Provision of One Lift at DRM Building, Samastipur

(1) Only OEM of any make elevator /Lift can participate in the tender. Authorized dealer not allowed to participate in this tender. Also, OEM has to submit the relevant document to certify OEM (2) The CMC for the Lift will be comprehensive and shall be inclusive of all spares, materials (all minor or major items etc.) and labor cost for scheduled/unscheduled day to day maintenance.

I/we the tenderer (s) am/are signing this document after carefully reading the contents.

I/We the tenderer(s) also accept all the conditions of the tender and have signed all the pages in confirmation thereof.

I/we hereby declare that I/we have downloaded the tender documents from Indian Railway website www.ireps.gov.in . I/we have verified the content of the document from the website and there is no addition, no deletion or no alteration to the content of the tender document. In case of any discrepancy noticed at any stage i.e. evaluation of tenders, execution of work or final payment of the contract, the master copy available with the railway Administration shall be final and binding upon me/us.

I/we declare and certify that I/we have not made any misleading or false representation in the forms, statements and attachments in proof of the qualification requirements.

I/We also understand that my/our offer will be evaluated based on the documents/credentials submitted along with the offer and same shall be binding upon me/us.

I/We declare that the information and documents submitted along with the tender by me/us are correct and I/we are fully responsible for the correctness of the information and documents, submitted by us.

I/we certify that I/we the tenderer(s) is/are not blacklisted or debarred by Railways or any other Ministry / Department of Govt. of India from participation in tender on the date of submission of bids, either in individual capacity or as a HUF/ member of the partnership firm/LLP/JV/Society/Trust.

I/we understand that if the contents of the certificate submitted by us are found to be forged/false at any time during process for evaluation of tenders, it shall lead to forfeiture of the Bid Security and may also lead to any other action provided in the contract including banning of business for a period of upto two year. Further, I/we and all my/our constituents understand that my/our offer shall be summarily rejected.

I/we also understand that if the contents of the certificate submitted by us are found to be false/forged at any time after the award of the contract, it will lead to termination of the contract, along with forfeiture of Bid Security/Security Deposit and Performance guarantee and may also lead to any other action provided in the contract including banning of business for a period of upto two year.

I/We have read the clause regarding restriction on procurement from a bidder of a country which shares a land border with India and certify that I am/We are not from such a country or, if from such a country, have been registered with the competent Authority. I/We hereby certify that I/we fulfil all the requirements in this regard and am/are eligible to be considered (evidence of valid registration by the competent authority is enclosed)

Scanned copy of PAN (Permanent Account Number) and Goods and Services Tax Registration Certificate indicating GSTIN should be uploaded. In case of non-availability / non-applicability of any of these documents, reasons should be furnished under 'Remarks'. GSTIN along with other details required under CGST/SGST/UTGST/IGST Act may also be submitted by the successful tenderer immediately after the award of contract.

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

Attested copies of the documents pertaining to constitution of the concern (Sole Proprietorship Firm / Partnership Firm /Registered Company/ Registered Trust / Registered Society /HUF etc.) as described in detail at clause no.14 of Tender Form (Second Sheet) of GCC 2022 as well as legal competency of the person signing the tender offer (Power of Attorney) should be uploaded clearly indicating the nature of the firm. Power of attorney shall be submitted even if the person signing on behalf of the tenderer is authorized for that purpose through partnership deed / Memorandum of Understanding / Article of Association or such other document, failing which tender is liable to be rejected. Sole proprietorship firm shall have to submit notarized copy of the affidavit. In case the tender is signed and submitted by the proprietor himself /herseIf, no power of attorney is required. Railway reserves the right to legally scrutinize original copies of such documents as and when required. After opening of the tender, any document pertaining to the constitution of Sole Proprietorship Firm / Partnership Firm / Registered Company/ Registered Trust / Registered Society / HUF etc. shall be neither asked nor considered, if submitted. Further, no suo moto cognizance of any document available in public domain (i.e., on internet etc.) or in Railway's record/office files etc. will be taken for consideration of the tender, if no suchmention is available in tender offer submitted.

The tenderer will have to make payment towards Earnest money deposit (EMD) against this tender through online payment modes like net banking, debit/ credit cards etc. available on IREPS portal (www.ireps.gov.in). The tenderer is required to pay the Earnest Money deposit before he can prepare and submit his bid. Any firm recognized by Department of Industrial Policy and Promotion (DIPP) as 'Startups' shall be exempted from payment of Earnest Money on submission of Registration Certificate issued by appropriate authority. 100% Govt. owned PSUs shall be exempted from payment of earnest money deposit. Labour Cooperative Societies shall deposit only 50% of above earnest money deposit on submission of necessary documents.

In support of their credentials, the Tenderers should submit along with their tenders document - List of Plant and Machinery available on hand (own/hired) and proposed to be inducted (own/ hired) to be given separately for the subject work .

The Earnest Money and Cost of tender booklet : There is one mode for submssion of EMD through online payment. The bidders will have to make payment towards tender document cost and earnest money against the tender through online payment modes like net banking, debit/ credit cards etc. available on IREPS portal in favour of FA & CAO, ECR, Hajipur payable at Hajipur executed by State Bank of India or any of the Nationalized Banks or Scheduled Bank.

Eligibility criteria for works tender in respect of partnership firms:-

in case the tenderer is a partnership firm s , the experience, solvency and turn over shall be in the name and style of the firm only.

If the tenderer is a partnership firm, all the partners shall be jointly and severally liable for successful completion of the work and no request for change on the certification of the firm shall be entertained.

During the currency of the contract, no partner of the firm shall be permitted to withdraw from partnership business and in such and event it shall be treated as breach of trust and abandonment of the contract.

JOINT VENTURE will not be permitted for the tenders.

Any Conditional offer will be summarily rejected.

Rates are inclusive of all taxes/GST, license fee, royalty charges etc. legally leviable by State, Central Govt. and/or any other local authority.

Earnest Money and Tender Document Cost: -All the tenderers / Contractors have to deposit full earnest money and tender document cost as stipulated in the tender document through online modes as permitted in IREPS application.

After opening of the tender, any document pertaining to the constitution of Sole Proprietorship Firm / Partnership Firm / Registered Company/ Registered Trust / Registered Society / HUF etc. shall be neither asked nor considered, if submitted. Further, no suo moto cognizance of any document available in public domain (i.e., on internet etc.) or in Railway's record/office files etc. will be taken for consideration of the tender, if no such mention is available in tender offer submitted.

Tenderers shall note that the submission of supporting documents at the time of on line bidding of tender, is important and they shall ensure the same. However Railways may seek clarification/details /documents in this regard.

Before submitting the offer, please read carefully complete e- tender document including annexed document, Standard General Condition of Contract. Special Condition of Contract, bill of quantities etc. Your digital signature on the etender form will be considered as your confirmation that you have read and accepted all the condition laid down in the document stated above.

This contract shall be governed by "Indian Railways General Condition of Contract, April-2022" which is uploaded with up to date correction slips (if any).However, tenderers need not upload the same along with their bid. Tenderers are responsible for knowledge of GCC and its amendment.
