Bid submission deadline

Bid validity

Intended completion / contract period (as printed)

NIT states period of completion as 90 days; Conditions of Contract also state the work is to be completed in 30 days — see contradictions. BOQ manpower quantities indicate about 12 months of operations staffing.

• Programme start date is the date of concluding agreement, not site handover date.
• Defects liability / observation period after completion is 24 months.

Estimated contract value

Estimate contract value (ECV) put to tender is Rs.32,44,391/- (Rupees thirty two lakhs forty four thousand three hundred and ninety one only).

• Form of contract is L.S. (lump sum / percentage tender on Schedule A).
• Price bid is an overall tendered percentage Excess or Less over the estimated value of contract.
• Tenders with excess above 5% of ECV are summarily rejected.

EMD / bid security

EMD amount stated as Rs.81,150/- (2.5% of ECV), to be paid online via Net Banking/Cards/Online Challan from registered bank accounts; scanned proof uploaded with bid and original online-payment proof to reach the Executive Officer before price-bid opening.

• NIT labels the Rs.81,150/- amount as “EMD and FEMD … at 2.5% of the estimated contract value … along with bid documents”.
• ITT also states balance EMD @ 1½% of ECV/TCV whichever is higher is payable at agreement by DD or BG on a Nationalised/Scheduled commercial bank (internal inconsistency with the 2.5% upfront figure — see contradictions).
• Successful tenderer’s EMD as BG shall be valid for contract period plus defect liability of two years (and extended if contract is extended).
• Separately, Earnest Money shall be valid until 28 days from expiry of Defects Liability Period.
• EMD does not carry interest; returned when tenders are finalized or at end of tender validity, whichever is earlier (unsuccessful).
• EMD is forfeited if tender is withdrawn during validity, or successful tenderer fails to sign agreement.
• Failure to furnish EMD proof before price-bid opening: bid rejection and 12-month e-procurement suspension.

Transaction fee and e-procurement corpus fund

All bidders pay transaction fee of 0.03% of ECV + 18% GST (cap Rs.10,000 + 18% GST for ECV up to 50 crores) online to APTS; successful bidder pays corpus fund 0.04% of ECV + 18% GST (same cap) at agreement.

• Transaction fee via Electronic Payment Gateway (Credit Card/Net Banking) in favour of Managing Director, APTS, Hyderabad / through e-Procurement platform (ICICI/HDFC).
• Corpus fund by DD (also described as online) in favour of Managing Director, APTS, Hyderabad, handed over to the Executive Officer at agreement.
• For ECV above Rs.50 crores, corpus cap is stated as Rs.25,000/-.
• No separate tender document purchase fee is stated in the bid document.

Additional security for abnormally low bids

If tender is more than 25% below ECV, additional security equal to (tendered amount minus 75% of ECV) is payable at agreement by BG or DD on Nationalised/Scheduled commercial bank, valid till completion.

• For tenders up to 25% less than ECV, no additional security deposit is required.

Retention / performance-related withholdings

7.5% of each bill is retained until completion; on completion half is repaid and half held through Defects Liability Period (or may be replaced by on-demand BG). Final bill also retains EMD plus 2½% of total value of work done for 24 months.

• Intermediate payment equals 92½% of certified value of work done.
• EMD retained as security together with withheld amounts is released after 24 months when defects are made good.
• No separate named “Performance Security” percentage beyond EMD/FEMD, retention and additional security for deep discount is prescribed.

Payment terms, taxes and price adjustment

Payment is for finished work on measurements recorded by AE (or above) and check-measured by DEE (or above); monthly statements checked within 14 days. Price adjustment is DELETED.

• Schedule A Part-II lists G.S.T @ 18% as Rs.5,83,991.00 and UNFORSEEN ITEMS Rs.21,618.00; Labour Cess and Seigniorage shown as “--”.
• Clause 101 states GST TDS at 12% and that quoted percentage is exclusive of GST; another clause says percentage is inclusive of GST — see contradictions.
• Income tax deduction at 2.24% during currency of contract.
• Valid GST clearance certificate required before final bill payment.
• No interest on arrears or guarantee fund balances.

Class of contractor registration

Open to Contractors/Contracting firms registered with Government of Andhra Pradesh in Class-IV and above Civil registration.

