Tender validity

Tender validity is 120 days from the last date of submission of tender (both days inclusive).

• Employer may request extension in writing; a tenderer may refuse; an agreeing tenderer cannot modify the tender for the extended period.

Commencement and completion period

Work is to commence within seven days from issue of LOA (or as instructed by the Engineer); completion period is 03 (Three) Years / 36 months.

• FOT Appendix-1 states time for completion of the whole of the work as 36 months; sections are Not Applicable.

Approximate / estimated cost

Approximate cost of work is ₹84.60 Lakhs (Inclusive of all); BOQ grand total inclusive of GST @18% is ₹84,60,225.65.

• BOQ exclusive of GST grand total is ₹71,69,682.75 across Schedules A–D.
• Schedule-A (Manpower) incl. GST ₹46,60,436.73; Schedule-B (NDSR) incl. GST ₹31,01,346.92; Schedule-C (Civil DSR) and Schedule-D (Electrical DSR) each have ₹3,00,000 exclusive base (₹3,54,000 incl. GST before Schedule-C correction factor).

Tender security (EMD)

Tender Security / EMD is ₹56,402/-, payable only online through the portal; no other mode is accepted.

• Payment must be from the bidder’s own account; for JV/Consortium, from JV/Consortium account or one constituent member’s account—otherwise bid is ineligible and summarily rejected.
• No transaction copies need be sent to CE/Tender (O&M).
• Acceptable tender security is returned to successful tenderer on Contract Agreement execution and receipt of Performance Security; technical failures after financial opening; unsuccessful financial bidders after LOA/finalisation.
• Forfeited if tender withdrawn during validity; if correction of tender price not accepted; or if successful tenderer fails to furnish Performance Guarantee, commence work after LOA, or enter Contract within time.
• MSEs registered in the specified STP/RO/WTP/ETP etc. category (or UDYAM NIC 3600/3700) with valid registration as on tender submission may be exempt from Tender Cost and Tender Security, subject to NIT conditions; JV registration must be in JV name.

Tender document fee

Cost of Tender Documents is ₹5,900/- (inclusive of 18% GST), non-refundable, payable only online via the portal.

• Payment of tender cost is acceptable from any account but must be made on the e-portal.
• Same MSE exemption framework as for EMD applies when eligibility is met.

Performance security

Performance Security is 10% of the annual Contract Price / annual value of the Maintenance Contract, to be furnished within 30 days of LOA and kept valid for 6 months beyond DLP.

• May be reduced for balance years on completion of each year (ITT F5.1).
• Acceptable forms: irrevocable BG in Annexure-5A format on SFMS from Scheduled Commercial Bank in India / Indian branch of scheduled foreign bank payable at New Delhi; Bank Draft in favour of DMRC payable at New Delhi; or FDR pledged in favour of DMRC.
• Employer bank for SFMS BG confirmation: ICICI BANK LTD, 9A, Phelps Building, Connaught Place, New Delhi-110001, IFSC ICIC0000007.
• For JV/Consortium, PS is split by % participation and each member must submit from its own bank account—JV account or third-party account not accepted.
• No additional PS if plus variation is within 25% of Original Contract Value.
• Contract Agreement to be executed within 30 days of PS submission or 60 days from LOA, whichever is later.

Contract price basis, taxes and advances

Contract is an all-inclusive fixed-price style maintenance contract (GST included in contract price per SCC/ITT inclusive option and BOQ); Advances under GCC 11.2 are Not Applicable.

• SCC replaces GCC 11.1.1/11.1.4: Contract Price is all inclusive (including all taxes, duties, royalties etc.).
• Tax/duty adjustment only for new tax applicable to the work or change in GST rate after tender submission, and not during contractor-fault extensions for upward revision.
• SCC Cl.5: adjustment only if formula is in BOQ/Preamble; otherwise fixed price—BOQ Preamble has no price-variation formula.
• Bidders quote % Excess only on Schedule-A and Excess/Less on combined Schedule-B+C+D in BoQ1; prices deemed to include duties, taxes, labour law compliance, overheads, insurance liabilities etc.
• ITT C2.5 also contains an exclusive-of-GST option text; SCC and BOQ structure support all-inclusive—see contradictions.

