Performance Guarantee: As per Indian Railways Standard GeneralCondition of Contract 2022. 16.(4) Performance Guarantee The procedurefor obtaining Performance Guarantee is outlined below: (a) The successfulbidder shall have to submit a Performance Guarantee (PG) within 21(Twenty one) days from the date of issue of Letter of Acceptance (LOA).Extension of time for submission of PG beyond 21 (Twenty one) days andupto 60 days from the date of issue of LOA may be given by the Authoritywho is competent to sign the contract agreement. However, a penalinterest of 12% per annum shall be charged for the delay beyond21(Twenty one) days, i.e. from 22ndday after the date of issue of LOA.Further, if the 60thday happens to be a declared holiday in the concernedoffice of the Railway, submission of PG can be accepted on the nextworking day. In all other cases, if the Contractor fails to submit therequisite PG even after 60 days from the date of issue of LOA, the contractis liable to be terminated. In case contract is terminated railway shall beentitled to forfeit Bid Security and other dues payable to the contractoragainst that particular contract, subject to maximum of PG amount. Incase a tenderer has not submitted Bid Security on the strength of theirregistration as a Startup recognized by Department of Industrial Policy andPromotion (DIPP) under Ministry of Commerce and Industry, DIPP shall beinformed to this effect. The failed Contractor shall be debarred fromparticipating in re-tender for that work. (b) The successful bidder shallsubmit the Performance Guarantee (PG) in any of the following forms,amounting to 5% of the original contract value:- (i) A deposit of Cash; (ii)Irrevocable Bank Guarantee; (iii) Government Securities including StateLoan Bonds at 5% below the market value; (iv) Pay Orders and DemandDrafts tendered by any Scheduled Commercial Bank of India; (v)Guarantee Bonds executed or Deposits Receipts tendered by anyScheduled Commercial Bank of India; (vi) Deposit in the Post OfficeSaving Bank; (vii) Deposit in the National Savings Certificates; (viii)Twelve years National Defence Certificates; (ix) Ten years DefenceDeposits; (x) National Defence Bonds and (xi) Unit Trust Certificates at 5%below market value or at the face value whichever is less. Also, FDR infavour of FA&CAO (free from any encumbrance) may be accepted.
The Performance Guarantee shall be submitted by the successfulbidder after the Letter of Acceptance (LOA) has been issued, but beforesigning of the contract agreement. This P.G. shall be initially valid upto thestipulated date of completion plus 60 days beyond that. In case, the timefor completion of work gets extended, the Contractor shall get the validityof P.G. extended to cover such extended time for completion of work plus60 days. (d) The value of PG to be submitted by the Contractor is basedon original contract value and shall not change due to subsequentvariation(s) in the original contract value. (e) The Performance Guarantee(PG) shall be released after physical completion of the work based on'Completion Certificate' issued by the competent authority stating that theContractor has completed the work in all respects satisfactorily. (f)Whenever the contract is rescinded, the Performance Guarantee alreadysubmitted for the contract shall be encashed. (g) The Engineer shall notmake a claim under the Performance Guarantee except for amounts towhich the President of India is entitled under the contract (notwithstanding and/or without prejudice to any other provisions in thecontract agreement) in the event of: (i) Failure by the Contractor toextend the validity of the Performance Guarantee as described hereinabove, in which event the Engineer may claim the full amount of thePerformance Guarantee. (ii) Failure by the Contractor to pay President ofIndia any amount due, either as agreed by the Contractor or determinedunder any of the Clauses/Conditions of the Agreement, within 30 days ofthe service of notice to this effect by Engineer. (iii) The Contract beingdetermined or rescinded under clause 62 of these conditions.
