Bid validity

BIDs shall be valid for not less than 120 days from the BID Due Date (extendable by mutual consent).

Post-award milestones

LOA acknowledgement within 7 days of receipt; 50% Performance Security (and APS if any) within 30 days of LOA; Agreement within 10 days of receipt of that 50%; remaining PS/APS within 30 days of signing.

Estimated Project Cost / tender value

Estimated Project Cost is ₹ 75,71,77,107/- (₹ 75.718 crore), excluding 18% GST and including Labour Cess of 1%.

• BID Price is exclusive of GST; evaluation is lowest BID Price (Clause 1.2.6).

BID Security (EMD)

BID Security ₹ 75,71,800/- (Rupees Seventy five Lakh Seventy one Thousand Eight Hundred only).

• Acceptable forms: Insurance Surety Bond (Appendix-IX; IRDAI-authorised insurer), Account Payee DD, Banker's Cheque, or e-Bank Guarantee (Appendix-II) from a Scheduled Bank (net worth ≥ Rs. 1,000 crore); e-BG via SFMS to Authority bank; foreign-bank e-BG needs nationalised bank confirmation.
• Refundable not later than 150 days from BID Due Date except Selected Bidder (retained till Performance Security/APS furnished). L-1 and L-2 retained longer per Clause 3.3.6.
• Appendix-II/IX formats state force for 150 days + 60-day claim period (claim date falling 180 days after BID Due Date) — conflict with Clause 2.20.1's '180 days inclusive of 60-day claim' wording; seek clarification (see contradictions).
• DD/Banker's Cheque originals: physical sealed envelope within 5 working days / by 16.10.2026 11:00 AM to CE PWD Highway, Tuikhuahtlang-796001, Aizawl; scan also uploaded online.

Performance Security and Additional Performance Security

Performance Security = 3% of Bid Price within 30 days of LOA (option to furnish 50% before signing and balance within 30 days of signing).

• Forms: Insurance Surety Bond (Appendix-X), Account Payee DD, Banker's Cheque, or irrevocable unconditional e-Bank Guarantee (Appendix-VII).
• Additional Performance Security applies for abnormally low bids (below 10%/20%/30% of project cost put to bid) on a stepped percentage formula; APS only as e-Bank Guarantee (surety bond not accepted for APS).
• Failure to furnish remaining PS/APS: extension up to 60 days with Damages 0.01% of Bid Price per day; thereafter award cancelled and Bid Security encashed.

Retention Money

Authority deducts 6% from every Works payment as Retention Money, capped at 5% of Contract Price; balance refunded within 15 days of Completion Certificate (after any appropriations).

Payment terms (works and maintenance)

Lump-sum Contract Price (ex-GST, ex-Maintenance). Stage payments on Schedule-H weightages; 90% interim release on AE recommendation then IPC. Interest-bearing mobilisation advance available. Price adjustment deleted. Maintenance paid separately for 2-year DLP/Maintenance Period.

• Additional equipment advance up to 5% of Contract Price against BG for new key equipment brought to site.
• Advance recovered at 15% of each Stage Payment; full recovery before 80% of Scheduled Construction Period; BG = 110% of instalment.
• If Authority pays late: interest @ Bank Rate + 3% p.a. (Clause 19.9).
• Bonus for early completion: Deleted (Clause 19.20).

Bidder form and JV restriction

Open to natural persons/private entities; Joint Venture generally not allowed because Estimated Project Cost (₹75.718 Cr) is up to Rs. 100 Crore, subject to the maintenance-works exception in Clause 2.1.11(h).

• If JV were allowed: max 3 members; each ≥26% share; Lead meets ≥60% of Bid/Technical/Financial Capacity and performs ≥51% of total length; other members ≥20% each; JV collectively 100%; JBA Appendix-V; joint and several liability till DLP.
• Confirm with Authority whether Strengthening/Rehabilitation is treated as 'maintenance works on EPC mode' for JV permission.