Payment terms

Interim (RA) bills monthly or quarterly (or as directed), on measured executed quantities; BOQ allows monthly On-Account bills; Final Bill within 3 months of completion letter; no interest on delayed payments.

• Payment basis is actually executed BOQ quantities (ITT C10 / ER 3.3).
• Bills to be raised in hard copy and on DMRC Vendor Payment Portal; contractor must deploy engineer for joint measurement verification.
• Final Bill verification generally about 60 days subject to compliance; statutory deductions (IT, GST, labour cess etc.) and recoveries for penalties/damages apply.
• First RA bill/advances not released until all applicable insurance policies are in place (SCC Cl.17).
• Insurance of works: not less than 100% of maximum annual contract price during the entire contract term for Maintenance, effected within 4 weeks of commencement of Maintenance, valid till end of DLP.
• Third Party Insurance amount as FOT Appendix-1 (for OCP up to Rs 50 Crore: 10% of Original Contract Price).

Eligible applicants and one-bid rule

Open e-tender for proprietorships, partnerships, companies, corporations, consortia or JVs meeting NIT 1.2; only one bid per tenderer (individual or JV member); conflict-of-interest and multi-bid participation disqualify.

• In JV/Consortium all members are jointly and severally liable; each responsible for duties in MOU/JV agreement.
• Non-Indian bidder may tender only in JV/Consortium with India-registered firms (min 74% Indian participation) or wholly owned Indian subsidiary with min 74%; Indian contractor/subsidiary must be lead member.
• A tenderer cannot be sub-contractor while bidding individually/as JV partner in same process; may be sub-contractor in multiple bids only in that capacity.

Work experience (similar works)

In last five years ending last day of month previous to tender submission month, bidder must have successfully/substantially completed: one similar work ≥ ₹22.56 Lakh OR two each ≥ ₹14.10 Lakh OR three each ≥ ₹11.28 Lakh.

• Similar works: any individual/combination of Design, supply, construction, Fabrication, Erection, commissioning, Installation, Repair, Refurbishment, Modification, Servicing, Testing, Operation and Maintenance of RO, WTP, STP, ETP or Filtration plant.
• If Design is only a part of whole work, entire contract value counts; if work is largely for Design only, it is not considered.
• Substantial completion = 80% value-wise or more under original/revised scope (whichever less).
• Only substantial partners (≥26%) experience counts for JV; values updated with 5% p.a. INR inflation (2% foreign); private-client works need extra CA/TDS/26AS evidence with UDIN.
• Foreign JV partner works done in home country also need additional non-similar works ≥ ₹11.28 Lakh outside that country.

Financial standing — average annual turnover

Average annual turnover in last three audited FYs (2023-24, 2024-25 and 2025-2026) must not be less than ₹22.56 Lakhs; JV turnover weighted by % participation.

• Liquidity (T2), Profitability (T3) and Net Worth (T4) are Deleted.
• Financial data in Appendix-8 with audited balance sheets, CA certified with stamp, membership no. & UDIN.
• If last FY unaudited, Appendix-8A affidavit; then previous 2 audited years used; missing other year balance sheet may make tender non-responsive.
• Tenderer including all substantial JV members should have been incorporated more than three years earlier from last day of previous month of tender submission.

JV/Consortium participation rules

Lead partner must be substantial with minimum 26% participation; each substantial partner needs at least one similar work ≥ ₹11.28 Lakh in last 5 years; each non-substantial partner minimum 20% and at least one Civil work ≥ ₹5.64 Lakh in last 5 years.