Security Deposit: As per Indian Railways Standard General Condition ofContract 2022. 16.(1) Security Deposit: The Security Deposit shall be 5%of the contract value. The Bid Security submitted by the Contractor with his tender will be retained/encashed by the Railways as part of security forthe due and faithful fulfillment of the contract by the Contractor. Providedfurther that, if Contractor submits the Cash or Term Deposit Receipt issuedfrom a Scheduled commercial bank of India or irrevocable Bank GuaranteeBond from a Scheduled commercial bank of India, either towards the FullSecurity Depositor the Part Security Deposit equal to or more than BidSecurity, the Railway shall return the Bid Security, to the Contractor.Balance of Security Deposit may be deposited by the Contractor in cash orTerm Deposit Receipt issued from Scheduled commercial bank of India orirrevocable Bank Guarantee bond issued from Scheduled commercial bankof India, or may be recovered at the rate of 6% of the bill amount till thefull Security Deposit is recovered. Provided also that in case of defaultingContractor, the Railway may retain any amount due for payment to theContractor on the pending "on account bills" so that the amounts soretained (including amount guaranteed through Performance Guarantee)may not exceed 10% of the total value of the contract. The IrrevocableBank Guarantee submitted towards Security deposit shall be initially validup to the stipulated date of Maintenance period plus 60 days and shall beextended from time to time, depending upon extension of contract grantedin terms of Clause 17A and 17B of the Standard General Conditions ofContract. Note: Security Deposit deposited in cash by the Contractor orrecovered from the running bills of a Contractor or submitted by contractoras Term Deposit Receipt(s) can be refunded/returned to the contractor, inlieu of irrevocable Bank Guarantee bond issued from scheduledcommercial bank of India, to be submitted by him, for an amount equal toor more than the already available Security Deposit, provided howeverthat, in a contract of value less than Rs. 50 Crore, such refund/ return ofthe already available Security Deposit is permitted up to two times and ina contract of value equal to or more than Rs. 50 Crore, such refund /return of the already available Security Deposit is permitted up to threetimes
Refund of Security Deposit: Security Deposit mentioned in subclause (1) above shall be returned to the Contractor along with or after,the following: (a) Final Payment of the Contract as per clause 51.(1) and(b) Execution of Final Supplementary Agreement or Certification byEngineer that Railway has No Claim on Contractor and (c) MaintenanceCertificate issued, on expiry of the maintenance period as per clause 50.(1), in case applicable. 16. (2) (ii) Forfeiture of Security Deposit:Whenever the contract is rescinded as a whole under clause 62 (1) ofthese conditions, the Security Deposit already with railways under thecontract shall be forfeited. However, in case the contract is rescinded inpart or parts under clause 62 (1) of these conditions, the Security Depositshall not be forfeited. 16.(3) No interest shall be payable upon the BidSecurity and Security Deposit or amounts payable to the Contractor underthe Contract, but Government Securities deposited in terms of Sub-Clause16.(4) (b) of this clause will be payable with interest accrued thereon.

The work shall be treated as on work contract basis and the rates tenderedshall be for complete items of work (except the materials, if any, stipulated forsupply by the department) inclusive of all taxes (including works contract tax,ifany0, duties, and levies etc and all charges for items contingent to the work,such as packing, forwarding, insurance, freight and delivery at site for thematerials to the supplied by the contractor, watch and ward of all materials(including those if any supplied by the department) for the work at site etc.
Unless and otherwise mentioned in the tender documents, the following worksshall be done by the contractor, and therefore their cost shall be deemed to beincluded in their tendered cost- i)Foundations for equipments and componentswhere required, including foundation bolts. ii)Cutting and making good alldamages caused during installation and restoring the same to their originalfinish. iii)Sealing of all floor openings provided by him for pipes and cables,from fire safety point of view, after laying of the same. iv)Painting at site of allexposed metal surfaces of the installation other than pre-painted items likefittings , fans, switchgear/distribution gear items, cubicle switch board etc.Damages to finished surfaces of these items while handling and erection, shallhowever be rectified to the satisfaction of the Engineer-in-charge. v)Testingand commissioning of complete installation
Unless and otherwise specified, power supply and water supply will be arranged by the contractor at the site for installation purpose. However, for testing purpose, electricity supply will be available free of cost to the contractor. Contractor will take due care to ensure safety of electrical installation during execution of work.
All tools and tackles required for handling of equipments and materials at siteof work as well as for their assembly and erection and also necessary testinstruments shall be the responsibility of the contractor
The contractor shall co-ordinate with all other agencies involved in the building work is not hampered due to delay in his work. Recessed conduit and other works, which directly affect the progress of building work, should be given priority.
