EMD / Bid Security

EMD is Rs. 2,46,000/- (Rupees Two Lakhs Forty Six Thousand Only), paid online through GOM payment gateways on https://mahatenders.gov.in; bid without EMD is summarily rejected.

• EMD valid till bid validity; successful bidder’s EMD retained / discharged on signing Agreement and furnishing Security Deposits; other bidders’ 100% online EMD refunded automatically.

Contract Deposit (Security Deposit)

Successful contractor pays Contract Deposit equal to 2% of the contract sum by Demand Draft only in favour of ‘Brihanmumbai Municipal Corporation’ within 30 days of LOA.

• Security Deposit comprises Contract Deposit and Retention Money.
• If Contract Deposit not paid within 30 days of LOA, accepted tender is cancelled and legal steps taken.

Retention Money

Retention Money is 5% of the Contract Sum, recovered from every interim / running / final bill; not applicable to M. & E. Department.

• 50% of RM released within 30 days of Certificate of Completion for the whole Works; balance after DLP completion / Defect Liability Certificate as per DLP table.
• For 1/2/3 year DLP: after completion ASD + 50% RM; after DLP CD + 50% RM + PG.
• For 5 year DLP: after completion ASD + 50% RM; after 3 yrs of DLP CD + 50% RM; after DLP PG.

Additional Security Deposit (ASD)

ASD applies only if rebate is more than 12% (circular CA(F)/Project/04 dtd. 08.07.2026), paid by DD at CFC within 15 working days of LOA.

• Up to 12% rebate: no ASD.
• 12.01% to 20%: 1% of estimated cost for each percentage and part thereof above 12%.
• Above 20%: 8% (for the 12–20 band) + 2% extra for each percentage and part above 20%.
• If ASD not submitted within 15 working days of LOA: 10% EMD forfeited; within 30 working days still not submitted: 100% EMD forfeited, bidder/company debarred 2 years (related director/partner companies also), and work terminated/revoked.
• ASD refunded within 30 days of Certificate of Completion.

Performance Guarantee

PG is over and above Security Deposit; for premium/at-par/rebate 0–12% PG = 0.92% × contract sum applicable for 12% rebate; for rebate >12% additional X% of contract sum where X is rebate above 12%; payable within 15 days of LOA and valid till DLP or final bill finalisation, whichever is later.

• Forms: Cash (if < Rs.10,000/-); DD (if < Rs.1,00,000/-); Government securities; FDR of a Schedule Bank; irrevocable BG of any Schedule bank / prescribed annexure form.
• Contract sum for PG = amount after rebate/premium with contingencies only, excluding price variation.
• PG released within 30 days of Defects Liability Certificate subject to final bill finalisation, whichever later, if no recoveries pending.

Payment terms

Monthly running bills for works estimated above Rs.1,000; Employer pays certified amounts within 15 days of each Engineer’s certificate, subject to deductions (advance, retention, SD, statutory taxes).

• Intermediate payments are advances against final payment only.
• Final bill within one month of the fixed completion date, else Engineer’s measurement/certificate is final.
• All payments in Indian Rupees.
• No price variation applicable for contracts up to 12 months.

Bank solvency (qualification finance)

Valid Bank Solvency Certificate of minimum Rs. 30,00,000/- (Rs. Thirty Lakhs only) as per Registration Rules for the contractor’s class is required in Packet A.

Who may bid / registration class

Open to reputed contractors — Proprietary/Partnership/Private Ltd/Public Ltd/companies under Companies Act 2013 — registered with BMC in Class III & above (new registration), or equivalent/superior class with Central/State Govt, Semi-Govt, or Central/State PSUs.

• Non-BMC-registered successful contractors must apply for BMC registration within three months of award, else EMD forfeited/recovered and an amount equal to Registration Fee of respective class recovered as penalty.
• Applicants not registered with BMC are mandated to get Vendor Registration with BMC.
• Joint Venture clause is deleted.

Technical capacity – similar works

In own name, satisfactorily executed similar work in BMC / Semi Govt. / Govt. & Public Sector Organizations during last seven (7) years ending last day of month previous to bid invitation month, as Prime Contractor (or nominated Sub-Contractor meeting conditions).

