• Forms: DD on Nationalised/Scheduled Bank in Client's name; BG from Indian Nationalized/Scheduled Bank (or acceptable foreign bank branch in India); or IRDAI Insurance Surety Bond valid till three months beyond contract period (form notes also refer six months beyond completion — see contradictions).
• Delayed submission without valid reason attracts simple interest @12% p.a. on full PS; failure within 60 days of LOA (contract >12 months) leads to award termination, EMD forfeiture, 1-year debarment and re-tender ineligibility.
• PS released after successful completion of entire contract period including extensions; no interest on PS.
• Advisory Bank for ePBG: State Bank of India.

Payment terms

GeM payment timeline: within 30 days of SDAC and online bill submission (superseding GeM GTC cl.12's 10 days). Contract payments via monthly RA bills by NHPC Finance, Faridabad, through ECS.

• No RA payment without EPF/ESI deposit proof, wage sheets and bank-transfer labour payment proof for the billed period.
• Worker wages by 7th of succeeding month via NEFT/ECS; delay attracts 1% of gross monthly RA bill penalty (waivable if delay beyond control).
• Minimum wages reimbursable on statutory revision with related EPF/GST increments; present unskilled minimum wage cited Rs. 827/day (Area-A).
• Reimbursables on evidence: uniforms up to Rs 3500/head/annum incl. GST; PMJJBY @ Rs 436 + GST/worker/year; EC+Mediclaim premium limited to 3.29% of Rs 21000/month/worker (max Rs 1,76,097 incl. GST for 9 workers/2 years); annual health check-up up to Annexure-A rates.
• TReDS preferred mode for MSME sellers where buyer is registered.
• Prices firm and inclusive of labour, statutory costs, consumables/materials (as applicable) and taxes after ITC; statutory variation after bid-28-day cut-off adjustable on evidence.

Who may bid

Open to sole domestic bidders that are registered legal entities (Firm/Company/Proprietary firm) and Class-I local suppliers under DPIIT Make-in-India order; JV/consortium not allowed.

• Notarized Registration Certificate / Certificate of Incorporation required.
• Work experience as sub-contractor not counted.
• Entity must be registered in India; bid currency INR only.
• Land-border sharing country bidders eligible only if registered with Competent Authority (GeM GTC cl.26).

Financial turnover

Minimum financial turnover in any one year in last three years ending FY 2024-25 at least Rs. 68,18,644.00 (estimated cost excluding GST).

• Support: notarised printed annual reports/financial statements/auditor reports for past three years ending FY 2024-25, or CA certificate with UDIN if audited accounts unavailable.

Past experience / similar works

NHPC ATC requires similar horticulture maintenance works in last 7 years (ending 28 days before online bid deadline): one work Rs. 64,36,800.00 OR two each Rs. 40,23,000.00 OR three each Rs. 32,18,400.00.

• Similar works means “Maintenance of Horticulture works”.
• ‘Completed’ means at least one (1) year continuous service even if contract not closed, with owner documentary evidence.
• Support: notarised Work/Supply Order/LOA with detailed BOQs + successful completion/installation certificates; if non-government owner, also notarized TDS certificate; list in Format-14.
• GeM bid standard text also states a different 3-year 40%/50%/80% experience formula — conflict recorded under contradictions; ATC NIT values are the specific NHPC criteria.
• MSE/Startup complete experience relaxation available with supporting exemption documents.

Registrations, integrity and debarment

Must produce PAN, GSTIN, EPF and ESIC registrations; not banned/blacklisted/debarred (Format-7); not under IBC proceedings (Format-10); and must enter Integrity Pact (Format-12) as basic QR.

Work and location

Lumpsum horticulture maintenance of NHPC Office Complex, Sector-33, Faridabad for 24 months, covering lawns, trees, shrubs, hedges, flower beds, potted plants, pesticides/fertilizers/fungicides and garden-waste removal.

