Performance security (CPG / Security Deposit)

Total Contract Performance Guarantee is 10% of contract value, due within 45 days of LOA or before 1st RA bill/mobilization advance, whichever earlier.

• Options: (i) full 10% CPG; (ii) 5% + further 5% before 50% scope completion; (iii) Initial CPG minimum 2%, with 10% of each gross RA bill retained until total reaches 10%.

Payment terms & safety-linked retention

Progressive interim payments per GCC 24; RA bills payable within 21 days of submission (or 75% within 7 days after preliminary certification). 2% of contract value is linked to Safety Aspects and retained/paid per GCC 24.11 / SCC 6.0.

• Scope: 2% of the value of work shall be retained from each RA Bill towards amount linked to safety.
• If bidder prices safety-linked amount below 2%, shortfall is retained proportionately from other BOQ components; no interest.
• First interim payment also requires accepted insurance policies.
• GST: quoted separately in BOQ; Employer reimburses GST on Works Contract items; other taxes/royalties in quoted rates.
• Price basis: SCC says FIRM PRICE overall, but price adjustment applicable only for items under Header 10 & 90 (SOQ); remaining BOQ firm. Scope also says 'Price basis: Firm.'
• Mobilization/equipment advance interest rate: variable SBI PLR as per SCC 9.0 (if advance taken under GCC).

MSE / Integrity Pact commercial flags

MSE benefits and Integrity Pact are NOT APPLICABLE for this Works package.

• Despite generic MSE/EMD-exemption language retained in BDS boilerplate, NIT/BDS package-specific entries disallow MSE benefit and EMD exemption.

Technical experience (QR 5.1)

Within preceding 7 years prior to techno-commercial bid opening, bidder must have executed Construction/Repair/Maintenance of Road(s) including Bituminous Road work, meeting one of three value routes.

• i) Single order executed value ≥ Rs 261 Lakhs; OR
• ii) Two orders each ≥ Rs 163 Lakhs; OR
• iii) Three orders each ≥ Rs 131 Lakhs.
• ‘Executed’ includes ongoing works if certified; basic value only (taxes excluded); sub-contractor references allowed if main contractor certificate is owner-certified; JV/consortium past works allowed only with defined scope split (or pro-rata for integrated JV with proof of regular road works).
• Only reference works declared in Attachment-3 / bid are considered; no substitution of references after bid.

Financial criteria (QR 5.2)

Average annual turnover in preceding three financial years as on techno-commercial bid opening ≥ Rs. 327 Lakhs.

• If bidder fails turnover on its own, Holding Company may meet it if Holding Co. net worth ≥ paid-up share capital; LOU + Board Resolution for unconditional irrevocable financial support required.
• Other income excluded from turnover; net worth defined as paid-up capital + free reserves (specified adjustments).
• Unaudited stand-alone statements allowed only with holding consolidated auditeds + CEO/CFO certificate; last-year under-audit pathway via CA/CEO-CFO certificates as per NIT 5.2.5.
• CA certificates/financial statements must carry UDIN.

Authentication of QR documents (TPIA / Statutory Auditor)

Technical QR supporting documents must be certified/verified by Independent Statutory Auditor or specified TPIA and digitally signed by them (proprietorship/partnership: TPIA only).

• Formats: Appendix D (Statutory Auditor) / Appendix E (TPIA) to Attachment-3A.
• Exception: works directly awarded by NTPC or its Subsidiary/JV need not have client certificate/TPIA/ISA authenticity for those references.
• Cost of verification borne by bidder; uncertified QR docs may lead to rejection.

Make in India / Class-I only

Only Class-I local suppliers (minimum 60% local content) are eligible; Class-II / Non-Local bids are outrightly rejected.

• Local content Class-I minimum 60%; Class-II minimum 20%.
• Ancillary services (transport, insurance, installation, etc.) cannot be counted as local value addition to claim Class-I/II on imported products.
• Self-certification via GTE attribute; if bid price > INR 10 crore, statutory/cost auditor local-content certificate required before last bill.
• Margin of purchase preference stated as 20%, but participation itself is Class-I only for this lump-sum evaluation tender.

Consortium / JV / Associate

Consortium/Joint Venture bids are not permitted; Associate/Collaborator is not permitted for this package.

• Past JV experience may still be used to meet technical QR under NIT notes, but bidding entity cannot be a JV/consortium for this tender.

Land-border registration (GFR/Order restrictions)

Bidder from a country sharing a land border with India (or Indian bidder with specified ToT from such country) is eligible only if registered with the Competent Authority (Annexure-II to SCC), subject to GoI exceptions.

• Same registration restriction applies to sub-contractors from land-border countries (SCC 21.0 / GCC 30.3).

Insolvency / bankruptcy bar

Bidder (and any parent/holding/subsidiary/associate/collaborator/tech provider used for QR support) must not be under CIRP, liquidation, bankruptcy or similar proceedings; Attachment-3L declaration mandatory.

• Ineligibility also arises if such proceedings start during evaluation/before award.
• False declaration / suppression: bid rejection, EMD forfeiture, and debarment under NTPC Policy.

Debarment / banning / conflict / no-deviation

Bidders must accept NTPC Fraud Prevention Policy and Withholding & Banning Policy via GTE; false PPP-MII declarations and debarment by other procuring entities for PPP-MII violations affect eligibility. This is a no-deviation tender.