Technical Capacity — threshold experience

Over past 5 financial years preceding BID Due Date, payments/construction on Eligible Projects (adjusted per Clauses 2.2.2.5) must exceed ₹ 56.788 crore.

Technical Capacity — similar completed works

For normal highway projects: either two similar completed works each ≥ ₹ 18.929 crore (25% of EPC), or one similar completed work ≥ ₹ 26.501 crore (35% of EPC), from Eligible Projects Category 1 and/or 3; ≥90% value completed in last 5 FYs preceding BID Due Date or till BID Due Date.

• Eligible similar works include widening/reconstruction/upgradation on NH/SH/Expressway and specified road/bridge/linear works listed in Clause 2.2.2.2(ii).
• No major bridges/ROB/flyovers/tunnels listed as existing in Schedule-A (Nil); additional major-structure experience triggers therefore not indicated for this project from existing inventory.
• Client certificates required; subcontract/JV claims need Govt./Client approval limited to original share.

Financial Capacity — Net Worth and Turnover

Minimum Net Worth ₹ 3.786 crore at close of preceding FY; minimum Average Annual Turnover ₹ 15.144 crore (updated) for last 5 FYs.

• Updation factors Year-1 to Year-5: 1.00, 1.05, 1.10, 1.15, 1.20.

BID Capacity

Available BID capacity (A×N×2.5 − B + C) must exceed total BID value; N = years prescribed for completion (18 months → N as per formula).

Conflict of interest, debarment and non-performer bars

Conflict of Interest disqualifies and can forfeit Bid/Performance Security. Debarred/non-performer firms (and allied firms; all JV partners if JV debarred) cannot bid; must not be debarred on tender opening date or LOA date. Catastrophic structure/highway failure in last 2 years → non-eligible.

Land-border and Make in India rules

Bidders from land-border-sharing countries need Competent Authority registration (Order F.No.6/18/2019-PPD). Class-I Local Supplier (min 50% local content) gets purchase preference with 20% margin; Class-II min 20%; self-certification mandatory else treated Non-Local.

Project identity and mode

EPC contract for Strengthening/Rehabilitation of NH-306 'A' between Km 45.00 to Km 94.32 (Length = 49.320 km) in Mizoram under FY 2026-27.

Site and existing condition

Existing single-lane flexible pavement NH-306A; stated RoW 6.00 m; no land acquisition (works on existing NH); full RoW of construction zone within 10 days of Agreement.

• Existing major bridges/ROB/RUB/grade separators: Nil (Schedule-A).

Pavement and geometric works

Flexible pavement strengthening with specified crust lengths; carriageway width 3.75 m; existing alignment; curve cutting 1.88 km (min 10,183.77 m³).

• Design standards: IRC:SP:73-2018 & IRC:SP:48-2023 (flexible); IRC:58-2015 (rigid if applicable).
• Also road safety items (km stones, signages, markings, 2100 m W-beam crash barrier, delineators, studs), drain clearance (2 times) and jungle clearance (4 times).

Structures in scope

Retaining walls at listed chainages (aggregate about 260 m as stated) and 38 nos. RCC culverts (1 m and 1.5 m spans at listed chainages).

• One listed 1.5 m culvert chainage is km 98.500, beyond project end km 94.32 — confirm location (pre-bid).

Completion and maintenance timelines

Construction Period 18 months including monsoon (Scheduled Completion Date = 548th day from Appointed Date). Maintenance/Defects Liability Period 2 years from Completion Certificate.

• Milestones (Schedule-J): MS-I / MS-II / MS-III at progressive stage-payment thresholds (10%/…/70% of Contract Price) on specified day counts from Appointed Date.
• Contractor also designs, engineers, procures and constructs per Schedules B–D and maintains during DLP (Clause 1.1.2).

Submission mode and portal

Single-stage two-part e-tender only on CPPP https://eprocure.gov.in/eprocure/app; no fax/telex/telegram/e-mail bids. Class-III DSC mandatory in name of authorised signatory (corporate/Lead Member capacity).

