• Soft copy of EMD instruments / NTRP receipt+challan to be uploaded; original EMD hard copy mandatory (except NTRP where receipt/challan uploaded/submitted).

Performance Guarantee and Security Deposit

PG is 5% of tendered and accepted value within 07 days of award/LOA; SD is 2.5% deducted from RA and final bills.

• PG forms: Insurance surety Bond / DD / Banker’s cheque / FDR of Scheduled Bank in favour of PAO, NFC payable at Hyderabad, or Bank Guarantee from scheduled Bank valid up to 2 months after completion (NIT 28.0) / initially valid to stipulated completion + 60 days (GCC Clause 1).
• PG late submission: up to 07 days further with late fee 0.1% per day of PG amount/value.
• EMD returned after valid PG received.
• GCC allows SD recovery at 2.5% of gross amount of each running and final bill; SD refund linked to defect liability under Clause 17.

Need one similar completed work ≥ Rs. 24.88 Cr., OR two ≥ Rs. 18.66 Cr. each, OR three ≥ Rs. 12.44 Cr. each, during last 7 years ending 30.06.2026.

• Similar work means “Construction of buildings/Sheds”.
• Executed values escalated at simple 7% p.a. from completion date to previous day of last date of receipt of tender; free-issue materials excluded.
• Additional mandatory quantities: (C1) min 35 MT PEB/Structural steel (individually or combined) in one of the qualifying works or any other separate single completed work in same period; AND (C2) min 1500 Cum RCC likewise.
• Composite works: only similar component value counts; supporting SOR/contract/final bill/owner letter if value not clear from WO/CC.
• In-house experience not valid.
• Consortium/JV and foreign bidders not allowed; JV experience considered only for bidding entity’s own share.
• Subletting experience only for Govt. works with EE-or-above approval certificate.

Financial criteria — turnover, losses, solvency, bidding capacity

Average annual construction turnover ≥ Rs. 31.10 Cr. in last 3 FYs ending 2024-25; not more than two loss years in last 5 FYs ending 2024-25; solvency ≥ Rs. 12.44 Cr.; bidding capacity ≥ Rs. 31.10 Cr.

• Turnover certificate (Appendix-VII) + audited balance sheets last 5 FYs ending 2024-25 with CA UDIN + FORM-A.
• Solvency: scheduled bank certificate (Appendix-VIII) min Rs 12.44 Cr., not older than one year from tender opening/extended due date + FORM-B.
• Bidding capacity = [A × N × 2] – B, with N=2.0 years; A = max turnover in one year of last 5 years (completed + in progress), escalated 7% p.a.; B = existing commitments/ongoing works during this work’s completion period (FORM-D).
• Zero-turnover years still count in average.

Registrations and mandatory resources

Valid GST, PAN, LIN, ESI and EPF required; minimum key personnel and plant as per Appendices V and VI; evaluation scoring applies with 50% per attribute (other than financial strength & experience) and 60% aggregate.

Disqualification, debarment and integrity conditions

False/misleading PQ info, poor past performance, back-to-back execution of claimed similar works, code-of-integrity breaches and related offences can lead to disqualification, debarment and/or PG/EMD forfeiture.

• Clause 21: misleading/false representation or poor performance (abandonment, non-completion, financial failures, labour wage issues, poor safety) → liable to disqualification.
• Clause 35 / Bidder Declaration: eligible similar works must not have been executed through another contractor on back-to-back basis; violation → debarment forever in NFC/DAE and PG forfeiture if noticed before start.
• Clause 26: conviction under PC Act / causing loss of life or property, bribery, collusion, false declaration, non-disclosure of conflict/debarment etc. → non-responsive and debarment from NFC procurement for a period decided by department.
• Make in India false declaration → debarment up to 2 years (Appendix-II).
• Near-relative restriction in NFC (Clause 33); retired gazetted engineer restriction 2 years without GoI permission (Clause 34).
• Zero deviation: deviations/stipulations/clarifications/assumptions → summary rejection (Clause 7.0).
• GFR 144(xi) land-border restrictions apply (Appendix-I certificates).

