Bid submission deadline

Online proposal submission deadline is 20.08.2026, 15:00 hrs IST on jharkhandtenders.gov.in.

• Modification/substitution/withdrawal of e-bid is allowed only prior to Bid Due Date; after withdrawal, re-submission is not allowed.

Bid / technical proposal opening

Technical proposals open on 21.08.2026 at 15:30 hrs IST; financial opening date of shortlisted firms will be notified later.

• Technical opening is both online and manual; financial opening is online only for firms scoring the technical cut-off.

Bid validity

Proposal remains valid for 180 days after the last date of submission.

• Bid Security must remain valid for 45 days beyond this bid validity period.

Assignment commencement and service period

Services commence within one month of signing the Consultancy Agreement; total AE engagement is 78 months (18 months construction + 60 months DLP/maintenance).

Project / civil works estimated cost

Underlying EPC highway project cost is stated as about Rs 96.01431 Cr for 15.90 km; this is the civil project cost, not the AE consultancy fee.

• Consultancy fee is bidder-quoted (QCBS); BOQ has blank rate fields for remuneration and reimbursables.

Tender / RFP document fee

Non-refundable Cost of RFP document is Rs. 30,000/-, to be deposited online as per IT & E-Governance Department order no. 120 dated 03.10.2023 at the time of online bid submission.

• One e-tendering note also says the original copy of Cost of RFP must be received before submission time; see contradictions.

Bid Security / EMD

Bid Security is Rs. 1,00,000/- (One lakh), required with the proposal; documents mix Bank Guarantee wording with online deposit under IT order no. 120 dated 03.10.2023.

• Where treated as BG: valid for 45 days beyond bid validity; format Appendix-M (also referred as Appendix-N in TOR).
• Successful bidder's Bid Security returned after Contract Agreement signing and Performance Security within 15 days of LOA; unsuccessful bidders' security returned within 28 days of end of bid validity (TOR).
• Forfeiture if bid withdrawn during validity, arithmetic correction not accepted, or successful bidder fails to sign / furnish Performance Security.

Performance Security

Successful firm must furnish Performance BG for 2.5% of Contract Value within 15 days of LOA, valid for 2 months beyond contract expiry.

• BG from any Scheduled Commercial Bank approved by RBI; foreign bank BG needs Nationalised Bank counter-guarantee in India.
• Printed performance BG form is Appendix H (contract); TOR wrongly cites Appendix I for this form.

Taxes and currency

All costs in Indian Rupees; Employer pays only service tax (as applicable) on services, while the consultant must build other taxes into the financial proposal.

• Consultant must deposit service tax with authorities and provide proof within 90 days of payment.

Payment terms

Monthly itemized billing; Client to pay within 60 days of receipt of supported bills; optional 10% interest-bearing advance against BG, recovered over first 12 months at 10% p.a.

• Remuneration is man-month based for key/sub-professional/support staff.
• From the 19th month after bid submission deadline, remuneration billing rates increase by 8% every 18 months (for payment only; evaluation uses initial rates).
• Transportation, duty travel, office rent, supplies, reports and survey equipment are converted to % of civil work cost and paid in proportion to civil work financial progress.
• Delayed payment interest under SC is 10% per annum.

Sole-firm only; JV/association barred for this bid

Although general RFP text discusses JV/associate, a specific amendment states No JV and Association is allowed for this bid; apply only as sole firm.

• General text otherwise limits JV to maximum 2 partners (lead + 1) and associate key personnel to maximum 3, but the bid-specific bullet overrides that.
• Submitting both as sole and in JV, or multiple JVs with different partners for the same work, leads to rejection/non-responsiveness under the general rules.

Firm experience (last 7 years) – sole applicant

Must meet both DPR and supervision/IE/AE experience thresholds on NH/SH/equivalent highways, including similar-category and bridge thresholds.