• Partners with <26% are non-substantial and their financial soundness/work experience are not evaluated for JV qualification (except the Civil work floor for non-substantial).
• Wholly owned subsidiary exception for similar-work floor when parent+WOS JV, with Appendix-4A undertaking.
• No change in constitution or % participation after application submission.
• MOU must define roles; secret side MOUs treated as fraudulent practice with up to 3-year debarment risk.
• Parent/subsidiary credential sharing only if both are substantial JV members (≥26% each) with individual similar-work proof.

Debarment, rescission, LD/penalty history, insolvency and pending litigation

Bidder (and each JV member) must not be banned by DMRC/other 100% Govt metro/MoHUA/MoC as on tender submission; no relevant high-value rescission for non-performance in last 3 years; no ≥10% LD/penalty on relevant Civil works >10% of NIT cost in last 3 years; no bankruptcy/insolvency in last 5 years; pending litigation amount ≤50% of net worth.

• Undertakings in Appendix-5; pending litigation details in Appendix-14; failure on Appendix-5 or pending litigation criteria makes applicant ineligible.
• Misrepresentation on Appendix-5/2/14/15 treated as fraudulent practice under GCC 4.33.1 with rejection and further action.
• Notarized Rs 100 stamp affidavit Appendix-15 that all statements/documents are true is mandatory—non-submission rejects bid.
• L-1 work experience is verified with clients after financial opening; concealment or non-verification within 2 months of LOA can trigger Suspension/Banning Policy Aug 2019 actions.

Make in India / local content and land-border restrictions

Class-I local supplier minimum local content is 90%; purchase preference margin 20% applies (non-divisible works procedure). Land-border country bidders need Competent Authority registration as applicable.

• Appendix-12 local-content undertaking to be uploaded with technical bid; if not uploaded, bidder treated as Non-local supplier and ineligible for estimated purchases up to Rs 200 crore except global tenders.
• False local-content declaration → debarment 3 years from all metro rail company tenders.
• Successful bidder cannot subcontract to unregistered land-border-country contractors.

Statutory registrations required with bid

Copies of EPF, ESI, PAN, Service Tax, and GST registration in Delhi (or undertaking to register in Delhi on LOA) are required; non-compliance may cause summary rejection. PSARA only for watch & ward works (not this STP O&M).

Work summary, locations and duration

3-year Operation & Maintenance of one 30 KLD STP at Dwarka Metro Police Station (Dwarka Metro station, Line-3) and one 50 KLD STP at D-21, Corporate Park (Airport Line Depot).

• Contract No. OCM-2296; open works e-tender of DMRC.
• Completion 03 years / 36 months from commencement; start within 7 days of LOA or as Engineer instructs.
• Contractor supplies own materials, tools, machinery and labour; brief scope also in BOQ and site requirements.

Manpower deployment (BOQ Schedule-A)

Skilled operators with reliever for full 3-year period: 1×8-hour shift daily at 30 KLD plant (1095 shifts) and 2×8-hour shifts (General + Night) at 50 KLD depot plant (2190 shifts).

• Rates inclusive of EPF/ESI, overheads, T&P, chemical dosing, oiling & greasing; nothing extra for healthy STP operation.
• ITT also requires minimum organisation: 1 Site Engineer (engineering degree, ≥3 years experience) with non-deployment penalty Rs.0.50 Lakh/Month, plus Safety staff as per SHE manual/BOQ.

Comprehensive O&M technical scope

Comprehensive maintenance covers tank cleaning, pump/blower repair & replacement, filter media, dosing equipment, valves, panels, internal piping, sampling/testing and routine plant operations to keep STPs fully operational.

