Railways reserves the rights to place order for entire / bulk quantity on firms who have successfully supplied same/similar items to any Railway/ PUs for which documentary evidence must be furnished along with their offer evidencing execution of such the purchase orders

Procurement from (OEMs) manufacturers or authorized agent/dealer: (i). Either OEM should quote directly or OEM can authorize and give Tender Specific Authorization to its Agent / dealer to quote on their behalf. (ii) The authorized dealer should submit valid tender specific authorization, along with the offer, failing which their offer will be liable to be passed over. (iii) Trader / Authorized dealer should mention name of Manufacturer along with complete address for inspection of material at OEM Premises in line with Instructions to Tenederes and General Conditions of Tender Indigenous Version 14 or latest with all revisions and corrigendums issued before tender closing.

Make In India Preference policy :- In keeping with the Public Procurement (Preference to Make in India) Order, 2017 as amended, procurement of the item is restricted to Class I and class II local suppliers. Minimum local content requirement for Class-I local supplier is minimum 50 % . For Class-II local supplier is minimum 20 % . Non local suppliers: The bidders offering imported products will fall under the category of Non-local suppliers- As per MINISTRY OF RAILWAYS - RAILWAY BOARD letter ..2020/ RS(G)/779/2-Part-1 Dated: 17/05/2021. The vendors with local content less than 20% should not quote in the tender who do not qualify to be Class I and class II local suppliers, as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a Class I and class II local supplier for tendered item participates in the tender it does so at its own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor.

Single use plastic should not be used in packing of material to be supplied otherwise it will be rejected.

On receipt of the machine, the firm or his agent would be required to carry out a joint check at the consignee's end along with the consignee before unpacking is done to avoid subsequent complaints regarding short shipment/ transit damages. It is necessary that this joint inspection be done immediately on receipt of the machine by the consignee & firm's representative to avoid commissioning delays due to shortage/transit damages. Commissioning Time: - Commissioning will be completed within the delivery period specified in the Purchase Order (PO) or the period mentioned for commissioning in the PO, whichever is applicable. Other penalty as per IRS condition of LD.

Maximum downtime during the warranty period will be 2% for online Machinery and Plant including Medical equipment and 10% for offline Machinery and Plant calculated on quarterly basis. Penalty of 0.5% per week on part thereof of the contract value will be levied for delay in response time for attending and rectification of fault beyond specified time during the warranty time. Maximum penalty to be levied on account of warranty failure will be 5% of the contract value calculated during the whole of the warranty period, and after that if there is any delay on part of the Contractor; purchaser shall be entitled to encash warranty BG. Further, in such cases bad performance of such Contractor shall be recorded and circulated to all the zonal railways and in future tender the poor performance of such tenders shall be duly considered. The decision of the Purchaser in regard to Contractor's liability and the amount, if any, the pay able under this warranty shall be final and conclusive. Warranty clause is also applicable for spare parts / assemblies.
