Financial Eligibility Criteria: The tenderer must have minimum average annual contractual turnover of V/N or 'V' whichever is less; where,
V= Advertised value of the tender in crores of Rupees
N= Number of years prescribed for completion of work for which bids have been invited.
The average annual contractual turnover shall be calculated as an average of "total contractual payments" in the previous three financial years, as per the audited balance sheet. However, in case the balance sheet of the previous year is yet to be prepared/audited, the audited balance sheet of the fourth previous year shall be considered for calculating the average annual contractual turnover. The tenderer shall submit the requisite information as per Annexure-VI B of GCC, along with copies of Audited Balance Sheets duly certified by the Chartered Accountant / Certificate from Chartered Accountant, duly supported by the Audited Balance Sheet.
Technical Eligibility Criteria: The tenderer must have successfully completed any of the following during the last 07 [seven] years, ending on the last day of the month previous to the one in which the tender is invited: Three similar works, each costing not less than the amount equal to 30% of the advertised value of the tender, or Two similar works, each costing not less than the amount equal to 40% of the advertised value of the tender, or One similar work, costing not less than the amount equal to 60% of the advertised value of the tender.
For the purpose of this tender, "Similar Nature of Work" shall be as defined as:

Tenderers shall submit the truthfulness certificate as per Annexure-V. For Partnership Firms/JVs/HUF/LLP etc., each member shall also submit Annexure-V(A). Non-submission will result in rejection of the bid. Tenderers must clearly identify and submit all supporting documents for the Qualifying Criteria, duly self-attested/digitally signed.
If the tenderer is a Partnership Firm, the following documents shall be submitted: A notarized copy of the Partnership Deed; A notarized or legally registered Power of Attorney authorizing an individual to sign the tender documents and bind the firm; and The PAN/TAN of the Partnership Firm. (PAN/TAN in the name of any individual partner will not be accepted.)
If the tenderer is a Hindu Undivided Family (HUF), the following shall be submitted: A notarized affidavit on stamp paper declaring that the individual submitting the tender is the Karta of the HUF and is duly empowered and authorized by all other members to act on behalf of the HUF; and All other documents as specified in the explanatory notes under Clause 10 of IRGCC- 2022.
In case the Tenderer is a Sole Proprietorship Firm: All other documents in terms of explanatory notes in clause 10 of IR-GCC 2022.
If the tenderer is a Company registered under the Companies Act, 2013, the following documents shall be submitted: Copies of the Company's Memorandum of Association (MOA) and Articles of Association (AOA); A copy of the Certificate of Incorporation; A copy of the Authorization/Power of Attorney, issued by the Company and supported by a Board Resolution, empowering an individual to sign the tender documents and bind the Company; and A copy of the PAN of the Company.
If the tenderer is a Limited Liability Partnership (LLP) registered under the LLP Act, 2008, the following documents shall be submitted: A copy of the LLP Agreement; A copy of the Certificate of Incorporation; A copy of the Power of Attorney/Authorization issued by the LLP, authorizing an individual to sign the tender documents and bind the LLP; and A copy of the PAN of the LLP.
If the tenderer is a Registered Society or a Registered Trust, the following documents shall be submitted: A copy of the Certificate of Registration; A copy of the Deed of Formation; A Power of Attorney/Authorization in favour of the individual authorized to sign the tender documents and bind the Society/Trust; and A copy of the PAN of the Society/Trust.
Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.
If the mandatory documents asked for in the E-Tender Document are not submitted along with the tender, the tender submitted otherwise will be treated as incomplete and will not be considered.
The quantities shown in above Schedule are approximate and are as a guide to give the tenderer(s) an idea of quantum of work involved. The Railway reserves the right to increase/decrease and/or delete or include any of the quantities given above and no extra rate will be allowed on this account.
All rates quoted in the tender shall be deemed to include all taxes and royalties payable by the contractor to any Government, public body, or local authority. No additional payment or claim on this account shall be admissible by the Railway.
It shall be the responsibility of the tenderer to regularly check the website for any corrigendum issued to the tender. The tenderer must ensure that all such corrigenda are noted and complied with.
The tenderer shall quote rates as a percentage above or below the South Western Railway Schedule of Rates applicable to Mysuru Division, except for items requiring item-wise rates. The tenderer must quote for all items listed in the Schedule of Approximate Quantities. The quantities indicated are only approximate and may vary depending on Railway requirements. The Railway does not guarantee execution of the quantity under each item of the Schedule.
If the tender is accepted, the Earnest Money will be retained and adjusted towards the Security Deposit required for proper and faithful execution of the contract. This Security Deposit shall be forfeited if the tenderer/contractor fails to execute the Agreement Bond within seven days of receiving the Railway's notice that the documents are ready, or fails to commence the work within fifteen days of receiving the work order.
The authority to accept any tender shall rest solely with the Railway. The Railway is under no obligation to accept the lowest tender or any other tender. Tenderers shall not be entitled to seek or demand any explanation for the rejection of their tender, nor is the Railway required to provide reasons for declining to consider or accept any particular tender.
If the tenderer(s) passes away after the submission of his / their tender or after the acceptance of his/their tender, the Railway shall deem such tender cancelled. If a partner of a firm expires after the submission of their tender or after the acceptance of their tender, the Railway shall deem such tender as cancelled, unless the firm retains its character.
The works are required to be completed within a period of months as mentioned in website from the date of issue of acceptance letter.
The Tenderer(s) shall keep the offer open for a minimum period of 45 days from the date of opening of the Tender. It is understood that the tender documents have been sold/issued to the Tenderer(s) and the Tenderer(s) is/are permitted to tender in consideration of the stipulation on his/their part that after submitting his/their tender, subject to the period being extended further, if required by mutual agreement from time to time. He will not modify the terms and conditions thereof in a manner not acceptable to the DRM/S&T/Divisional Engineer of SW Railway. Should the tenderer fail to observe or comply with the foregoing stipulation, the amount deposited as Earnest Money for the due performance of the above stipulation shall be forfeited to the Railway.
No post tender correspondence will be permitted and the tender shall be decided based on the documents uploaded with the offer only.
The Tenderer(s) shall not add any conditions on their own in the tender documents while submitting their offer. Any such conditions if stated and if tender conditions are in violation of the Railway's, may lead to summary rejection of the offer. Railway reserves the right to reject such tenders summarily without assigning any reasons whatsoever.
The responsibility of uploading the correct documents lies with the Tenderer(s). In case the documents uploaded are found manipulated/forged, the offers of such Tenderer(s) will not be considered and such Tenderer(s) are liable to be debarred to participate for future works duly forfeiting their Earnest Money and the tenderer/contractor shall have no claims whatsoever in this regard. Railway reserves the right to determine/rescind the contract entered into in case of such false certificates/documents at any stage of the contract treating it as default of the contractor.
Tender Opening will be done any time after the tender closing time. Tenderers are not required to be present during the opening. Railway reserves right to open the tender any time after the time of closing of tender.
Before submitting a tender, the tenderer will be deemed to have satisfied himself by actual inspection of the site and locality of the works, that all conditions liable to be encountered during the execution of the works are taken into account and that the rates he enters in the tender forms are adequate and all inclusive to accord with the provisions in Clause-37 of the Standard General Conditions of Contract for the completion of works to the entire satisfaction of the Engineer.
Railways, being principal employer are required to ensure that the contractors are complying with the provisions of the contract labour (R&A) Act, 1970 and Minimum Wages Act, 1948 strictly and arranging prescribed minimum wages to the contractor labourers/staffs vide Railway Board letter No. 2016/E(LL)/AT/MW/1 Dt. 05.06.2017.