• DPR/Feasibility/PDR: aggregate highway length more than 30.00 km; plus at least one similar-category highway project more than 15.00 km; plus at least one bridge project more than 100 m.
• Project Supervision/IE/AE: aggregate highway length more than 45.00 km; plus at least one similar-category highway project more than 15.00 km; plus at least one bridge project more than 100 m.
• Lane-conversion factors: for 2-lane projects, 4/6-lane experience x1.5; 2-lane experience counts to 4/6-lane needs x0.75; 4/6-lane interchangeable.
• Client/employer certificates required; JV-share weightage rules apply to past assignments even if current bid is sole.

Turnover

Updated average annual turnover from consultancy business for last 3 years must be equal to or more than Rs. 10.00 Crores.

• Enhancement factors to common base: current FY 1.00; one year prior 1.10; two years prior 1.21; three years prior 1.33.
• Foreign currency figures use SBI BC Selling rate as on last bid submission date (no enhancement).
• CA-certified annual turnover / audited balance sheets required (FY 2023-24, 2024-25, 2025-26).

Technical qualification cut-off and evaluation

Minimum 75/100 technical marks to open financials; final ranking is QCBS with Tw=0.80 and Fw=0.20.

• Technical marks: Relevant firm experience 30 + Key staff competence 70.
• If fewer than two firms score >=75, Employer may pre-qualify lower scorers at sole discretion.
• Key staff marks (single package): Team Leader-cum-Highway Engineer 20; Bridge Engineer 15; Senior Quantity Surveyor 20; Material cum Geotech Engineer 15.
• If more than 2 key CVs score <75%, or Team Leader scores <75%, proposal is non-responsive.
• Same CV submitted by two firms scores zero; key personnel consenting to multiple bidders debarred 2 years.

Key personnel essential qualifications / age

Four evaluated key positions; each key person must be not more than 60 years on proposal submission date and meet Enclosure-B essential quals.

• Team Leader-cum-Highway Engineer: Civil graduate; 20 years highway contracts; >=10 years as TL/RE/PM or similar; >=2 construction supervision projects of similar nature as TL/RE/PM/similar; >=1 major highway project preparation >15 km as TL/similar.
• Bridge Engineer: Civil graduate; 15 years bridge supervision; >=10 years construction/supervision of bridges/structures; 2 major highway bridges on pile/well; rehabilitation/repair of 2 bridges.
• Material cum Geotech Engineer and Senior Quantity Surveyor: essential quals in Enclosure-B including age <=60.
• Permanent staff preferred; retainers get only 60% employment weightage; permanent = employed with firm >=1 year before tender notice month.

Debarment / ethics ineligibility

Firms debarred by SHAJ, NHAI or any other central/state government organisation with debarment in force on last submission date need not apply; corrupt/fraudulent etc. practices lead to rejection/ineligibility.

• Consultants, JV partners, sub-consultants and associates must not be under declaration of ineligibility for corrupt and fraudulent practices.

Portal registration

Bidder must be registered on http://jharkhandtenders.gov.in with user ID and password to participate.

Assignment and project package

Authority’s Engineer consultancy for supervision of widening & strengthening of Jainamore (Tilka Manjhi Chowk) to Phusro (Nirmal Mahato Chowk) (MDR-077) from 2-lane to 2-lane with paved shoulder on EPC mode in Jharkhand.

• Project length 15.90 km; approx. civil cost Rs 96.01431 Cr; construction period 18 months.
• Selection is National Competitive Bidding; selected AE to be intimated to the EPC Contractor.
• Contract reference: SHA/Tech/AE/Jaina more to Phusro/2026.

Duration and phasing

Total AE services 78 months: 18 months construction supervision + 60 months Defect Liability/maintenance period with reduced manpower.