Make in India / local content

Bids must conform to Make in India (Appendix-II); for procurement value > Rs.10 crores, Class-I/Class-II local suppliers need statutory auditor/cost auditor/practicing CA certificate of local content percentage.

• Class-I: local content ≥ nodal ministry/NIT prescription or 50%, whichever higher.
• Class-II: more than nodal/NIT or 20% whichever higher, but less than Class-I threshold.
• Offers without requisite certificate treated incomplete and not considered.

Major measured works include large RCC volumes (M40/M35/M25), ~107 MT structural/PEB steel primary+rolled, 670 MT CRS reinforcement, PH/electrical packages; PEB is design-fabricate-erect with third-party certified footing reactions in Part-1 bid.

• Tech forms checklist requires self-attested WOs, completion certificates etc.
• Solvency on bank letterhead sealed and addressed to tendering authority.

No corrigendum / addendum found in the tender document set

The downloaded tender pack contains no corrigendum or addendum files, and no issued amendment changing dates, amounts or conditions was identified in the documents.

• Bidders should still monitor CPP Portal until bid closing because Appendix-XIV states changes will be intimated only via corrigendum/addendum/amendment on the website.
• Values that finally apply are therefore those in the original NIT/bid documents (key dates, EMD Rs 41,10,000/-, estimate Rs. 31.10 Cr., 24-month completion, 365-day bid validity, etc.).

Partial EMD-as-BG cash portion wording differs between NIT and Schedule F

NIT requires minimum Rs. 20.00 Lakhs in non-BG forms before balance BG; Schedule F says “50% of earnest money or Rs. 20.00 Lakhs whichever is less”.

• For EMD Rs 41,10,000/-, 50% is Rs 20.55 Lakh, so Schedule F’s “whichever is less” still yields Rs 20.00 Lakh — practically aligned with NIT’s Rs 20.00 Lakh minimum, but the formulae differ and could matter if EMD amount is amended.
• Action: treat Rs. 20.00 Lakh cash-like minimum as the stated floor unless NFC clarifies; use Annexure-III BG only for the balance.

PEB seismic design location: Hyderabad vs actual Tuticorin site

PEB specification says earthquake loadings “as per IS 1893 for Hyderabad or for location of shed”, while project site data is Tuticorin/Pazhayakayal Seismic Zone II.

• Special Instructions give site seismic Zone II at 8°42'N, 78°07'E (Tuticorin).
• Using Hyderabad parameters could mis-design relative to site; bidder should seek written clarification which seismic zone/parameters govern PEB design and footing reactions submitted with Part-1 bid.
• Site-specific data in Special Instructions is more specific to this project location than the PEB generic wording.

Performance Guarantee validity wording: NIT vs GCC

NIT 28.0 says PG valid up to 2 months after completion; GCC Clause 1 says initially valid up to stipulated completion plus 60 days.

• Both are essentially completion + ~60 days / 2 months, but exact instrument wording should follow LOA/NFC approved format and GCC annexure; extend if time is enlarged.

Bidder Declaration EMD instrument list narrower than NIT

Bidder Declaration text lists DD/Pay Order/FDR/Banker’s Cheque/Deposit at call Receipt, while NIT also expressly allows Insurance Surety Bond and NTRP online payment.

• NIT Clause 4.3 is the operative EMD clause; Declaration is a bidder undertaking template and should be read with NIT-permitted instruments.

Confirm governing seismic parameters for PEB design and Part-1 footing reactions

Ask NFC to confirm whether PEB/IS 1893 design must use Tuticorin site Zone II data or Hyderabad parameters, and what third-party certification standard is acceptable for Part-1 submission.

• Affects PEB tonnage, foundation design interface, price and risk of ±10% post-award variation rejection.
• Also ask whether PEB design is fully contractor-designed (design-build) against departmental preliminary drawings only.

Clarify partial EMD BG formula if instruments straddle Rs 20 Lakh / 50%

Seek confirmation that cash-like EMD minimum is Rs. 20.00 Lakhs (NIT) and whether Schedule F “50% or Rs 20 Lakh whichever less” changes anything for this tender.

