Tender document fee

Tender cost is Rs. 7,500 + 18% GST, payable by RTGS to the same EE ED-I ICICI account with UTR upload and hard copy by 08.09.2026.

• Documents can be viewed/downloaded free from the e-tender portal; fee is still required to participate as per NIT/ITT.
• If tender becomes invalid after opening for ineligibility or document mismatch, tender document cost and processing fee are not refunded.

Performance / security deposit

Successful bidder must deposit 10% security (FDR/CDR pledged to EE, ED-I, Lucknow) within 7 days of the acceptance letter and before agreement; additional performance security applies on below-BOQ rates.

• Failure to deposit 10% security → EMD forfeiture and blacklisting process.
• Additional security/performance guarantee (GO 622 dt. 08.06.2012 / CE letter 4196 dt. 14.09.2018): for rates up to 10% below BOQ — 0.50% extra security per 1% below; beyond 10% below — 1% extra per 1% below; to be deposited within one week of bid opening as FDR/CDR of a nationalised bank pledged to EE ED-I.
• GCC: 10% security at bonded cost at bond execution, else recoverable from running bills; EMD adjusted; may be cash/FDR of scheduled/nationalised bank/Govt securities/guarantee bonds; normal refund after 6 months of completion or final bill, whichever later (75% interim possible if final bill delayed).
• Appendix E: 10% security against warranty is releasable after the completion period on Engineer-in-Charge recommendation.
• Commissioner Varanasi meeting (bound into tender via NIT cond. 35) directed holding 30% security money released 10%+10%+10% over three O&M years — conflicts with the 10% tender/GCC text (see contradictions).

Taxes and payment terms

BOQ rates exclude GST (payable extra as per rules) but include all other taxes; bill payment is only after Tourism Dept/administration releases funds to UPAVP as a deposit work — no contractor claim for delay.

• Agreement requires Rs.100 non-judicial stamp paper (or as ordered by court/Govt).
• If below/above is not marked on the rate, it is treated as Below.
• Percentage additions/deductions apply on gross bill amounts (GCC Clause 36).
• No payment for rain/Act of God damage during execution.
• Permanent EMD (general security) vs total EMD difference must be deposited with the tender or bid is not considered (NIT cond. 24).

Registration / enlistment

Open to experienced firms registered as contractors in U.P. Housing Board or other U.P. Government departments/PSUs; enlistment must be valid on the last date of tender submission.

• Two-bid e-procurement on percentage-rate form.
• Digital signature holder required to bid online.
• Only 'A' Class Electricity Safety Licence holders’ bids are acceptable (NIT cond. 32).
• Valid GST registration mandatory; also PAN and labour cess proofs.
• Labour Department registration of contractor/workers is mandatory.
• List of documents also asks for copy of pre-qualification/enlistment letter issued by UPAVP (narrower than the broad UP dept/PSU registration on the cover NIT).

Similar work experience

In the last 7 years (ending last day of month before applications): one similar work ≥80% of bid amount, or two ≥50% each, or three ≥40% each, in organised sector (Govt/Semi-Govt/Public Sector).

• Similar works means commercial work of similar nature as the tender (facade lighting).
• Experience certificates only from Engineer-in-Charge not below Executive Engineer (or equivalent) are acceptable.
• Executed values enhanced to current level at simple 7% per annum from completion date to last date of bid receipt.

Turnover, liquid assets and bid capacity

Average annual financial turnover for last 3 years ending 31 March 2025 ≥ 30% of bid value; liquid assets ≥ 15% of bid value (bank certificate not older than 6 months); available bid capacity (2*A*N − B) must be ≥ total bid value.

• A = max electrical engineering works in any one year of last five years, updated @8% per year; N = years allowed for completion (here 12 months → 1 year); B = value of existing commitments during the completion period.
• CA certificate/affidavit of turnover for last 3 years to be uploaded (full balance sheets not required initially).
• Appendix B for liquid assets; Appendix K for ongoing commitments.

Staff, T&P and other certificates

Must declare technical staff (graduate + diploma electrical as directed by E/I) and T&P on notarised Rs.10 affidavits; character and solvency certificates from District Administration required.

• Absence of required engineers attracts non-refundable deduction @ Rs.25,000 or Rs.20,000 per month from bills as applicable.
• All uploaded certificates must remain valid for at least 1 month after bid opening date.
• Bar chart to be uploaded.

Debarment / blacklisting / integrity

Only bidders not on the banned/black list of the U.P. Government or any other State Government in India may participate; false documents, mafia links or integrity failures trigger rejection, EMD forfeiture, contract cancellation and blacklisting.

Deliverables, standards and quantities

Percentage BOQ for SITC of IP68 facade/wash LED luminaires (mono and RGBW/DMX), related electrical/civil accessories; total BOQ amount Rs. 16,93,19,377.01; quantities may vary with no claim.

• Typical fixtures require BIS IS 10322, CE/NABL test credentials, specified efficacy/IP/IK, approved makes (Philips/Havells/Bajaj/K-lite/Leksa/Wipro or equivalent as directed by E/I), and LED life ≥50,000 hours at L70.
• Special conditions: contractor-arranged materials to IS/approved brands with purchase bills and quality certificates; sampling/testing at contractor cost; samples approved before use.
• External electrification detailed specifications (HT/LT, poles, etc.) form part of the bid document.

O&M, warranty, handover and completion

12-month completion; after handover, 3 years operation & maintenance by the firm at no extra payment, plus material warranty 60 months (5 years) from handover; firm must hand over to the local body and obtain related NOCs.

• Appendix E: defects in O&M/material warranty period to be rectified within 10 days of notice at contractor cost; ward & watch during stipulated period at firm’s cost.

Security retention 10% vs meeting direction for 30%

NIT/GCC/Appendix E require 10% security, but the 30.06.2026 Commissioner meeting minutes (incorporated by NIT cond. 35) directed 30% security money released 10% per year over 3 O&M years.

• GCC also refunds security after six months of completion, which conflicts with multi-year O&M retention.
• Bidders should seek written clarification which security quantum and release schedule will be enforced in the agreement.

Defect liability / warranty period inconsistency

Appendix E requires 3-year O&M plus 5-year material warranty; Appendices F/G require 60-month defect/material warranty from handover; GCC Clause 40 cites 3-year building/electrical defect liability with 1% or general security forfeiture.

Clarify contractor’s 3-year free O&M/ward-watch obligations versus meeting direction that Nagar Nigam will takeover & maintain after completion via MOU.

Definition of acceptable similar facade-lighting experience

Request written confirmation whether only completed facade/monument lighting in Govt/PSU counts, and whether private commercial facade lighting is excluded by “organised sector”.

No time-extension clause vs heritage-site realities

Ask whether NIT’s blanket “no time extension” survives festival/ASI/temple-authority access stoppages, and how LD will be applied.

• 12-month schedule across multiple live religious/ghat sites is execution-critical.

EMD exact amount and IFSC before RTGS

Confirm exact EMD rupees (33.85 vs 33.86 Lacs) and IFSC ICIC0004698 in writing before transferring ~Rs. 3.386 Cr.

Heavy delay damages and no-extension stance

GCC LD up to ~1% of estimated cost per day of delay (capped at full security amount) with time of essence; NIT says no time extension will be allowed.