• Either: (a) Three similar completed works each ≥ 20% of estimated cost; or (b) Two each ≥ 25%; or (c) One ≥ 40% of estimated cost put to tender.
• Value of completed works updated at compound 10% p.a. from completion date to last date of receipt of applications.
• Similar work = completed or ongoing Building Construction OR Building Maintenance such as repairs / retrofitting / up-gradation / structural repairs.
• Packet B text also refers to last Five years for the similar-works list (see contradictions).

Financial capacity – turnover

Average annual financial turnover in all classes of civil engineering construction works only, certified by Chartered Accountant, equal to 30% of estimated cost of work in last three (3) financial years immediately preceding the Financial Year in which bids are invited.

• Executed-works values for capacity also updated at 10% compound p.a. as stated under financial capacity.

Bid capacity

Assessed Available Bid Capacity = (A × N × 2 − B) must be demonstrated; wrong bid-capacity calculation is a non-curable defect.

• A = maximum value of Civil Engineering works executed in any one financial year in last five years, updated 10% compound p.a. (current FY as base), including completed and works in progress.
• N = years prescribed for completion excluding monsoon; e.g. 7 months = 7/12 year; for every intervening monsoon 0.33 added to N.
• B = value of existing commitments (allotted works) on last submission date and ongoing works to be completed during this project period.
• Attach Engineer-in-Charge certificates (not below Executive Engineer or equivalent) for commitments/ongoing works.

Disqualification / poor performance

Even if qualifying criteria are met, bidders are disqualified for misleading/false qualification submissions and/or poor performance (abandoning works, not properly completing, inordinate delays, financial failures, etc.).

Technical staff during execution

For cost Rs. 1.5 to 5 crore: Principal Technical Representative — 1 Graduate Engineer with 5 years; plus Project/Site Engineer — 1 Graduate Engineer with 2 years or Billing Engineer — 1 Diploma Engineer with 5 years.

• Non-compliance recovery rates: Project Manager degree/10 yrs Rs.30,000 p.m.; Graduate Engg/5 yrs Rs.25,000 p.m.; Graduate Engg/2 yrs Rs.15,000 p.m.; Diploma Engg/5 yrs Rs.15,000 p.m.

Electrical sub-agency requirement

Civil contractors must get Electrical/Mechanical work done through BMC-registered Class ‘A’ Electrical Category contractors; upload attested electrical registration and willingness undertaking with the tender.

Litigation / blacklisting disclosure

Packet B must disclose litigation history for last 5 years covering blacklisting, debarring, banning, suspension, deregistration and cheating with BMC/State/Central Govt or authorities; if none, specifically state no litigation history.

• Also disclose BMC-party litigation and show-cause / orders by BMC authorities or courts for last 5 years.

ESIC / EPF (post-award conditional)

Successful bidder must produce ESIC registration if establishment exceeds employee thresholds (10 with energy / 20 without), else Rs.500 stamp-paper undertaking; EPF if more than 20 employees, else similar undertaking — as and when demanded.

Work title and location

Repairs & beautification of Sagbaug Hindu Cemetery at Marol, Andheri (E) in K/East ward, Mumbai.

• Inviting department: Chief Engineer (Building Maintenance) / Building Maintenance.

Civil works scope

Civil scope covers roof replacements, toilet slab/roof and waterproofing, burial earth filling, pathways, SWD, plumbing/sanitation, doors/windows, masonry, flooring, anti-termite, plastering/pointing/painting.

• Replacement of existing roofs of Prayer hall, DRK Chowky, Godown, Wood store, Waiting area etc.
• Replacing existing damaged slab of Toilet with AC Roof.
• Waterproofing of toilets; Filling in burials with red hill earth; Raising of pathways; SWD works.
• Plumbing and Sanitation works; Doors and Windows; Brick and rubble masonry works; Flooring works; Anti termite treatment; Plastering, pointing and painting etc.

Electrical works scope

Electrical estimate based on approximate site measurements: LED street lights and poles for compound and burial area; SFUs, DBs, MCBs, ELCBs, cables; and point wirings.

• To be executed via BMC Class ‘A’ electrical registered contractor (see eligibility).

Quantities / BOQ structure

Commercial bid is on percentage over/under two BOQ components: Civil Works Rs. 1,75,31,456 and Electric Works Rs. 32,45,989 (total Rs. 2,07,77,445 excl. GST).