• Treated effluent targets include pH 6.5–9.0, BOD <10 mg/l, COD <50 mg/l, TSS <10 mg/l, Nitrogen <10 mg/l, Coliform <230 MPN/100 ml; quarterly NABL/in-house testing at contractor cost (BOQ item: 48 tests).
• Applicable standards: IS 2490, CPHEEO letter 18.12.2023 limits, Water/Environment/Hazardous waste laws, CPCB standards; materials per DMRC approved vendor list, IS codes and CPWD Specs 2023.
• BOQ Schedule-B includes feed/dosing pumps, multiport valves, air blowers, control panels, MBBR media, activated carbon, flow/pH meters, sludge/transfer pumps, bar screens, tank cleaning, tube deck media, chemicals (hypochlorite, bio culture, alum, DAP, urea, jaggery), etc.
• Schedules C & D are provisional Civil DSR 2023 and Electrical DSR 2025 lumps (₹3 Lakh each exclusive) for related works as needed.
• TS: feed/dosing pumps, filter press, tube settlers, motors etc. under NDSR must be kept pristine; repair/replacement during guarantee/DLP/contract tenure at contractor cost, else risk & cost by DMRC.

Defect liability and site constraints

DLP is 12 months from the latest Taking-over/Completion Certificate for the whole works; work must not interfere with utilities/operations; interface with Facility Manager, E&M and other system contractors required.

• Depot/station access controls: original IDs for workers, daily verification, no work without contractor supervisor; damage to DMRC property rectified at contractor cost.
• Wherever feasible Employer may provide electricity and water on non-chargeable basis per SCC, subject to Annexure procedures (see contradictions on charging).
• Failure to meet mutually agreed timelines allows Employer to get work done at contractor’s risk and cost.

Online submission mode and packages

Bids are submitted only online on https://etenders.gov.in/eprocure/app as Technical Package and Financial Package before NIT deadline; freeze bid submission on portal.

• Intending tenderers must be registered on the CPP portal.
• Financial package is the filled BOQ excel (BoQ1) plus Appendix-3A minor deviation prices if any; rates not to be quoted in technical package.
• No physical EMD/tender-fee instruments—both are portal online payments only.
• NIT designates CE/Tender (O&M), Metro Bhawan as authority/place for submission of required documents if any and for clarifications.

Digital signature and signing

Upload tender using Class-III DSC of the authorised signatory (ITT); NIT also allows Class-II or Class-III for download/upload—see contradictions. Documents to be duly completed/signed; POA notarised with Board Resolution.

• FOT signed by duly authorised representative; for partnership/JV each member authorises signatory; attach relevant POAs.
• Foreign POA/Board Resolution notarised in country of origin and Embassy/Apostille stamped as applicable.
• Self-attestation required for supporting qualification documents per Appendix-15 regime; Appendix-15 itself notarised on Rs 100 stamp.

Post-LOA originals / agreement documents

Within 30 days of LOA (and before signing agreement): Performance Guarantee, Power of Attorney, and detailed executed JV/Consortium agreement (with % participation and joint & several liability).

• Agreement signing: within 30 days of PS submission or 60 days from LOA, whichever later.
• LOA unconditional acceptance copy to be returned signed within one week of receipt.

No corrigendum/addendum on record in the tender pack

The downloaded tender document set contains no corrigendum or addendum file; key dates, fees and conditions above are as printed in the original NIT/ITT/FOT/SCC/ER/BOQ.

• Tender-metadata also lists an empty corrigenda array; bidders should still monitor https://etenders.gov.in/eprocure/app until submission for any later amendment (NIT last amendment date 07.09.2026).

FOT cover contract number OCM-2226 vs OCM-2296 everywhere else

Form of Tender PDF title page prints CONTRACT NO.: OCM-2226 while headers and all other tender documents use OCM-2296.

• Treat OCM-2296 as the tender/contract identity used in NIT, ITT, SCC, ER, BOQ and FOT running headers; the cover ‘OCM-2226’ appears to be a template typo.
• Bidder action: quote OCM-2296 in submissions unless a corrigendum says otherwise.

Digital signature class — NIT Class-II or III vs ITT Class-III only for upload

NIT 1.3.4 allows Class-II or Class-III DSC for download and upload; ITT C2.2(s) requires upload using Class-III DSC of authorised signatory.

