Payment delay and measurement risk
Payment is contingent on fund availability and actual measurement, with no interest for delay. The unresolved per-ton versus percentage-BOQ basis increases invoice and cash-flow risk.
Broad all-inclusive price exposure
The per-ton rate is stated to include a very broad and partly open-ended citywide scope, labour, all vehicle fuel and minor repairs, PPE/uniforms, waste processing and all Government deductions. The Chief Officer may also negotiate rates if received rates are considered unsatisfactory.
Operational penalties
After a one-month grace period, event/day penalties apply for missed household/commercial collection, uncleared bins, route/timing failures, absent or misused vehicles, delayed complaint resolution, weighbridge manipulation and labour strikes; the highest listed penalties are ₹30,000 per vehicle and ₹20,000 per day.
- Other listed penalties range from ₹200 per event/ward to ₹5,000 per event.
- Improper source segregation after the first month attracts ₹2,000 per instance.
No-stop and termination exposure
Work cannot be stopped or unilaterally abandoned without prior permission. Premature abandonment permits forfeiture of earnest money and security deposit, recovery of completion and other losses, and blacklisting.
Liability and regulatory pass-through
The contractor bears full responsibility for worker/driver injuries and third-party death, injury or property loss, while the Council disclaims responsibility. Environmental penalties imposed on the Council may be recovered from the contractor where it is at fault, and wage-law/EPF/ESIC non-compliance can trigger recovery and legal action.
One-sided authority provisions
The Chief Officer reserves rights to alter conditions, reject one or all tenders without reasons, and issue a decision binding on the contractor in disputes. These clauses create change-control and remedy risk.
