EMD / bid security

EMD is Rs. 30,89,500/-; acceptable as online payment, DD/Bankers Cheque in favour of Engineering Projects (India) Limited, Bank Guarantee, or Insurance Surety Bond.

• NIT Cl.5 states EMD shall be valid for minimum period of 180 days (one hundred fifty days) from last date of tender submission — numerical and worded periods conflict; see contradictions.
• Scanned EMD proof with online bid; if DD/BG/surety bond, original physical instrument must reach EPI by offline EMD deadline 10.08.2026 1500 HRS.
• EMD BG must be accompanied by SFMS from beneficiary bank; without SFMS the bid is unresponsive.
• Unsuccessful bidders' EMD returned within 30 days of price-bid opening; successful bidder's EMD after receipt of Security Deposit cum Performance Guarantee.
• MSME EMD exemption not applicable.

Performance security (SD cum PBG)

Security Deposit cum Performance Guarantee is 2.50% of Contract Value, to be submitted within 21 days of LOA/LOI.

• Forms under GCC 9.0: irrevocable BG from Nationalized/Scheduled Bank, Insurance Surety Bond, Account Payee DD, or online payment.
• BG/ISB validity: up to 90 days after contractual/actual completion/handing over.
• Delay in PBG beyond 21 days (or EPI-granted extension) attracts 12% p.a. penal interest; no payments until PBG confirmed and agreement signed.
• Failure to submit PBG leads to LOA withdrawal and EMD forfeiture.
• PBG returned after successful completion/testing/commissioning/handing over and EOT finalisation.

Additional performance security for below-estimate bids

If L1 quotes below estimate, Additional Performance Security is payable on a stepped scale and must be furnished within 60 days of LOI (or SDPBG timeline), else LOI withdrawn and EMD forfeited.

• Up to (-)5%: nil; (-)5% to (-)10%: 1% of estimated cost; (-)10% to (-)15%: 1% plus half the % beyond 10%; beyond (-)15%: 3.5% plus the % beyond 15%.
• Calculated on estimated cost including GST.

• Release: 50% after 75% work complete; balance after 95% complete.

Retention money

Retention Money is 7.5% of each RA bill gross value: 5% refunded with final bill after successful completion; 2.5% after defect liability period.

Advances, escalation and payment terms

No mobilization or secured advance; prices are firm with no escalation; contractor payment is back-to-back after EPI receives payment from Palamuru University.

• RA bills certified by EPI are released within 10 working days after receipt of corresponding payment from Client.
• Final bill payment 30 days after GST clearance, EPF clearance and other contractual/statutory clearances.
• GCC 37.2: contractor entitled to payment only after EPI receives corresponding client payment; delay by client does not entitle contractor to compensation/interest.
• GST @18% on works contract paid separately on matching GSTR-1 / ITC; TDS under GST deducted on gross invoice value.
• Quoted rates inclusive of labour cess @1% (deducted and deposited by EPI), Seigniorage, NAC @0.1%, DMFT @30% on seigniorage and SMET @2% on seigniorage as applicable.
• TPQA audit reports and compliance are a precondition for processing corresponding RA bills.

Technical experience – similar works

In last 7 years ending last day of month previous to tender invitation: 3 similar works ≥40% ECPT, OR 2 ≥50%, OR 1 ≥80%.

• Similar works mean: “Execution of G+2 Building works with RCC Frame Structure including Plumbing and Electrical Work.”
• For composite works, only the qualifying-work value counts.
• Completed values enhanced at simple 7% p.a. from completion date to bid opening; value excluding GST; free-issue materials excluded.
• Completion certificates from Govt/semi-govt/State-Central PWD/PSU/Autonomous/Municipal bodies with work order/agreement; tax component must be clearly mentioned.

Financial – turnover, profit and solvency/net worth

Average annual turnover on works in last 3 FYs ending 31.03.2025 ≥50% of ECPT; no losses in more than two consecutive years in last five FYs; and either Banker’s Certificate =40% ECPT (not older than 3 months before bid due date) OR Net Worth ≥10% ECPT as on 31.03.2025.

• Turnover/financials to be CA-certified with UDIN.
• Firms <3 years old: average turnover over available period; must not have incurred any losses since formation.
• Banker’s Certificate / Net Worth formats in Annexure-VII.
• Certifying CA must not be employee/Director or have interest in the bidder.

Joint Venture / Consortium

Joint Venture / Consortium is not eligible to bid.