• Safer compliance is Class-III DSC of the POA holder for tender upload, which satisfies both texts.

Employer’s Requirements still refer to RO/WTP while tender is STP-only

ER general scope text tells the contractor to plan so that the RO plant and WTP run smoothly, and comprehensive CMC lists STP/RO/ETP, though the contract title and BOQ are only two STPs.

• NIT/ITT/BOQ define scope as O&M of 30 KLD and 50 KLD STPs only.
• Bidder should seek clarification whether RO/WTP wording is residual template language or expands scope.

Liquidated damages — FOT Appendix-1 delay LD vs SCC/ER O&M penalty regime

FOT Appendix-1 sets classical delay LD at 0.128% of Original Contract Price per week (cap 10%, overall 15%), while SCC Cl.8 says for maintenance contracts KPIs/penalties/ceilings are as defined in Employer’s Requirements, and ER sets specific O&M penalties capped at 10% of contract value.

• SCC states that where conflict exists, SCC prevails over GCC; maintenance LD is pointed to ER.
• Practical reading: day-to-day O&M performance is governed by ER 3.2.4–3.2.5 penalties; Appendix-1 weekly delay LD may still be cited for completion/extension under GCC 8.4.3—confirm in pre-bid which regime is billed for this pure O&M contract.

Electricity/water — SCC ‘non-chargeable’ vs Annexure-I metered DISCOM billing

SCC Cl.4 says Employer may provide Electricity and Water on non-chargeable basis and Annexures apply ‘except applicability of charges’, yet Annexure-I describes metered temporary supply billed at prevalent DISCOM temporary-supply tariff.

• Clarify before pricing whether O&M power/water at the two STP sites is free, recoverable, or contractor’s arrangement beyond the tapping point.

NIT 1.3.7 cross-refers tender security to ITT C17 instead of C18

NIT validity clause says tender shall be accompanied with tender security as per clause C17 of ITT, but ITT C17 is Tender Validity and C18 is Tender Fee/EMD.

• EMD mechanics actually sit in ITT C18; treat C18 as the operative EMD clause.

ITT still prints both GST-inclusive and GST-exclusive quoting options

ITT C2.5(c) states GST is included in contract price, while a later C2.5 block describes Contracts Exclusive of GST and a note that one option will be struck off; SCC Cl.10 and BOQ build GST into an all-inclusive price.

• BOQ amounts already load GST @18% and NIT approximate cost is ‘Inclusive of all’; SCC heading is ‘All Inclusive Contract’.
• Quote on all-inclusive basis consistent with BOQ/SCC unless a corrigendum strikes the other way.

Confirm pure STP scope vs residual RO/WTP/ETP language in ER/TS/BOQ item text

Ask DMRC to confirm that scope is limited to the two named STPs and that RO/WTP/ETP phrases in ER 3 / 3.2.2 and some BOQ descriptions are template leftovers with no extra assets.

• Material to mobilisation planning, spare inventory and pricing of comprehensive CMC obligations.

Which liquidated damages / penalty schedule will actually be levied?

Request written confirmation whether FOT Appendix-1 weekly delay LD (0.128%/week) applies to this 36-month O&M contract, or only ER 3.2.4–3.2.5 operational penalties (and Site Engineer Rs 0.50 Lakh/month), and how double counting is avoided.

• SCC Cl.8 points maintenance contracts to ER KPIs/penalties; Appendix-1 still prints classical construction LD.

Electricity and water charging at STP sites

Clarify whether process power and water for the two operating STPs are free (SCC Cl.4 non-chargeable) or recoverable at DISCOM/DMRC rates per Annexures, and who pays energy for continuous O&M (not just temporary works).

• Three-year energy cost is material to bid price if chargeable.

Performance Security quantum — ‘annual Contract Price’ definition and yearly reduction

Ask how 10% of annual Contract Price is computed on a 3-year BOQ (total/3 vs year-wise maximum), timing/amount of yearly reduction, and whether DLP-linked validity uses 12-month ER DLP after full 36 months.