• Key man-months (construction / DLP): Team Leader-cum-Highway Engineer 18 / 30 intermittent; Bridge Engineer 12 / 12 intermittent; Senior QS 18 / 4 intermittent; Material cum Geotech 18 / 4 intermittent.
• Sub-professionals include Survey Engineer 18, Lab Technician 18 (construction), Field Engineer 60 (DLP).
• Support: Office Manager-cum-computer operator 78 months; Office Boy 78 months.

Construction-period AE duties

AE must review contractor drawings/data, inspect works, enforce quality testing to IRC SP-11 and MoRTH specs, monitor milestones, and issue/recommend completion certificates with Authority prior approval.

• Drawing review observations within 15 days of receipt (major bridge/structure subject to TOR timelines).
• Monthly progress report comments within 7 days; monthly inspection reports; AE may recommend suspension for safety.
• Tests per Quality Control Manuals on random sample basis, independent of contractor's own QA.
• Prior written Authority approval needed before determining time extension, additional cost, termination payment, or material design deviations (crust thickness/composition, length/width, foundation type).

Defect Liability Period duties

During DLP, AE conducts at least monthly joint inspections, specifies tests/remedial limits and time for defect rectification, and controls lane closures for maintenance (permission within 5 days).

Site establishment / logistics requirements in financial proposal

Financial proposal must price site office (>=200 sqm construction; 100 sqm maintenance), vehicles (Innova/Scorpio or equivalent <=3 years old), duty travel (24 round trips each to Head Office and regional office), reports and survey equipment.

• Reports: Monthly reports 78x2 copies; Quarterly 20x2; various other EPC reports 5x2.

Submission mode and portal

Bids are submitted on e-tender portal http://jharkhandtenders.gov.in / www.Jharkhandtenders.gov.in; technical + financial uploaded online; financial online only.

• Two-part proposal: Part 1 Technical and Part 2 Financial.
• Authorized signatory holding Power of Attorney must be the Digital Signatory; mismatch makes bid non-responsive.
• Technical proposal also required in hard-bound physical form exactly matching the online submission (spiral/loose not accepted); opening of technical is online and manual.
• Clause 18 refers to receipt at 'address given below' but the address block is not printed after the schedule on p.7; use Member (Technical), SHAJ address used throughout the RFP.

Signing / CV attestation rules

CVs of key and sub-professional staff must be recently signed in blue ink on each page by the proposed professional and the MD/Head/authorized representative; firm must certify checked qualifications.

• Key personnel must certify non-consent to other bidders and availability; affidavit for correctness of CVs and firm experience on non-judicial stamp paper (Appendix B-8).
• Key personnel claiming society membership must attach self-attested membership copy.

Bid Security form: online deposit vs Bank Guarantee

NIT and several RFP clauses require online EMD under IT order no. 120 dated 03.10.2023, while other clauses require a Bank Guarantee in Appendix-M/N format—both wordings appear together.

• Action: treat both online portal EMD process and BG format references as live risk; seek written clarification before bid due date.
• TOR cites Appendix-N for BG format, but the printed format is Appendix-M only (no Appendix-N in the document).

JV/Association allowed vs expressly prohibited

A bid-specific bullet prohibits JV and Association, but surrounding clauses and formats still set JV eligibility, associate limits and JV document checklists.

• Prevailing for this bid: No JV and Association allowed (Section 1 cl.10 bullet). JV/associate formats are residual boilerplate.

Performance Security BG format cross-reference

TOR cl.13 says Performance BG format is Appendix I, but contract appendices assign Performance BG to Appendix H and Advance BG to Appendix I.

• Use Appendix H (explicitly titled Form of Performance Security and marked Clause-13 of TOR) for performance security; Appendix I is advance payment BG.

RFP fee: online only vs original hard copy

Most clauses say Rs.30,000 RFP fee is deposited online, but e-tendering instructions also condition responsiveness on receipt of original Cost of RFP copy before submission time.

• No separate physical fee-receipt address/deadline is cleanly specified beyond the general SHAJ office address.