• Must possess valid registration in the class and category mentioned in the NIT and satisfy all conditions therein.

Mandatory qualification documents / experience

Mandatory uploads include Class-IV+ Civil Registration, PAN, AP GST registration, EMD proof, Latest IT Saral/IT returns, and similar nature of work experience in previous two years.

• Also required: transaction fee at 0.03% of ECV + 18% GST.
• Partnership firms registered as contractors must intimate partnership deed changes per G.O. Ms No.94, I & CAD dt.01.07.2003 within one month; failure can forfeit registration and reject tender.
• No quantified minimum turnover, net worth, bid capacity threshold, or value of similar work is stated beyond the checklist experience line.

Joint venture / consortium

Tenders from Joint Ventures are not acceptable unless specifically stated otherwise (not stated otherwise here).

• Each tenderer shall submit only one tender; multiple tenders cause disqualification of all.

Religion restriction for participation

No person professing other than Hinduism is entitled to participate in the tenders.

Blacklisting, debarment and other ineligibility

Bidders must not be blacklisted/debarred/suspended; false particulars, failure to execute agreement, poor past performance, or corrupt/fraudulent practices attract disqualification/debarment/blacklisting.

• Not blacklisted or debarred or suspended by Government from contracting business.
• Retired GoAP/temple/Endowments/GoI officers disqualified for 2 years from retirement without prior permission of Commissioner, Endowments; employing such persons without permission also ineligible.
• Near-relative employment bar in the Devasthanam (AE/AEE+ engineering; Superintendent+ administrative) — names must be disclosed.
• Declaration required that bidder has not been blacklisted/debarred/suspended/demoted in any department in AP or any State.
• If L1 backs out at agreement: EMD forfeiture and one-year business suspension with all AP Departments (G.O.Ms.No.259 TR&B dt.6.9.2008).
• Unreasonably high percentage / collusive or unethical practices can lead to rejection and debarment.

Sub-letting limit

Sub-letting of part work may be permitted if proposed with tender or during execution; total value on sub-letting shall not exceed 50% of contract value, subject to verification of sub-contractor experience.

Operation charges for the Sewage Treatment Plant of Sri Bhramaramba Mallikarjuna Swamyvarla Devasthanam, Srisailam, Kurnool District.

• SSR adopted: Common SSR 2025-2026 and local rates.
• Form of contract L.S.; percentage tender on Schedule A Part-I.

Manpower / operational deliverables (BOQ)

BOQ is manpower supply for STP and associated pump-house operations on a monthly basis, totaling Rs.32,44,391/-.

• Item header: Supply of High Skilled Technicians, Skilled Technicians and Semi Skilled workers for operation of STP of Srisaila Devasthanam including labour and conveyance charges; printed period “from 01.11.2025 to 31.10.2025” (end date before start — see contradictions).
• Pump House-1 near Rajula Satram (Shift-1,2,3): qty 36 × Rs.17,949.50 / month = Rs.6,46,182.
• Pump House-1 near Nandeeswara Dormitory East side (Shift-1,2,3): qty 36 × Rs.17,949.50 = Rs.6,46,182.
• STP Maintenance Skilled Operator (Shift-1,2,3): qty 72 × Rs.17,949.50 = Rs.12,92,364.
• Supervisor: qty 12 × Rs.22,391.15 = Rs.2,68,694.
• Electricians: qty 12 × Rs.17,949.50 = Rs.2,15,394.
• Electrical helper: qty 12 × Rs.14,631.25 = Rs.1,75,575.
• UOM for all priced lines: Each per One month; rates “As directed by the department”.
• Supervisor/Electrician/Helper quantities of 12 imply about one year of cover; 36/72 quantities align with multi-shift man-months rather than a 30/90-day construction period.

Completion timeline as stated in bid conditions

NIT completion period 90 days; Time for Completion section says 30 days; milestone programme to be drawn at agreement. These conflict with BOQ man-month quantities.

• Date of commencement of programme is date of concluding agreement, not handing over site.
• Technical Specifications / Drawings sections of the template do not add STP process performance standards beyond BOQ manpower descriptions.

Contractor-arranged utilities and site obligations

Contractor must arrange own water and electrical power; standard construction-template obligations (safety, labour laws, ecological balance) are incorporated though the BOQ is operations manpower.

