Bidders shall ensure upload of relevant document certifying his/her status as CAT-I reserved category as prescribed in the tender document.-FAILING TO WHICH BID WILL BE REJECTED

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

1)The bidder is required to ensure browser compatibility of the computer well in advance to the last date and time for receipt of tenders. The departments shall not be responsible for non-accessibility of KPP PORTAL due to internet connectivity issues and technical glitches at bidders end.2)The intending Bidder/ Firm/ company are advised to visit the work site before submission of the tenders.3)The necessary Certificates / documents in support of eligibility criteria fulfilled as stipulated shall be scanned and attached to e- tender document. The original certificate / documents shall be produced prior to the opening of bid for verification. Scanned signature of the Bidder/ Firm/ company authorized representative of the Bidder/ Firm/ company shall be attached while uploading bid document.4)If any of the dates mentioned above happens to be a general holiday, the next working day holds good.5)conditional tenders are liable to be rejected. The officer competent to accept the tender shall have the right to reject any or all the tenders without assigning any reason whatsoever.6)Corrigendum will be published in the website for all modifications or corrections if any.7)The contractor should mention their recent correct postal address & mail address in declaration forms

8)All materials like steel, cement etc., required for the above work should be procured by the contractor only.No departmental supply of any materials shall be made by Dept.9)The contractor should adhere to the accepted execution plan submitted by him under any circumstances without linking to the pending payment of the work & also Land acquisition problems if any.10)Royalty charges will be deducted from contractors running bill as the per prevailing G.O.at the time of payment. Commerce and Industries Secretariat Notification No.CI 81 MMN 2014 18th February 2018 see sub rule i of rule 36 Royalty, and Mines and Geology, rules and regulations amendment Act, para 36 92 of 1994 and as per the and Circular issued from Director Mines and Geology Department, Bengaluru letter no 2019 20 4493 Dated 03.12.2019 are to be followed.11)Typographical errors, if any, will not be the ground for any claims by the Contractor.12)The necessary Certificates / documents in support of eligibility criteria fulfilled as stipulated shall be scanned and attached to e- tender document. The original certificate / documents shall be produced for verification otherwise the tender will be treated as non responsive bid and rejected.13)Scanned signature of the Bidder/ Firm/ company authorized representative of the Bidder/ Firm/ company shall be attached while uploading bid document.14)Incomplete tender documents will be rejected.15)As per the Karnataka Building and other Constructions Workers Welfare Cess Act 1996, 1% of the bill amount will be deducted from the bills.16)The contractor should adhere to the accepted execution plan submitted by him under any circumstances without linking to the pending payment of the Work

17)The contractor should furnish the name of the individual/Firm/company with address & telephone No with place of registration, year of incorporation etc.18)Original documents should be produced for verification at any stage of the tender process, as and when sought for. Failure to produce original documents will lead to disqualification. work done certificate should have all the details CR no, work order issuing date,work completion date and year as asked in bid document.19)If MDP(Mineral dispatch permits) not submitted by contractors for usage of respective minerals for construction the Royalty charges will be deducted from the contactors running bill as per the direction given by concern department or government at the time of payment.20)The Applicant shall be registered in KPWD/CPWD/KNNL /CNNL/ KBJNL/ VJNL and Other Public sector Organizations and shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by GOK/ GOI.21)Restrictions on Public Procurement from Bidders of certain countries as per Government order No. FD 455 Exp-12 2020 Bengaluru dated:01-04-2023.22)During the execution of works, if any minor minerals are required, contractors have to abide by the prevailing rules and Acts applicable to Minor Minerals. As per the prevailing rules, for any use of Minor Minerals, the contractor has to submit the mineral Dispatch Permit (MDP) obtained from Mines and Geology Department. If mineral Dispatch permit (MDP) is not submitted by the contractor along with the bill, the prevailing penalty DMF contribution as per Karnataka Minor Mineral Concession Rules 1994 (as amended from time to time) will be deducted from the contractors bill.23)The agencies participating in the tender shall be registered in the Construction Labour Board as per the G.O. No. LD 300 LET 2006 Dated:18-1-2007 and Addendum No. LD 95 LET 2013 Bengaluru Dt:1-4-2013. Also the contractors entrusted with the work shall employ the labours only who have registered in the Karnataka Building and Construction Workers Welfare Board failing which the contractor shall be liable for any further action as deemed by the authority.24)Within 20 days of receipt of the Letter of Acceptance, the successful Tenderer shall deliver to the Employer a Security deposit in any of the forms as mentioned in bid document for an amount equivalent to 5% of the Contract price plus additional security for unbalanced tenders in accordance with Clause 25.5 of ITT and Clause 44 of the Conditions of Contract for all works.25)The contractor has to make his own arrangements for procurement of all the required materials and the materials so procured shall confirm to the relevant IS Specifications and obtain necessary quality certificate from authorized quality control.

