Performance security

5% of Contract Price (plus unbalanced-bid additional security) within 15 days of Letter of Acceptance, as BG (Section 7 form) or FDR in name of concerned EE; PBG valid until 45 days after expiry of Defect Liability-cum-Maintenance Period.

• No additional BG for quotes up to 10% below DNIT; additional performance security equals percentage-below beyond 10% (e.g. 13% below → 5% PS + 3% additional = 8% of quoted price).

Retention, advances and payment terms

Retention 6% from each bill capped at 5% of final contract price; interest-bearing mobilization advance up to 5% (works > Rs 2 crore) against BG; secured advance 75% of invoice value; monthly running bills; GST reimbursed on proof.

• On whole-work completion, half retention repaid; remaining half after Defect Liability-cum-Maintenance Period and defect correction certificate; retention may be substituted by on-demand BG/FDR after completion.
• Mobilization advance interest @ SBI MCLR prevalent at tender time; recovery with interest desirable within 80% of stipulated time; use only for Equipment/Plant/Mobilization with invoice proof.
• Payment Caping: running/final bills paid at lowest of (i) amount at accepted rates of lowest agency and (ii) amount at accepted % above/below HSR+CP/analytical/NS rates per financial statement (made part of agreement).
• Bid rates exclude GST but include other duties/taxes/royalties; GST reimbursed on production of proof of deposit for previous payment.
• Price adjustment applies for bitumen, cement/steel and POL per Contract Data formulae; no cement/steel/bitumen increase reimbursed beyond original contractual time even if time extended.
• Monthly statements by 1st week; if not submitted, Engineer prepares by end of 3rd week.

Portal registration / contractor ID

Invitation open to bidders who have created contractor ID on https://works.haryana.gov.in and meet ITB eligibility; interested bidders must have contractor ID on HEWP.

Financial turnover

Minimum average annual financial turnover during last three years ending 31st March of previous FY: Rs 1056.96 lacs (30% of value of work), CA-certified and updated @8% compounded yearly.

• Applies under ITB 4.5A(i) because work is above Rs 64.01 Lacs.

Similar work experience

During last seven years ending last day of month previous to bid invitation: either three similar works each ≥ Rs 1409.28 Lacs, or two ≥ Rs 1761.60 Lacs, or one ≥ Rs 2818.56 Lacs; Similar Work = Building Works.

• Amounts updated to last FY price level @8% compounded yearly.
• Substantially completed = at least 95% of original/enhanced contract price completed and continuing satisfactorily.
• Experience as prime contractor or JV member (proportionate); sub-contractor experience needs Principal Employer certificate.
• Employer certificate must state name of work, contract value, billing amount, commencement, satisfactory performance etc.
• Sub-contractors’ experience/resources not counted toward bidder qualification.

Available bid capacity

For works above Rs 25.01 Lacs, Assessed Available Bid Capacity = (A×N×2 − B) must be ≥ total bid value.

• A = maximum financial turnover in any one of last three years (updated @8% compounded); N = years prescribed for completion (≤6 months = ½; >6 months as 1 in a year); B = value of existing commitments/ongoing works during the completion period (current price level @8%).
• For this 24-month work, N is two one-year units under the stated rule.
• Contract not awarded if available bid capacity is less than evaluated bid (works > Rs 25 Lacs).

Joint venture / consortium

Joint Ventures are Not allowed for this tender (Appendix to ITB / Contract Data).

• Although ITB contains generic JV rules (max 3 partners, lead ≥50%, others ≥25%), Appendix expressly disallows JV and controls.

Debarment / blacklisting / integrity

Co-operative societies must produce attested copy of Co-operative department resolution for issuance of tenders; conditional tenders liable to rejection; single-tender handling rules apply.

• No post-bid self-submission of new technical documents; only clarifications on already-uploaded documents.

Request the specimen financial statement methodology comparing accepted % vs HSR+CP/analytical/NS rates, and whether it can reduce payable amounts below quoted BOQ totals during execution.

• ITB 30 / GCC 43 pay the lowest of accepted rates and HSR-based financial statement—material to cash-flow and margin.

Liquidated damages and milestones

LD = (1/2000)th of initial/revised Contract Price per day (rounded to nearest thousand) for whole-work delay and for each missed milestone; overall LD cap 10% of contract price.

• Milestones: 20% financial progress by 25% time; 50% by 50%; 75% by 75%; 100% by 100% of stipulated time.
• 24-month programme on a live jail site with multiple building types heightens milestone LD exposure.