• Supplier debarred/banned by any procuring entity for PPP-MII Order violation is ineligible for the debarment duration.
• GTE acceptance required: full compliance to bid doc, QR, fraud policy, banning policy; non-acceptance rejects bid.

Percentage schedule (DSR earthwork/dismantling) plus non-schedule bituminous road items including WMM, DBM, BC, tack coat, glow studs and thermoplastic marking.

• Schedule items (Part 10): earthwork/dismantling quantities e.g. 2,559.375 M3; 288.750 M3; 2,848.125 M3 (DSR 2023 items).
• Non-schedule (Part 20): tack coat on WBM/WMM 13,575 M2; tack coat on bituminous surface 13,575 M2; glow studs 3,000 EA; WMM 3,060 M3; Dense Graded Bituminous Macadam 1,018 M3 (VG-30 @5%, lime filler 2%, batch hot-mix 100-120 TPH); Bituminous concrete 545 M3 (VG-30 @5.5%, lime filler 3%); thermoplastic road marking 1,000 M2.

Completion, working constraints and quality

Completion in 06 months from start of work; day-shift working normally; surplus materials to be removed within 72 hours of completion or face penalty.

• Work permit & JSA required daily; supervisor mandatory; PPE mandatory.
• Quality as per approved FQP; CAR policy + ESI/WC insurance before start.
• Defect liability 12 months.

NIT/BDS defer bid submission/opening dates to the e-tender portal, while Section-VII SOQ prints fixed dates (NIT 16.07.2026; Tech opening 31.07.2026; Bid opening 01.08.2026) and offline 23:30 Hrs language.

• NIT is digitally signed 24.07.2026 — after the SOQ-printed NIT Date 16.07.2026.
• SOQ also says sealed-envelope offline submission, which contradicts the mandatory online GePNIC process in NIT/BDS.

Contract period: 6 months (Scope) vs 12 months (SCC)

Section-VI Scope states Contract period 06 months; SCC Clause 12 states Completion period 06 months but Contract period 12 months (extendable +3 months).

• SCC prevails over GCC on conflicts; between tender-specific Scope and SCC, both are tender-specific — completion obligation is clearly 06 months in both, but overall contract currency differs.
• Bidder should seek clarification on whether site establishment/retention obligations run 12 months while construction completion remains 6 months.

Price basis: Firm (Scope/SCC header) vs partial price adjustment (SCC 11)

Scope says Price basis: Firm; SCC first says FIRM PRICE with no escalation, then states price adjustment applies only for Header 10 & 90 items.

• Operational reading: most BOQ firm; only specified headers get CPA formula in SCC 11.0.
• Note SOQ headers present are 10 (schedule) and 20 (non-schedule) — Header 90 is not present in SOQ extract; confirm applicability before pricing.

MSE EMD exemption boilerplate vs package-specific ban

BDS retains generic MSE text that MSEs are exempted from EMD, while NIT/BDS package entries state MSE benefit NOT APPLICABLE and EMD exemption not allowed.

• Prevail: package-specific NIT Clause 2.0/3.0 and BDS EMD ‘EXEMPTION IS NOT ALLOWED’ / ‘MSE BENEFITS are NOT APPLICABLE’.
• Uploading MSE certificate for exemption risks rejection.

ITB EMD modes (DD/Banker’s cheque) vs NIT/BDS modern modes

Contract period 6 vs 12 months — LD and resource planning

Seek written clarification whether construction completion is 6 months within a 12-month contract currency, and which period feeds LD under SCC 13.0.

• Material to programme, cash flow, BG tenure and LD exposure (1%/week up to 10% for ≤6 month completion).

Price adjustment headers 10 & 90 vs actual SOQ headers 10 & 20

Confirm whether CPA under SCC 11 applies to SOQ Header 10 only, Header 20 bituminous items, or neither — Header 90 does not appear in the SOQ.

• Directly affects escalation risk on aggregates/bitumen/diesel-heavy road items.

Plant road working constraints / traffic & shutdown windows

Request site-specific constraints: live plant traffic management, permitted work fronts, night/holiday working approval norms, and any outage windows for road strengthening inside Simhadri plant.

• Scope requires day shift only unless EIC approves; bidder must visit site but detailed traffic/plant interface is not quantified in documents.

Acceptability of specific past road works without explicit ‘bituminous’ wording

If reference completion certificates do not expressly say ‘bituminous’, confirm whether BOQ/RA bill extracts proving bituminous items (as Attachment-3 requires) will suffice for QR 5.1.

• Pass/fail on technical QR; TPIA/ISA certification still required.

Liquidated damages for delay

For completion period ≤6 months (this package), LD is 1% of Contract Value per week of delay, capped at 10%.

• Also applies if progress remains below required progress, not only final completion.
• Separate caps: 7.5% if original completion >6 months ≤2 years; 5% if >2 years (not the base case here).
• Tight 6-month road programme inside an operating plant elevates LD risk.

High bid and performance security lock-up

Large bituminous quantities (WMM 3,060 M3; DBM 1,018 M3; BC 545 M3) on a mostly firm-price basis expose bidder to binder/aggregate/fuel volatility unless CPA truly applies.

• Percentage tender on NTPC rates — commercial competitiveness depends on accurate assessment of DSR vs market for non-schedule items.
• GST mis-quote rules in BDS can rework basic price at award.

QR documentation authentication burden

Mandatory TPIA/Statutory Auditor digital authentication of technical QR documents is a pass/fail administrative risk; uncertified references may be ignored and bid rejected.