Tools for Handling and Erection All tools and tackles required for handling of equipments and materials at site of work as well as for their assembly and erection and also necessary test instruments shall be the responsibility of thecontractor
Co-ordination with Other Agencies: The contractor shall co- ordinate with allother agencies involved in the building work so that the building work is nothampered due to delay in his work. Recessed conduit and other works, whichdirectly affect the progress of building work, should be given priority.
Care of Buildings: Care shall be taken by the contractor to avoid damage to the building during execution of his part of the work. He shall be responsible for repairing all damages and restoring the same to their original finish at his cost.He shall also remove at his cost all unwanted and waste materials arising out of his work from the site.
Structural Alterations to Buildings: (i) No structural member in the building shall be damaged/altered, without prior approval from the competent authority through the Engineer-in-charge. (ii) Structural provisions like openings,cutouts, if any, provided by the department for the work, shall be used. Wherethese require modifications, or where fresh provisions are required to be made,such contingent works shall be carried out by the contractor at his cost. (iii) Allsuch openings in floors provided by the Department shall be closed by thecontractor after installing the cables/ conduits/ rising mains etc. as the case may be, by any suitable means as approved by the Engineer-in-charge without any extra payment. (iv) All chases required in connection with the electrical works shall be provided and filled by the contractor at his own cost to theoriginal architectural finish of the buildings.
Addition to an Installation: Any addition temporary or permanent to the existing electrical installation shall not be made without a properly worked outscheme/ design by a qualified Electrical Engineer to ensure that such addition does not lead to overloading, safety violation of the existing system.
Work in Occupied Buildings: (i) When work is executed in occupied buildings,there would be minimum of inconvenience to the occupants. The work shall be programmed in consultation with the Engineer-in-charge and the occupying department. If so required, the work may have to be done even before andafter office hours. (ii) The contractor shall be responsible to abide by the regulations or restrictions set in regard to entry into, and movement within the premises. (iii) The contractor shall not tamper with any of the existing installations including their switching operations or connections thereto withoutspecific approval from the Engineer-in-charge.
Conformity to IE Act, IE Rules, and Standards: All Electrical works shall becarried out in accordance with the provisions of Indian Electricity Act, 2003 and Indian Electricity Rules, 1956 amended up to date and As per RDSO specification
Quality of Materials: All materials and equipments supplied by the contractorshall be new. They shall be of such design, size and materials as tosatisfactorily function under the rated conditions of operation and to withstandthe environmental conditions at site.
Inspection of Materials and Equipments: Materials and equipments to be usedin the work shall be inspected by the Departmental officers. Such inspectionwill be of following categories: (i) Inspection of materials/ equipments to bewitnessed at the manufacturer's premises in accordance with relevant BIS/Agreement Inspection Procedure. (ii) To receive materials at site withManufacturer's Test Certificate(s). (iii) To inspect materials at the AuthorizedDealer's Godowns to ensure delivery of genuine materials at site. (iv) Toreceive materials after physical inspection at site. The Departmental officerswill take adequate care to ensure that only tested and genuine materials ofproper quality are used in work. Similarly, for fabricated equipments, thecontractor will first submit dimensional detailed drawings for approval beforefabrication is taken up in the factory. Suitable stage inspection at factory alsowill be made to ensure proper use of materials, workmanship and qualitycontrol. The tender specifications will stipulate the inspection requirements ortheir waiver for various materials/ equipments including norms of inspection inspecific cases.
Ratings of Components: All components in a wiring installation shall be of appropriate ratings of voltage, current, and frequency, as required at the respective sections of the electrical installation in which they are used. All conductors, switches and accessories shall be of such size as to be capable of carrying the maximum current, which will normally flow through them, without their respective ratings being exceeded
Conformity to Standards: All components shall conform to relevant IndianStandard Specifications, wherever existing. Materials with ISI certification markshall be preferred. A broad list of relevant Indian Standards is given inAppendix D. These Indian Standards, including amendments or revisionsthereof upto the date of tender acceptance, shall be applicable in therespective contracts.Only quality materials of reputed make as specified in thetender will be used in work.
Testing: All tests, to be done before, during and after installation, shall becarried out, and the test results shall be submitted to the Engineer-in-charge inprescribed Performa, forming part of the Completion Certificate
Commissioning on Completion: After the work is completed, it shall be ensuredthat the installation is tested and commissioned