• Past experience as leader/member of Consortium/Unincorporated JV may still be counted for individual bidder qualification if that bidder’s own scope met the similar-work requirement (Cl.7(a)).
• Integrity Pact notes JV/consortium signing rules, but bidding as JV/consortium is barred by Cl.6.1.

Blacklisting / debarment and border-country restrictions

Bidder must not be currently ineligible/suspended/blacklisted/banned/debarred by EPIL or any Central/State Govt Department/PSU at bid submission; border-sharing country procurement restrictions apply with Annexure-VIII undertaking.

• False/fabricated documents or Integrity Pact breach can attract suspension/debarment of 1–3 years and EMD forfeiture (Cl.9.12(d)).
• False Make-in-India local-content declarations can lead to debarment up to two years (Cl.9.16(e)).
• Existing EPI contractors with unsatisfactory progress may be rejected (Cl.9.12(g)).

Make in India local content classes

All bidders must declare local content; Class-I (≥50%) gets purchase preference within L1+20% margin if L1 is not Class-I; Class-II (≥20%) gets no purchase preference.

Technical scope inclusions

Scope covers civil & structural works, architectural consultancy, all MEP services, materials, tools, labour and related building services as per bid documents, drawings and Engineer-in-Charge directions.

• ACC Cl.2 elaborates: Civil Architectural & Structural; Sanitary/Plumbing; Electrical (internal & external); Mechanical (Firefighting); Water supply (I&E); drainage/sewerage; Pump House; Power Supply; Fire detection including fire alarm; Sprinkler system; Signages.
• Successful bidder must tie up with a suitable Consultancy/Architectural firm within 15 days of LOA and submit tie-up + credentials for EPI prior approval.
• Contractor is responsible for statutory approvals from local authorities (town planning/municipal/electricity/fire etc.); statutory fees paid by EPIL/PU, incidental costs by contractor.
• Contractor must engage TPQA (IIT/NIT/Govt Engg Institute/NABL lab) at own cost; quarterly audits.
• Water-proofing via specialized firm with 10-year guarantee; anti-termite 10% cost retained 10 years from completion.

Completion timeline and financial milestones

Overall completion 15 months including design; financial milestone targets: Month 1 – 10%; Months 2–5 – 30%; Months 6–12 – 50%; Months 13–15 – 10%.

• Bar chart based on these milestones due within 10 days of LoI.
• Failure to achieve milestones attracts intermediate LD / withholding under GCC terms.
• Defect Liability Period: 24 months from completion as certified by line department/client; contractor retains watch & ward until client takeover of maintenance.

Applicable standards and pricing basis

Works to follow tender technical specifications, APSS/TSSOR 2025-26, AP state technical specifications/building data, BIS, and directions of Engineer-in-Charge; price bid is single lump-sum EPC quote against estimated Rs.20,89,40,980.

EMD validity: 180 days vs 150 days in same clause

Clause 5 states EMD valid for minimum 180 days but immediately glosses it as “(one hundred fifty days)”; bid validity elsewhere is 150 days.

• Bidders should seek written clarification; safest instrument validity is at least 180 days from bid due date unless EPI confirms 150 days.
• Bid validity itself is consistently 150 days in Cl.9.2 and Memorandum item (x).

Physical EMD deadline: schedule 10.08.2026 vs document-list wording

Tender schedule fixes offline EMD by 10.08.2026 1500 HRS, while Cl.12 item 2 says physical original EMD within last date of bid submission (07.08.2026) or extended time.

• Cl.5 says physical EMD on or before due date for submission or within extended time by EPI, and schedule item (v) separately lists offline EMD deadline 10.08.2026.
• Treat schedule item (v) as the express offline EMD cut-off, but confirm with EPI because missing physical EMD is a rejection ground.

Contract start reckoning: LOA vs agreement/work order

Memorandum reckons start/completion from 10th day of LOA, while ACC Cl.4 reckons actual start from 10th day of signing of agreement/work order.

• Memorandum item (vi): 15 months from 10th day of Issue of Letter of Acceptance.
• Memorandum item (xiii)/GCC Cl.43: start 10 days from Letter of acceptance.
• ACC Cl.4: Actual date of start of work shall be calculated from 10th day of Signing of agreement / Work order.
• Order of precedence puts Contract Agreement/Memorandum above ACC for conditions, but ACC expressly amends GCC time-schedule clause — clarify with EPI.