Hard-bound technical submission vs electronic-only checklist wording

Section 1 requires a hard-bound technical proposal matching the online upload, while some e-tendering checklist headings label the same contents as electronic uploads only.

• Technical opening is expressly both online and manual, supporting that a physical hard-bound set is expected; exact physical delivery deadline is not separately dated beyond bid due/opening provisions.

Confirm exact Bid Security instrument accepted on portal

Ask SHAJ to confirm whether EMD must be paid only online under order no. 120 dated 03.10.2023, only as Appendix-M BG, or both, and which instrument is scanned/uploaded.

• Also confirm that Appendix-M (not Appendix-N) is the governing BG format and required claim/validity wording.

Physical hard-bound technical set: what, where, by when

Seek written confirmation of the exact office address, number of hard-bound sets, and deadline (bid due date vs opening date) for manual technical submission.

• Also clarify whether any original RFP-fee instrument must accompany the hard-bound set.

Status of JV/Association prohibition vs residual JV eligibility text

Confirm that sole-firm bids only are acceptable and that leftover JV/associate criteria and formats are to be ignored for evaluation.

Reimbursable payment linkage to civil contractor progress

Ask how office/vehicle/survey/report payments will be certified if EPC contractor progress stalls, and whether AE fixed establishment costs are protected.

• SCC converts non-remuneration items to % of civil work cost and pays proportionate to civil financial progress—material pricing and cash-flow risk.

Whether EPC contractor is already appointed and site data available

Request status of the linked EPC contract, access to DPR/EPC schedules, and site visit facilitation before bid due date for realistic manning and pricing.

• TOR blanks still show placeholder contractor name/date in the EPC Agreement reference.

Long 78-month commitment with intermittent DLP manning

AE is locked into 18 months construction plus 60 months DLP (5-year project DLP) with reduced/intermittent staff—cash-flow and staff retention risk over 6.5 years.

• Commencement within one month of agreement signing may be tight if LOA/negotiations slip.

Payment linkage of fixed costs to civil progress

Non-remuneration costs (transport, office, reports, survey etc.) are paid only in proportion to EPC contractor financial progress, shifting contractor delay risk onto the AE.

• Monthly bills may still take up to 60 days to pay; delayed-payment interest is 10% p.a.
• 10% advance is interest-bearing at 10% p.a. and recovered in 12 months.

Severe key-personnel replacement and CV penalties

Replacement of key staff attracts steep remuneration cuts and can make the bid non-responsive or lead to debarment.

• During negotiation: max 2 replacements; cuts 20%/30% (or 20/30/35% for low-scoring CV replacements); >2 replacements => non-responsive; third such non-responsiveness => debarment up to 1 year.
• During execution: replacement remuneration generally 80% of original; beyond death/extreme medical grounds, >50% key replacements can trigger higher penalty/termination/debarment up to 2 years; sub-professional replacement cut 80%.
• Incorrect CV information: 15% salary cut once; second time firm can be black-listed.
• Key personnel leaving without approval may be debarred; Employer may host CVs/credentials in public domain.

Performance / deficiency penalties and broad AE liability

AE must indemnify for direct loss/damage from deficiency in services; failure to notify contractor non-compliance or meet TOR timelines is treated as non-performance.

• Client may suspend payments for consultant failure (30-day remedy notice) and may terminate for convenience in its sole discretion (GC 2.9.1(f)).
• Performance Security is 2.5% of contract value for essentially the full 78-month tenure plus 2 months.

High technical bar and sole-firm constraint

Sole-firm only with >=Rs.10 Cr average consultancy turnover and substantial DPR + AE/IE supervision + bridge experience may sharply limit eligible bidders and partnership options.

• Team Leader must clear 75% CV score or entire proposal is non-responsive.

Document inconsistencies creating bid-responsiveness risk

Conflicting instructions on EMD mode, physical fee/originals, and hard-bound delivery create avoidable non-responsiveness risk if portal practice differs from RFP boilerplate.
