Performance Guarantee

Successful bidder must submit Performance Guarantee of 5% of original contract value within 21 days of LOA (extendable to 60 days with 12% p.a. penal interest after day 21).

• PG is required after LOA and before signing the contract agreement; initially valid up to stipulated completion date plus 60 days.
• Acceptable forms include cash, irrevocable BG, Insurance Surety Bond (Annexure-XVII), specified Government securities, DD/Pay Order, bank deposit receipts, Post Office/NSC instruments, and FDR in favour of FA&CAO/Con (free from encumbrance).
• If contract is terminated for non-submission of PG after 60 days, Railway may forfeit Bid Security and other dues up to PG amount; failed contractor is debarred from re-tender for that work.
• Additional Performance Guarantee applies if bid is below advertised value: Below 0–5% (inclusive) — Nil; Below 5% — 5%.
• PG released after physical completion on Completion Certificate; PG value does not change with subsequent variations.

Security Deposit

Security Deposit is 5% of the contract value; Bid Security of successful contractor is retained/encashed as part of SD unless replaced.

• Balance SD may be deposited in cash/TDR/irrevocable BG from Scheduled commercial bank of India, or recovered at 6% of bill amount till full SD is recovered.
• Amounts retained (including PG) may not exceed 10% of total contract value.

Price Variation, rates inclusivity and payment options

PVC is applicable (Top Sheet Yes; GCC PVC for tenders above Rs.2 Crore). Quoted rates are inclusive of all taxes including GST, local taxes, licence fee and royalty.

• Base Month for PVC is one month prior to closing of tender; PVC quarter starts the following month.
• Quantity is approximate; Railway may increase/decrease/delete quantities with no extra rate.
• Optional Letter of Credit (sight LC) payment route is available if opted at bidding; LC incidental cost @ 0.15% p.a. of LC value is recovered from contractor bills.
• Mobilization advance is only for tenders with advertised value more than Rs.50 Crore; this tender (~Rs.36.90 Cr) does not attract mobilization advance under the printed condition.
• Early-completion bonus (clause 17C) is stated applicable on Top Sheet for open tenders >Rs.50 crore with original completion ≥12 months — this tender value is below Rs.50 crore, so bonus threshold is not met under the GCC text.

Ballast test report for impact value, abrasion value and water absorption must be submitted with the tender from specified approved labs; report date must be after tender notice issue date, else offer is summarily rejected.

Standards, quality and completion timeline