• ITT F5.1 says PS ‘may be reduced for balance years on completion of each year’ but gives no reduction schedule.

Three-year fixed manpower rates with no escalation

Confirm there is no labour/price variation (SCC Cl.5 / empty BOQ formula) so Schedule-A operator rates remain fixed for 36 months despite statutory wage revisions, and whether any reimbursement exists for minimum-wage/EPF/ESI changes.

• NDSR-1/2 rates expressly include EPF/ESI and say nothing extra shall be paid.

Provisional Schedule-C/D ₹3 Lakh envelopes and correction factor

Seek clarity on how Civil DSR Schedule-C correction factor 0.973 is applied in evaluation/payment, what works are chargeable under provisional C/D, and approval path when actual needs exceed the ₹3 Lakh exclusive envelopes.

• Grand total in BOQ appears to use uncorrected ₹3,00,000 for Schedule-C while a corrected line (₹2,91,900 exclusive) is also printed.

Stacked O&M penalties up to 10% of contract value

ER allows multiple per-instance/per-day/per-month penalties for outlet-parameter failure, missing reports, uncleanliness, non-operation, plus high equipment-downtime penalties, aggregated up to 10% of contract value, without relieving other liabilities.

• Examples: ₹2,000 per parameter non-compliance instance; ₹2,000 per plant per month for missing inspection/test reports; spot ₹2,000–5,000 per inspection; ₹2,000 per plant per day for non/improper operation.
• Equipment downtime (dosing/feed/filter-press/supply/raw-water pumps etc.): ₹5,000 if >48 hours, ₹10,000 if >one week.
• Separate Site Engineer non-deployment penalty ₹0.50 Lakh/month; general ER compliance failures up to ₹10,000 per instance; rejected-material token penalty up to ₹10,000.
• FOT Appendix-1 may still expose bidder to weekly delay LD up to 10%/15% unless clarified.

Fixed-price 3-year labour and comprehensive replacement cost risk

Manpower Schedule-A is fixed for 3 years inclusive of EPF/ESI with nothing extra; CMC requires repair/replacement of major mechanical/electrical items through contract tenure/DLP at contractor cost.

• No BOQ price-variation formula → SCC treats contract as fixed price aside from limited tax-change adjustments.
• TS expressly puts repair/replacement of pumps, filter press, tube settlers, motors etc. on contractor during entire tenure; non-performance → DMRC risk & cost.
• Statutory wage inflation and unexpected major equipment failures are bidder risks.

Payment, security and insurance cash-flow risks

No advances; first RA bill blocked without full insurances; no interest on delayed payments; PS is 10% of annual value locked through DLP+6 months; online EMD from wrong account kills the bid.

• Works insurance ≥100% of maximum annual contract price; third-party insurance 10% of OCP (for works ≤ Rs 50 Cr); policies within 4 weeks of maintenance commencement through DLP.
• Shortfall in insurance period: employer recovery of premium +20% or +50% overheads depending who bought cover.
• JV members must issue PS from own bank accounts only.
• MSE-exempt bidders face 1-year debarment if they withdraw during validity or fail to commence/execute/furnish PS after becoming successful.

Execution, interface and post-award verification risks

Live metro station/depot constraints, ID/access controls, interface with other contractors, risk-&-cost takeover for timeline failure, and post-award client verification of L-1 credentials can still cancel award under banning policy.

• Workers without original valid IDs denied entry; no work in depot without contractor supervisor/engineer present.
• Damage to DMRC property recovered at market cost from bills.
• Subcontracting to any single subcontractor limited to 50% of original contract value without prior Engineer consent.
• If L-1 experience not verified within 2 months of LOA, treated as fraudulent practice under Suspension/Banning Policy August 2019.
• Outlet quality must continuously meet strict BOD/COD/TSS/coliform limits or attract penalties.