• Power from nearest line after APSEB permission at contractor’s cost; electricity bills paid by contractor.
• No separate payment for security services on site.

Submission mode and portal

Bids are submitted online only on the AP e-procurement marketplace www.eprocurement.gov.in after registration; evaluation is on uploaded certificates/documents only.

• Hard copies before price-bid opening are dispensed with.
• Successful tenderer must furnish original hard copies of all uploaded documents/certificates/statements before concluding agreement.
• Online payment proof of EMD must still be furnished to the Tender Inviting Authority before price-bid opening (personally/courier/post).

Digital signature and signing

Bid must be authenticated with the bidder’s digital certificate on the eProcurement platform; unsigned/non-DSC bids are not accepted. Bidder must sign all uploaded statements/documents/certificates.

• If made by individual: full name and address; by firm: co-partnership name by a member who also signs own name with all partners’ particulars; by corporation: duly authorised officer with evidence of authorisation.

Completion period: 90 days vs 30 days vs ~12-month BOQ

NIT says 90 days completion; Conditions say 30 days; BOQ manpower quantities (12 / 36 / 72 man-months) imply about one year of multi-shift STP/pump-house staffing.

• NIT item 3: Period of completion of work : 90 days.
• Time for Completion: “The Work is to be completed 30 days” and “Rate of progress: Completion of work 30 days”.
• BOQ: Supervisor/Electricians/Electrical helper qty 12 months each; pump-house lines qty 36; STP skilled operator qty 72 — consistent with 12-month multi-shift deployment, not 30/90 days.
• Articles of Agreement also contains leftover sample dates (e.g. complete within Dt:09-12-2017 / 16-12-2017), underscoring template inconsistency.
• Bidder impact: duration drives staffing cost, LD exposure and security validity — seek written clarification before pricing.

EMD structure: 2.5% upfront vs 1% + 1.5% balance narrative

NIT fixes EMD+FEMD at 2.5% = Rs.81,150 with the bid, while ITT also requires balance EMD @ 1½% at agreement and refers to “1% E.M.D. paid … through Demand Draft”.

• NIT: EMD and FEMD gateway payment at 2.5% of ECV along with bid documents = Rs.81,150/-.
• ITT: pay Rs.81,150/- along with tender as earnest money; AND “balance EMD @ 1½% … at the time of concluding Agreement”.
• ITT also: “The 1% E.M.D. paid by the successful Tenderer at the time of submission of hard copies of Tender documents through Demand Draft…” though hard copies before price bid are dispensed with and payment is online.
• If both Rs.81,150 (already ~2.5%) and further 1.5% were taken, total security would exceed the stated 2.5% FEMD package.
• Prevailing practical reading is uncertain without clarification; report both wordings.

GST inclusive vs exclusive; 18% vs 12%

One clause says the quoted percentage is inclusive of GST; Clause 101 says exclusive of GST with 12% TDS/Part-B loading; Schedule A Part-II lists G.S.T @ 18% = Rs.5,83,991.00.

• Taxes included in the bid: percentage “deemed to be inclusive of the GST and other taxes on all materials…”.
• Clause 101: “The Percentage quoted by the contractor is exclusive of Goods and Services Tax (GST)…” and “tax at 12% has to be deducted at source”; “total amount towards component of GST at 12% is shown in Part ‘B’”.
• Schedule A Part-II: “G.S.T @ 18% | 583991.00” (18% of ECV 32,44,391).
• Pricing and reimbursement treatment is unclear — material pre-bid issue.

BOQ operation period dates are impossible

BOQ description states operation “from 01.11.2025 to 31.10.2025”, i.e. end date before start date.

• Likely typographical error for a one-year window (qty 12 on supervisor line), but as printed the service period is undefined.
• Tender schedule itself runs in July–August 2026, after both printed BOQ dates.

Confirm actual contract duration and shift manning

Ask TIA to confirm whether the engagement is 30 days, 90 days, or 12 months multi-shift STP/pump-house operations as the BOQ quantities imply, and to issue a corrected completion period/milestone table.

• Also ask how qty 36 and 72 map to number of persons × shifts × months.
• Confirm start date relative to agreement vs 01.11.2025 BOQ text.