• GeM item category also includes site clearing, soil preparation, planting, mowing/strimming/sweeping/watering/weeding, trimming & pruning, irrigation and garden designing; propagation method seeds.
• Estimated plants to be maintained/cultivated: 1300 (GeM consignee table).
• Manpower deployed may be required to work anywhere in Delhi/NCR without extra payment as directed by Engineer-in-Charge.
• Yard stick noted: 1 Mali = 1.25 Acre; permanent office accommodation referenced in BOQ Item 1.

Deliverables / BOQ items

BOQ covers six lumpsum items: 24-month complete garden maintenance with 09 unskilled Mali/Beldar; 72 cum cattle manure; fertilizers/pesticides package; winter & summer seasonal seedlings; and 72 trips garden-waste removal.

• Item 1 includes hoeing, weeding, pruning, gap filling/replacement, watering, mowing, brush cutting, waste removal, insecticide/pesticide/fertilizer application, top dressing and topiary/designer hedge works.
• Manpower schedule Annexure-B: Mali/Beldar (Unskilled) — 09 per day.
• Item 3 fertilizers/pesticides for one year, 1/4th quantity quarterly (Rogor 8 L, Thimate 8 kg, Chlorpyriphos 8 L, Potash/Urea/DAP/Zinc sulphate 80 kg each, Neem cake/Vermicompost 120 kg each).
• Item 2: 72 Cum well-decayed cattle manure (stack measure reduced 8% for payment).
• Item 6: Removal of garden waste by TATA 407 or equivalent, 72 trips up to 15 km lead to designated office-complex places.
• Seedling trays (100 plants/tray) for listed winter/summer seasonal varieties (Items 4–5).

Manpower, T&P, materials and standards

Contractor must deploy 09 unskilled workers with prescribed minimum T&P stock; no departmental T&P. Water available at hydrants; contractor carries water onward.

• Minimum T&P includes powered/manual lawn movers, bush cutter, chain saw, spray machines, pipes, hand tools, etc. (SCC list I–XX).
• BOQ Item 1 text says good earth, manure, fertilizer, insecticide, pesticide, lawn mover and brush cutter with fuel will be provided by Department — this conflicts with SCC/BOQ supply items (see contradictions).
• Works as per latest CPWD specifications and relevant IS codes; NHPC Safety Manual applies.
• Commence within 10 days of LOA and signing of Contract Agreement.

Submission mode and covers

Single-stage two-part e-bid on GeM (https://gem.gov.in): Part-I Techno-Commercial (no prices) and Part-II Financial/Price Bid (Schedule of Quantity & Price online only).

• Submission by any mode other than GeM online is not accepted.
• Offline: one sealed envelope of hard copies marked “Hard copy(ies) of documents for the work “Maintenance of Horticulture works at NHPC Office Complex, Sector-33, Faridabad””, by hand or registered mail, deadline two hours before opening; late/missing hard copies make bid non-responsive (except eligible MSE & Startup firms, for whom hard copies are not mandatory).

Past experience criteria: GeM standard vs NHPC ATC

GeM bid states last-three-years similar services at 40%/50%/80% of estimated cost; NHPC NIT requires last-seven-years horticulture maintenance at fixed values Rs 64.368 L / 40.23 L / 32.184 L.

• ATC NIT is the buyer-specific qualification text bidders must meet (and formats/support evidence follow ATC).
• Percentages of estimated Rs 80.46 L equal the ATC rupee thresholds, but look-back period differs (3 years vs 7 years) and GeM wording uses a different year-count formula.

Bid validity start point

GeM header says 120 days from Bid End Date; NHPC NIT says 120 days from opening of Techno-Commercial Bid; Bid Proforma refers validity reckoned after online bid submission deadline.

• No corrigendum resolves this. Practically keep offer valid for 120 days covering both end-date and opening-date readings (they are same calendar day here, 01.09.2026).

Who supplies manure/fertilizer/pesticide and lawn mower/brush cutter

BOQ Item 1 description says Department provides good earth, manure, fertilizer, insecticide, pesticide, lawn mover and brush cutter with fuel; SCC and BOQ Items 2–3 require contractor supply of manure/fertilizers/pesticides and all T&P including powered lawn movers/brush cutter.