26)The Contractor is fully responsible for the Equipment / Material until the same is handed over to the EXECUTIVE ENGINEER in an operating condition after commissioning. The Contractor is responsible for the proper maintenance of equipment / material as well as protection of the same against theft, elements of nature, damages etc., while in his custody as well as after erection until the same is taken over by the EXECUTIVE ENGINEER under due acknowledgment in writing.27)The tenderer shall also disclose if there are any bankruptcy proceedings against him..28)The Work Done Certificates shall be issued by the Executive Engineer with indent number mentioned (if work done in Karnataka State), otherwise it shall be issued/ counter signed by Superintending Engineer (if the work is done in other states).29)Sub-Leasing/G.P.A of Work is Prohibited.30)Each Item Of BOQ To be read as with all lead and lifts including loading and unloading charges and as per the direction of Engineer in charge.31)Uploaded drawings are for TENDER PURPOSE ONLY.32)The statements showing the value of existing commitments and on-going works as well as the stipulated period of completion remaining for each of the work listed should be countersigned by the Employer in charge, not below the rank of an Executive Engineer or equivalent.33)Income Tax : Latest copy of the Income Tax Clearance Certificate and Sale Tax Clearance PAN and TAN Nos. to be uploaded.34)It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee into the respective receiving bank accounts of KPP PORTAL on or before the last date and time of bid submission

35)The tender processing charges paid by the bidder/ firm/ company are not refundable even if the tenders are cancelled.36)For payments related to GST,contractor should abide to prevailing FD Order no 417 EXP-12/2024 bengaluru dated 09-08-2024.37)The Bidder shall quote Rates WITHOUT adding PREVAILING GST for either materials or works Contract (Service)GST payable by the contractor under this work/contract will be paid to the contractor.38)Item Rates are Exclusive of Prevailing GST and amount to tender is also Exclusive of GST hence the contractor should quote his/her rate Exclusive of prevailing GST.39)STAR rates are applicable as per prevailing G.O N :PWD-159 CRM dt:30-09-2010.40)All other terms and conditions as per KW1 tender documents ARE APPLICABLE

41)Labour:The Contractor shall, unless otherwise provided in the contract, make his own arrangements for the engagement of all the staff and labour, local or other, and for their payment, housing, feeding and transport. The contractor shall, if required by the employer, deliver to the Employer a return in detail, in such form and at such intervals as the Employer may prescribe, showing the staff and the numbers of the several classes of labour from time to time employed by the contractor on the site and such other information as the employer may require.42)Compliance with labour regulations: During continuance of the contract, the contractor and his sub contractors shall abide at all times by all existing labour enactments and rules made there under, regulations, notifications and bye laws of the State or Central Government or local authority and any other labour law (including rules), regulations, bye laws that may be passed or notification that may be issued under any labour law in future either by the State or the Central Government or the local authority. The contractor shall keep the employer indemnified in case any action is taken against the employer by the competent authority on account of contravention of any of the provisions of any act or rules made there under, regulations or notifications including amendments. If the employer is caused to pay or reimburse, such amounts as may be necessary to cause or observe, or for non observance of the provisions stipulated in the notifications/bye laws/acts/rules/regulations including amendments, if any, on the part of the contractor, employer shall have the right to deduct any money due to the contractor including his amount of security deposit. The employer shall also have right to recover from the contractor any sum required or estimated to be required for making good the loss or damage suffered by the employer. The employees of the contractor and the sub contractor in no case shall be treated as the employees of the employer at any point of time.