• Detailed measurement-based civil BOQ items (dismantling, flooring, roofs, etc.) appear in the DT Bill of Quantities section; online BOQ is the percentage schedule.
• Engineer-in-charge may delete any item or alter/reduce scope with no extra claim.

Completion timeline and DLP

Complete the whole contract in 12 months including monsoon; Defect Liability Period is 3 years for general works and 5 years for structural and waterproofing works.

• DLP starts on issue of Certificate of Completion; contractor must acknowledge within 14 days.
• Defects must be made good at contractor’s cost; DLP extends until defects are corrected.

Standards / special execution conditions affecting scope

Special directions impose free barricading, own-cost debris disposal under C&D Waste Rules/DMP, licensed plumber, licensed structural engineer for structural repairs, night work if directed, noise limits, and approved materials list.

• Barricading free of cost per MGC/F/6342 dtd.05.05.2018 and Annexures I–III.
• BMC has no debris disposal site; contractor disposes Debris/Demolition Material/Excavated earth at own risk & cost per SWM DMP — no separate payment.
• Successful bidder appoints licensed structural engineer at own cost; issues structural stability certificate after structural repairs.
• Approved building material list Ch.E./BM/5976/II dated 10.07.2026 or amended applies.
• No extra payment for dewatering seepage in trenches/foundations; high water table to be priced in.

Portal, mode and three-packet structure

E-tender only on https://mahatenders.gov.in under three-packet system (Packet A, B & C); freeze bid online; no fax/telex/telegram applications.

• Bidder must enroll on the portal and use Digital Signature (e-token from authorized CAs such as eMudhra CA/GNFC/IDRBT/Mtnl Trustline/Safe Scrpt/TCS).

Shortfall cure window and curable vs non-curable defects

Missing Packet A/B documents are emailed; bidder has three working days to comply or is non-responsive. Maximum 5 shortfalls of curable defects allowed.

• Curable: non-submission of registration, solvency, GST, PAN/photos, partnership deed, undertakings, litigation history, etc.
• Non-curable: inadequate EMD/ASD; inadequate technical/financial eligibility; wrong bid capacity; improper experience certificates; non-submission of rate analysis within 3 days of Packet-C opening.
• 3+ non-responsive intentional-avoidance cases in 12 months can lead to banning/de-registration.

Signing, stamping and physical originals

Bid documents are uploaded as scanned certified copies; specified undertakings on Rs.500/- stamp paper; Form of Tender & Appendix-I to be filled, signed, scanned and uploaded. No separate physical bid-submission address/deadline beyond online Header Data is prescribed for the bid packets.

• Bidders shall categorically provide Email-ID in Packet A.
• Equipment and other undertakings may be combined on a single Rs.500/- stamp paper.
• Generic e-procurement note about posting original EMD conflicts with the tender’s online-only EMD rule (see contradictions).

Equal-L1 preference and rate analysis demand

Bid validity 180 days vs Form of Tender 120 days

Dedicated Bid Validity / rejection clauses require ≥180 days, but Form of Tender clause 5 still says keep tender open 120 days from opening. Prefer 180 days as the operative bid-validity rule and rejection standard; treat Form of Tender 120 days as unamended boilerplate conflict.

• BID VALIDITY: not less than One Eighty (180) days after bid submission deadline.
• GCC Clause 59: bid rejected if validity period less than 180 days.

Similar-work look-back: 7 years (eligibility) vs 5 years (Packet B)

Section 2 Technical Capacity requires similar works in last seven (7) years, while Packet B document list repeatedly says last Five years / Proforma for five years. Eligibility criteria should drive qualification; Packet B five-year wording is inconsistent and creates evaluation risk.

• Use seven-year window and 20%/25%/40% thresholds from Section 2 for bid/no-bid and document assembly; also complete Packet B proformas as printed.

Annexure A label: Contract Data vs GST Irrevocable Undertaking

Packet B requires ‘Annexure A (Irrevocable Undertaking) for compliance of provisions of GST Act’ on Rs.500 stamp paper, but printed ANNEXURE – A is only Contract Data (engineers, costs, EMD, time, DLP). No GST irrevocable-undertaking proforma is printed under that name.

• Bidders should seek clarification and not assume Contract Data Annexure A satisfies the GST undertaking requirement.

EMD online-only vs generic offline original-EMD instruction

Compensation for delay / LD