• Wrong instrument split can cause summary rejection for invalid EMD.

Make in India local-content methodology for this works contract

Ask how local content % is to be computed for a composite civil/structural/electrical works contract and whether Class-I preference applies despite NIT saying no SSI/MSME/PSU purchase preference.

• Appendix-II requires auditor certificate for >Rs.10 Cr and incomplete without it; works contracts often need explicit calculation guidance (materials vs labour/services exclusions).

Milestone withhold amounts and programme approval timing

Schedule F says milestones are submitted by party and finalised by EIC after award, and amount withheld for non-achievement is “To be decided by EIC” — request indicative milestone structure/withhold percentages before bid.

• Cash-flow and LD exposure cannot be priced precisely while withhold amounts remain open-ended.

Nuclear site access logistics: PVC, height pass, medical and labour camp constraints

Request realistic lead times and capacity for PVC, NFC medical/height tests, safety training passes, and confirmed locations for site office/cement godown/labour camp given no hutments at site and security area limits.

• Rates must include PVC with no extra; height >3.0/3.5 m needs passes; safety training pass valid 3 months; labour camp only 1 week before start to 15 days after completion.
• Material entry/exit CISF controls and coordination with other contractors can drive idle time.

Power and water continuity risk and recovery confirmation

Confirm guaranteed construction power availability, shutdown liability beyond 24 hours, and whether water 1% gross + power Rs.14/kWh are fixed recoveries even if contractor arranges alternate supply.

Delay compensation / LD up to 10% of tendered value

Compensation for delay @ 1.5% per month of delay (per day basis) on tendered value, capped at 10%; milestone withholds automatic and interest-free.

• Early completion incentive Not Applicable.
• Extension authority CE, NFC / CE & DCE; milestones finalised post-award with withhold amounts TBD by EIC — pricing uncertainty.
• 24-month programme includes monsoon; coastal Tuticorin rainfall and nuclear-site access frictions can still create delay exposure.

Heavy site-accident penalties over and above statutory compensation

Annexure-I to Schedule F levies NFC penalties up to Rs.15.0 Lakhs for fatal accident, plus medical expenses and Employees Compensation Act liabilities.

• Other fixed penalties include Rs.10 L both limbs/eyes, Rs.5 L single limb/eye, etc.
• NFC classification of injury and penalty is final and binding as stated.
• Separate recoveries for non-deployment of key staff (e.g. Project Manager Rs 60,000/month) and safety supervisor penalties.

Nuclear security / PVC / AERB control-of-works constraints

Work inside DAE/NFC security area with CISF controls, PVC for all labour, medical and height passes, AERB Control of Works and safety lifeline rules — high compliance cost and schedule risk, no extra for PVC.

• Safety non-compliance can attract heavy compensation; delay due to safety compliance not treated as genuine EOT cause.
• Dark blue uniforms distinct from NFC; extensive labour-law compliance stack.

Zero-deviation, AHR and one-sided rate determination

Any deviation leads to summary rejection; EIC-determined extra/substituted/AHR rates are final, binding and non-arbitrable; building work deviation limit 30%.

• AHR items defined as quoted rates ≥ departmental estimate +25%; beyond WO quantities, payment is minimum of market and WO rates.
• Conditional rebate also causes summary rejection.
• Drawings only preliminary — scope evolution risk until detailed drawings issued.

Payment, recovery and working-capital risks

Site is coastal and highly corrosive; large protective coating, CRS rebar, M40/M35 concrete with corrosion inhibitors and PU paint systems increase quality and performance risk.

• Basic wind speed 55 m/sec; PEB sheeting and structural coatings must suit environment.
• Quality performance carries 40/100 marks in pre-eligibility scoring and may involve site inspection of past works.

EMD and bid-security cash lock / no MSME exemption

Rs 41.10 Lakh EMD with no SSI/MSME/PSU exemption; BG/Insurance Surety validity 365 days; physical original required — high bid-cost and rejection risk if instrument defective.

• Hard copy must match portal data; postal delay may be rejected.
• Tie-breaker revised-offer process can forfeit 50% EMD if bidder quotes higher revised item rates or refuses revised offer.