• Upload scanned files (PDF/RAR, each ≤30 MB) for Clause 2.11.1 documents.
• e-procurement registration must be valid at least up to BID submission date.

Physical originals — timing and address

DD/Banker's Cheque Bid Security: sealed envelope to CE PWD Highway, Tuikhuahtlang-796001, Aizawl by 16.10.2026 11:00 AM. Lowest Bidder must also submit originals of listed technical/financial instruments before LOA issuance.

• Envelope identification: BID for the Project name; show bidder name/address and BID Due Date on top-right corner.
• For DD/Cheque path, Technical Bid opened only if physical instrument received (Clause 2.15.2).

Signing / attestation rules

BID formats exactly as Appendix-I; Power of Attorney authorises signatory; Integrity Pact signed by authorised signatory; PoA-holder undertakes to abide by uploaded bid documents/amendments.

No corrigendum / addendum issued in the tender pack

The downloaded tender set contains NIT, RFP, DCA, Schedules and BOQ only; tender-metadata lists an empty corrigenda array. All values above are as originally published — no amendment chain to collapse.

• Finally applying (as published): Bid Due Date 10.10.2026 12:00 IST; Technical opening 12.10.2026 after 12:00 IST; Bid validity 120 days; Estimated cost ₹75,71,77,107; Bid Security ₹75,71,800; Tender fee ₹10,000; Completion 18 months; Maintenance/DLP 2 years.

BOQ / Financial Bid file is for a different project

Portal BOQ_972796.xls and its embedded Appendix-IB text name 'Strengthening and Reconstruction of NH-6 (Spur) from KM 0.00 to KM 38.80' (Job No. 06/MZ/2026-27/103), not NH-306A Km 45–94.32. RFP/NIT/DCA/Schedules are for NH-306A. Do not rely on BOQ title/items without Authority correction.

• DCA table of contents also labels Schedule-B Annex-I as 'Description of Strengthening and Reconstruction of NH-6 (Spur)' while the Schedules PDF body is NH-306A — template contamination.

Bid document download end-date conflict

NIT and Clause 1.3 allow download/request till 10.10.2026 12:00 IST, but Clause 2.14.1.4 states view/download only from 10.09.2026 to 25.09.2026 12:00 IST. Prefer NIT/1.3 schedule unless corrigendum clarifies; still a pass/fail portal risk if CPPP closes early.

Bid Security validity: Clause 2.20.1 vs Appendix-II/IX

Clause 2.20.1 requires BG validity not less than 180 days from BID Due Date inclusive of 60-day claim period. Appendix-II/IX state irrevocable force for 150 days from BID Due Date plus 60-day claim period, with claim-on-or-before date 180 days after BID Due Date. Align instrument text with Authority before issue.

Physical DD/Cheque time-of-day wording in NIT vs RFP

NIT body mixes 'up to 12:00 hours' with '16.10.2026 (upto 11:00 AM Hrs. IST)'; RFP Clauses 1.3 and 2.12 consistently require 11:00 AM Hrs. IST on 16.10.2026. Apply 11:00 AM IST.

Integrity Pact threshold vs mandatory submission

Clause 2.11.1(i) mandates Integrity Pact with the RFP Bid, but Appendix-VI header says IP is for construction tenders of Rs. 100 cr or above (this EPC ≈ ₹75.72 Cr). Submit IP as required by 2.11.1 unless Authority waives in writing.

JV ban under ₹100 Cr vs maintenance-works exception

Clause 2.2.1(a) bans JV for estimated cost up to Rs. 100 Crore; Clause 2.1.11(h) allows JV at any EPC cost for maintenance works on EPC mode. Project is titled Strengthening/Rehabilitation with 2-year maintenance — classification unclear without Authority ruling.

Replace / correct the portal BOQ and financial forms

BOQ_972796.xls and embedded financial letter refer to NH-6 (Spur) Km 0–38.80 / Job 06/MZ/2026-27/103, not this NH-306A package. Request corrected BOQ/Appendix-IB mapped to NH-306A estimated cost and scope before bid.