43)Protection of the environment: The contractor shall take all reasonable steps to protect the environment on and off the site and to avoid damage or nuisance to persons or to property of the public or others resulting from pollution, noise or other causes arising as a consequence of his methods of operation. During continuance of the contract, the contractor and his sub contractors shall abide at all times by all existing enactments on environmental protection and rules made there under, regulations, notifications and bye laws of the State or Central government, or local authorities and any other law, bye law, regulations that may be passed or notification that may be issued in this respect in future by the State or Central government or the local authority.44)The rates quoted by the agency shall not be less than the basic rates mentioned in breakup details enclosed in the tender booklet. The agency shall provide break up of rates quoted indicating all applicable taxes including any statutory benefits to be provided as per law separately along with the tender.45)The agency shall strictly comply with all labour laws of land. They shall produce documentary evidence of the same when demanded. The agency will alone be responsible for the consequences of any violations of these and employer shall be absolved of any short comings and consequences of any violations.46)The agency shall provide the Man power staff with EPF and ESI benefits as per rules in force of labour department and the agency shall provide the documentary evidence of providing the same with documents indicating the name of all man power staff deployed to the employer, along with the next bill without fail.47)The Man power staff should possess the requisite qualification and must be physically fit to perform the Assigned duties and shall follow the norms and Dress code of the concerned offices.48)The Man power staff viz D group, Electrical and Lift operators and Security guards must be provided with uniform by the agency during the period of contract.

49)The user reserves the right to increase or decrease the quantum of Man power staff during the contract period and the agency shall have no claim of any nature what so ever.The manpower staff should have good character and punctual to the duty.50)The employer reserves the right to reject the services of any persons if found unsuitable and the agency has to provide a suitable substitute.51)No extra cost for the substitute is payable.52)The supply of Man power to the employer shall strictly conform to the requirement of the department and due consideration shall be given as suggested by the employer only to those who have prior experience of working in this department and in as much required by the employer.53)No accommodation will be provided by the employer.54)Monthly bill shall be submitted in triplicate before 5th of every month for the previous month.55)The agency shall not claim for any additional charges other than the charges agreed to.56)One percent (1%) of the bill amount of the successful tenderer will be deducted towards the construction labour welfare fund as per Government Order LD / 300 / LET / 2006 Bangalore dated 01-01-2007 and Government letter no. PW / 134 / BMS / 2007 dated 27-07-2007.57)The employer can terminate the contract at any point of time without assigning any reason with a prior notice of one week.

58)The rates quoted are exclusive of GST. The GST will be paid separately.59)The agency shall supply man power staff as per the agreement throughout the committed period without any shortfall so that no hindrance is caused to the Government work.60)In case of inspection by higher authorities of Government or by Accounts department or by labour department, it is the responsibility of the agency to furnish details regarding man power staff supplied, accounts, different types of registers etc.61)The Agency shall pay the salary to the employee within 10th of every month without fail through cheque or ECS directly to the bank account of the concerned man power staff and the proof of payment in respect of all man power staff by way of bank statements or other documents indicating the name of the man power staff should invariably be submitted along with the next bill . Under no circumstance the agency shall wait for the release of funds from the Government for releasing payment to man power staff deployed by the employer.62)The Agency shall ensure all precautionary measures to his employees as per the Guidelines issued by Govt.63)The contractor should engage labour for water management during watering period for clearance of obstacles in flow path and operating, watching and guarding regulator & sluices as per the direction of engineer in charge.64)The contractor should engage labour during non watering period for removal of silt and jungle and other required work as per the direction of engineer in charge.65)The wages quoted by the contractor shall not be less than the basic wages specified.. Otherwise it will not be considered for evaluation.66)The tenderer should be registered with the Karnataka Labour Department for the supply of manpower. The agency shall provide the valid registration certificate for the concurrent period

To qualify for award of this contract, each tenderer in its name should have in the last five years period i.e. 2020-21 to 2024-25 satisfactory completion as a prime contractor for at least REJUVENATION/REPAIRS /MAINTENACE OF LIS / ANY WORK of value not less than Rs 5.03 Lakhs. (to an extent of 25% of the work for all works costing upto and Rs 100.00 Lakhs.)