• SCC cl.2: no T&P from department; contractor arranges machines and fuel.
• SCC cl.1(iii)-(iv) and BOQ items 2–3 require contractor to provide seedling/manure/fertilizer/pesticide packages.
• This affects pricing of Items 1–3 and risk of double-counting or under-provision — needs pre-bid clarification.

Performance security validity wording

GeM ePBG duration is 27 months; GCC Insurance Surety Bond text says three months beyond contract period; PBG form note says six months beyond contract completion period.

• Contract period is 24 months, so 27 months ≈ 24+3 months; the form’s “six months beyond” is longer and inconsistent.

Physical hard-copy prerequisite vs GeM disclaimer

NHPC ITB makes non-receipt of hard-copy Integrity Pact/EMD a non-responsive bid, while GeM bid disclaimer says mandating physical documents as a pre-requisite to qualify bidders can render bid/contract null & void.

• MSE/Startup hard copies are stated as not mandatory in ITB, partially mitigating but not removing the conflict for other bidders.

Governing conditions hierarchy

NHPC tender states its GCC supersedes GeM GTC; GeM bid says Service Level Agreement overrides GeM GTC if contradicted; SCC prevails over NHPC GCC on conflicts.

• Bidders should treat NHPC ATC/GCC/SCC as buyer-specific conditions layered on GeM, and flag residual conflicts (e.g. payment 30-day SDAC vs RA-bill regime).

Department vs contractor supply of inputs and machines

Please confirm whether manure, fertilizers, insecticides/pesticides and lawn mower/brush cutter with fuel are free-issue by NHPC (as BOQ Item 1 text) or contractor-supplied (as SCC cl.1–2 and BOQ Items 2–3), and how Item 1 price should treat these costs.

• Material to pricing of Fixed Cost/Service Charge and risk of non-provision deductions.

Which experience formula will be evaluated

Confirm whether evaluation will apply NHPC NIT 7-year thresholds or GeM standard 3-year 40/50/80% criteria (or both).

• Also confirm reference date “28 days prior to online bid deadline” for counting completed works.

Hard-copy EMD/Integrity Pact necessity on GeM

Confirm whether physical submission of Integrity Pact and original EMD remains mandatory for non-MSE bidders despite GeM disclaimer against physical pre-qualification documents, and the exact offline delivery address/deadline.

• ITB non-responsive consequence is severe if hard copies are still insisted upon.

Garden area and deployment basis

Please provide actual garden area (acres) maintained under the 1 Mali = 1.25 Acre yard stick and clarify how 09 Mali relates to area, the 1300 plants figure, and Delhi/NCR deployment without extra payment.

• Needed for productivity/risk assessment and absenteeism exposure.

Performance security validity period to be furnished

Confirm required PS/ePBG validity: 27 months (GeM), contract period + 3 months (GCC surety text), or + 6 months (PBG form note).

Below-floor-price automatic rejection

Item No.1 quote below Fixed Cost Rs. 72,88,731/- is treated non-responsive; only excess is service charge, limiting pricing flexibility on labour-heavy item.

• Fixed cost is built on notified minimum wages and statutory loadings; under-quoting is not a viable bid strategy.

Manpower absence and wage-payment penalties

Absence of unskilled manpower attracts deduction at 1.5× prevailing minimum labour rate with no allowances; late wage credit beyond 7th attracts 1% of monthly RA bill.

• Non-deployment versus Annexure-B also allows recovery at prevalent labour rate + 50%.
• RA bills blocked without EPF/ESI and wage-payment proofs.

Unsatisfactory performance / termination risks

Performance reviewed every three months and contract may be cancelled forthwith if unsatisfactory; NHPC may terminate and get work done at contractor’s risk and cost.

Failure to submit 5% PS within 60 days of LOA can terminate award, forfeit EMD, ban business dealings for one year and bar participation in re-tender.

Full labour-code/minimum-wage/EPF/ESI/bonus/gratuity compliance sits on contractor; NHPC may pay workers and recover with 15% overhead if contractor defaults.