Confirm whether JV is allowed

EPC ≈ ₹75.72 Cr is below Rs. 100 Cr JV ban, yet works are Strengthening/Rehabilitation with EPC-mode maintenance. Ask Authority to state expressly if JV is permitted under Clause 2.1.11(h).

Bid Security instrument validity period to print

Ask which BG/Surety validity to use: 180 days inclusive of 60-day claim (Clause 2.20.1) or 150 days + 60-day claim (Appendix-II/IX), and the exact claim-expiry date relative to 10.10.2026.

Culvert listed at km 98.500 beyond project end

Schedule-B lists a 1.5 m RCC culvert at km 98.500 while project ends at km 94.32. Confirm chainage, whether it is a typo, and if quantity is inside Contract Price.

Working within 6 m RoW on hill single-lane NH and traffic management

Stated full RoW is only 6.00 m on existing single-lane hill road with retaining walls, culverts and 3.75 m carriageway. Seek clarification on temporary land, diversions, traffic hold-and-release, and whether Authority provides additional RoW for catch-water drains/hill works as alluded in Schedule-B hill-road note.

Integrity Pact applicability vs Rs. 100 cr construction threshold

Clause 2.11.1(i) mandates Integrity Pact with the bid, while Appendix-VI header limits construction IP to tenders Rs. 100 cr or above (this EPC ≈ ₹75.72 Cr). Request written confirmation IP is mandatory.

• Appendix-XII catastrophic-failure undertaking is printed at RFP p.99 — use that proforma.

Price adjustment deleted — confirm fixed-price risk allocation

Clauses 19.10–19.12 (works and maintenance price adjustment) are Deleted while construction is 18 months in Mizoram hills. Confirm no PA/WPI relief except Change in Law, and whether bitumen/steel/cement indices or fuel can be claimed.

Delay Damages at 0.05% of Contract Price per day

Failure to achieve any Project Milestone or Scheduled Completion Date within 30 days of Schedule-J dates attracts Damages at 0.05% of Contract Price per day (refundable without interest if overall completion still by SCD including extensions).

• At 0.05%/day, theoretical exposure is very high relative to margin; model cash-flow and float carefully against 548-day SCD.

No price adjustment on Works or Maintenance

Price adjustment clauses are Deleted. 18-month hill construction plus 2-year maintenance is essentially fixed-price (save Change in Law / COS mechanisms).

Abnormally low bid → large Additional Performance Security

Bids ≥10%/20%/30% below project cost put to bid require stepped APS (only e-BG). APS release is staged (25% at COD if on-time, 25% after 1 year PCI/IRI compliance, 50% after DLP) with non-refundable penalties if PCI/IRI fails.

Site / execution risks on hill single-lane corridor

6 m RoW, single-lane live traffic, many retaining walls and 38 culverts, curve cutting, and hill drainage/slope notes create logistics, traffic and geotechnical risk. Contractor bears site-data sufficiency and design responsibility; limited claim basis for inadequacy of Bidding Documents (Clause 2.5).

Security cash lock-up and forfeiture triggers

Bid Security ₹75.71 lakh locked through evaluation; PS 3% of Bid Price until 60 days after DLP; Retention 6% of IPCs up to 5% CP. Bid Security forfeitable for withdrawal during validity, corrupt practices, or failure to sign LOA/Agreement or furnish PS/APS.

Wrong BOQ / document contamination risk

Submitting price on the NH-6 Spur BOQ or mismatched financial letter could make the financial bid non-responsive or create award disputes. Insist on corrected files or Authority written clarification before pricing.

Maintenance performance deductions and defect remedies

2-year Maintenance/DLP with only 0% then 0.5% of CP maintenance fee; non-compliance reduces payments per Schedule-M. Failure to rectify defects: Authority may rectify and recover cost + 20% Damages.
