Item no 10.2 of GCC 2022: Financial Eligibility Criteria: The tenderer must have minimum average annual contractual turnover of V/N or 'V' whichever is less; where V= Advertised value of the tender in crores of Rupees N= Number of years prescribed for completion of work for which bids have been invited. The average annual contractual turnover shall be calculated as an average of "total contractual payments" in the previous three financial years, as per the audited balance sheet. However, in case balance sheet of the previous year is yet to be prepared/ audited, the audited balance sheet of the fourth previous year shall be considered for calculating average annual contractual turnover. The tenderers shall submit requisite information as per Annexure-VIB, along with copies of Audited Balance Sheets duly certified by the Chartered Accountant/ Certificate from Chartered Accountant duly supported by Audited Balance Sheet. The advertised value of instant tender is more than Rs 10 crore wherein eligibility criteria includes bid capacity also, the tenderer will be qualified only if its available bid capacity is equal to or more than the total bid value of the present tender. All documents in support of fulfillment of eligibility criteria with respect to completion of similar nature of work for Technical Eligibility Criteria and Total contract value for Financial Eligibility Criteria should be submitted/ uploaded online in the website with scanned copy at the time of tender bidding with details showing in Annexure I, IV. No post tender communication, in any form will be made or entertained, after opening of tenders, in this regard. Railways may however call for the originals of the credentials for verification or any clarifications/confirmations on the contents of the documents submitted. Eligibility of tenderers shall be decided solely of the basis of the documents submitted along with the tender offers and any subsequent document whatsoever submitted in this connection would not be given any cognizance for finalization of the tender.

Payment through Letter of Credit is applicable for this tender as per Railway Board's letter no 2017/ACII/9/10 Pt I dated 20.02.2018 & 2018/CE-I/CT/9 dt. 04.06.2018 (Annexure B & C attached).

INSTRUCTION TO BIDDERS: A] The Railway reserves the right to verify all statements, information and documents submitted by the bidder in his tender offer, and the bidder shall, when so required by the Railway, make available all such information, evidence and documents as may be necessary for such verification. Any such verification or lack of such verification, by the railway shall not relieve the bidder of his obligations or liabilities hereunder nor will it affect any rights of the railway there under. B] In case of any wrong information submitted by tenderer, the contract shall be terminated, Earnest Money Deposit [EMD], performance Guarantee [PG] and Security Deposit [SD] of contract forfeited and agency barred for doing business on entire Indian Railways for 5[five] years.

Contractor(s)/ Bidders are requested to refer to Clause 46A of Indian Railways Standard General Conditions of Contract'2022 with up to date correction slip for Price Variation Clause (PVC) in works contract. Item no 46A.1 of GCC 2022: Price Variation Clause (PVC) shall be applicable only in tender having advertised value above Rs. 2 Crores. RATES TO INCLUDE ALL TAXES: Any increase in rate of statutory taxes of State/Central Govt. including royalty and levy of any new type of such statutory taxes shall be on Railway account. Similarly, decrease in rate of statutory taxes of State/Central Govt. including royalty shall be deducted from the bill of contractual agency.

Whereas Income Tax and GST shall be deducted from the bills of contractual agency as per the extant instructions on the issue for the time being, the contractor shall furnish certificate of payment of Royalty Charges from the concerned State Mining Department before payment of such bills as mentioned in para 11.0 of Ch-III. However, change of rate of Statutory Taxes of the State/ Central Government and levy of any new type of such Statutory Tax shall be on Railway Account.

No deviation from the stipulations laid down under Para 8.5 of the Chapter-III of this tender document shall be accepted by way of any special condition from the tenderer.

Mobilisation advance is not applicable for this Tender.

Machinery and Equipment advance is not applicable for this tender.

Tenderer should quote rate inclusive of applicable GST.

Joint Venture is applicable for this tender. Bid Security shall be submitted by JV or authorized person of JV either as : (i)Cash through e-payment gateway or as mentioned in tender document, or (ii)Bank Guarantee Bond as per Annexure-VIA of GCC-2022 either in the name of JV, or in the name of all members of JV as per MOU irrespective of their share in the JV if the JV has not been constituted legally till the date of submission of tender. The Technical and Financial eligibility of the JV shall be adjudged as per Para 18.15 of Chapter-I of Tender Document.
