Legal constitution

Bidder must be a company under Companies Act 1956/2013, or a Partnership, LLP or Proprietary Firm, with incorporation/relevant documentary evidence.

West Bengal registration

Firm/Agency/Company shall be registered in West Bengal under the relevant Act/Rule (Company Act, Proprietorship Act etc. as applicable).

• This is a pass/fail local registration condition distinct from central Companies Act registration.

Experience

Minimum 5 years' experience in developing IT software is mandatory.

• Technical scoring separately awards up to 10 marks for years of IT experience and up to 10 marks for number of IT applications of Rs. 20 lakhs or more for State/Central Government Department or Undertaking (2 marks per completed project).
• Bidder must be prepared to substantiate claimed experience if requested.

Turnover

Annual turnover of Rs. 1.00 Crore or more in each of the last 2 Financial Years 2024-2025 and 2025-2026; if current-year audited BS not available, submit 2023-2024 and 2024-2025.

• Support by Audited Balance Sheet / Audited Accounts / Auditor Certificate.
• Scoring uses Average Annual Turnover of last 3 years ending 31st March 2025 (2 marks per Rs.1 Crore, max 10)—different window from the eligibility years.

Blacklisting / integrity / debarment conditions

FORM TECH-2C requires solemn declarations on non-blacklisting, no terminated/foreclosed contracts in last 5 years, no corrupt practices, no insolvency, and no convicted directors; false documents attract forfeiture and 3-year debarment from ADDA tenders.

• Corrupt/fraudulent practices can lead to proposal rejection and ineligibility indefinitely or for a stated period.
• Only one proposal participation allowed; multiple proposals cause disqualification.

Financial score formula defines HB as both lowest and highest bid

Pf = (HB / LB) × 100 defines HB first as Lowest Bid Price and then as Highest Bid Price, making the formula unusable as written.

• Standard QCBS usually uses Llowest/Lbid; here both HB and LB labels are muddled.

LOI vs LOA trigger for performance security timeline