Drawing labels vs NIT project description

Tender drawings are labelled for hostel blocks for Law/Engineering buildings, while NIT scope is Library vertical extension at Mahabubnagar and Boys/Girls hostels at PG Center Wanaparthy.

• Volume II drawings pages refer to “HOSTEL BLOCK FOR LAW BUILDING” / “HOSTEL BUILDING FOR ENGINEERING BLOCK”.
• NIT/ACC describe Palamuru University library extension and Wanaparthy PG Center hostels.
• Bidders should confirm correct GADs/area statements before pricing.

Online-only submission vs Envelope-1 wording

NIT mandates online-only bid submission, but Annexure-I still says Letter of Undertaking is “TO BE ENCLOSED IN ENVELOPE-1 ALONG WITH EMD”.

• Operational rule is online upload of technical documents plus physical EMD instrument when applicable; envelope language appears residual.

Confirm pre-bid query cut-off and whether a pre-bid meeting will be held

Schedule leaves Last Date of Submission of Pre-bid Queries blank; ask EPI to notify the cut-off and any meeting date/mode.

• Material because clarifications can change eligibility interpretation, drawings and pricing with only ~10 days from NIT to bid due date.

EMD validity period to print on BG/Surety Bond

Ask EPI to confirm whether EMD instrument must be valid 180 days or 150 days from bid due date.

• Same sentence uses both figures; wrong validity risks unresponsive bid.

Exact offline EMD delivery address, acceptable receipt cut-off and SFMS beneficiary details

Seek written confirmation that physical EMD may arrive by 10.08.2026 1500 HRS (not 07.08.2026), delivery address at Contracts Division CO, and exact SFMS beneficiary bank identifiers.

• Cl.12 wording conflicts with schedule item (v).
• BG without SFMS is treated as unresponsive.

Correct tender drawings / area statement for Library and Wanaparthy hostels

Request issue of project-specific drawings/area statements matching the NIT scope, because Volume II drawings appear labelled for Law/Engineering hostel blocks.

• Also request soil/structural assessment basis for vertical extension over existing library.

Payment back-to-back and cash-flow protection

Ask whether any maximum payment timeline applies if Palamuru University delays paying EPI, and whether milestone RA billing percentages are defined beyond financial targets in ACC Cl.4.

• ACC/GCC make contractor payment contingent on client payment to EPI with no interest for delay — major pricing risk on a 15-month EPC with no mobilization/secured advance.

Start-date basis for LD and 15-month clock

Clarify whether the 15-month completion clock and LD run from 10th day of LOA or from 10th day of agreement signing/work order.

• Affects programme, intermediate milestone LD and PBG validity planning.

Back-to-back payment with no advances

No mobilization/secured advance; RA payments only after EPI receives funds from Palamuru University; contractor gets no interest/compensation for client-side payment delay.

• Final bill only after multiple clearances including GST and EPF.
• TPQA compliance is a precondition to RA bill processing.
• Combined with firm prices and 15-month programme, cash-flow risk is high.

Liquidated damages and aggressive milestones

Compensation for delay is 0.5% of awarded contract value per week, capped at 10% of tendered value (excl. GST); intermediate financial milestones can trigger automatic withholding.

• Milestone targets front-load 40% in first 5 months and 90% by month 12 of a 15-month design+build job across two distant sites.
• Failure to submit as-built/completion plans within 30 days of completion attracts up to 2.5% of work value (cap Rs.25 lakh).

Firm-price / no-escalation and high retention stack

Rates firm for entire/extended period with no escalation; 7.5% retention plus 2.5% PBG and possible additional below-estimate security lock substantial cash.

• NIT Cl.9.8 and GCC 15/16 bar revision for material/labour/POL/statutory increases.
• Anti-termite 10% cost retained for 10 years; waterproofing 10-year free rectification guarantee.

Two-site vertical extension / existing-structure and drawing mismatch risk

Work includes vertical extension on an existing library plus new hostels at a second campus; tender drawings appear mislabelled, increasing design, interface and rework risk on EPC lump-sum.

• Bidder must visit sites; EPI will not entertain claims on ground/working conditions (Cl.8.3).
• Architectural tie-up mandatory within 15 days of LOA.
• Statutory approvals responsibility on contractor (fees by EPIL/PU).

One-sided default, debarment and integrity exposures

False credentials, Integrity Pact breach, cartelisation or unsatisfactory progress on existing EPI works can lead to rejection, EMD forfeiture and debarment up to three years; LOA collapses if PBG/additional APS not timely furnished.