Clarify EMD/FEMD cash outlay at bid vs agreement

Request written confirmation whether only Rs.81,150/- (2.5%) is payable with the bid and held through DLP, or whether a further 1.5% balance EMD is still collected at agreement.

• Ask acceptable instruments for any agreement-stage security and exact validity wording to use in BG.

GST treatment on quoted percentage and reimbursements

Ask whether the overall percentage is to be quoted exclusive or inclusive of GST, whether Part-II 18% or clause-101 12% applies, and how GST will be paid/reimbursed on monthly manpower bills.

• Critical for L1 pricing headroom given the +5% excess rejection cap.

Define “similar nature of work” for eligibility

Seek definition of acceptable similar experience (STP O&M, pump-house operations, civil works, manpower supply) and any minimum value/period evidence required for the two-year look-back.

• Checklist makes experience mandatory but gives no quantitative threshold — pass/fail risk at technical evaluation.

Scope boundaries for “operation charges”

Confirm whether contractor only supplies listed manpower or also bears consumables, chemicals, spares, sludge disposal, lab testing, statutory consents, and plant downtime risk; and who pays electricity for STP/pump houses.

• Special conditions require contractor to arrange power/water at own cost — may be construction boilerplate misaligned with O&M manpower BOQ.

Hinduism-only participation clause

Seek confirmation whether the bar on persons “professing other than Hinduism” will be enforced for firms/companies and what declaration/evidence is required.

• Material bid/no-bid legal and compliance issue for non-Hindu proprietors/partners/directors.

Liquidated damages up to 10% of contract value

LD of one tenth of one percent of contract value per calendar day (or part) for delay beyond milestones/completion, capped at 10% of final contract price; milestone daily amounts left blank to be filled at agreement.

• LD deduction does not relieve completion or other obligations.
• Delay reaching maximum LD days is a fundamental breach enabling termination.

Ambiguous duration and template mismatch

Conflicting 30-day / 90-day / ~12-month indications plus construction-heavy GCC applied to STP manpower create large pricing and LD exposure.

• BOQ end date before start date leaves service window undefined.
• Articles of Agreement still shows 2017 sample completion dates.

Security cash lock-up through 24-month DLP

EMD retained as security plus 2½% from final bill and half of 7.5% retention remain locked until defects liability of 24 months is certified clear.

• BG for EMD must cover contract period + two-year DLP (+28 days per securities clause).
• Additional security for deep discount remains until completion.

Forfeiture, suspension and blacklisting triggers

Withdrawal during validity, failure to sign agreement, fake documents, or missing EMD/hard copies trigger EMD forfeiture and/or 12-month e-procurement suspension; L1 back-out adds one-year suspension across AP departments.

• False experience can lead to blacklisting and taking over work under clause 61 of PS to APSS even during execution.

Tight bid ceiling and no price adjustment

Bids above +5% of ECV are rejected; price adjustment is deleted — limited room to price wage/statutory risk on a manpower-heavy BOQ.

• Abnormally high or collusive bids can be rejected and attract debarment.
• Contractor not eligible for compensation for delay in handing over site (only time extension on merits).

One-sided termination and set-off rights

Devasthanam may terminate for convenience; on contractor default, materials/plant on site are deemed Devasthanam property; overpayments recoverable from other Endowments/Government contracts/deposits.

• On termination for contractor default, payment upon termination certificate deducts advances, recoveries, taxes and percentage for incomplete work; shortfall is a debt to Devasthanam; default in paying that debt attracts 12% p.a. interest after 28 days’ notice.

Employer-favourable dispute ladder

Disputes go first to Executive Officer then Endowments Department; arbitration only for claims ≤ Rs.50,000; claims above Rs.50,000 must be civil suit — no high-value arbitration.

• Reference for adjudication must be made within six months from intimation of final bill preparation or acceptance of payment, whichever earlier.

Labour, indemnity and utilities risk on O&M deployment

Full labour-law compliance, workmen’s compensation indemnity, and own arrangement of water/power are contractor risks; Devasthanam may recover from dues/performance security for statutory defaults.

• Staff of qualified engineers/supervisors and a Work Manager must be maintained — may exceed bare BOQ headcount if strictly enforced.
