Railway reserves the right to place order for up to 20 percent of Net Procurement Quantity as developmental order in deserving cases. Firms who are otherwise not eligible for regular bulk order(s) due to their not meeting with the eligibility conditions mentioned in Para mentioned above can be considered for developmental orders provided they are able to demonstrate their Capacity-cum-Capability to manufacture the tendered item as per clause 3.5 of Central Railway CENTRAL RAILWAY BID DOCUMENT (Updated) JANUARY 2024.

For placement of bulk quantity order, Minimum 80% of Net Procurement Quantity shall be placed on the tenderer having relevant past performance of at least one single purchase order of any Zonal Railway/PUs/Core for the tendered item/specification for a minimum of 20 percent of the tendered quantity during previous 3 years. This period of 3 years shall be counted with respect to date of tender closing. Firms should submit documentary evidence certifying proof of execution of PO, such as scanned copies of Purchase Order along with copy of I/C s and R/Notes with the offer in terms of Clause 3.4 of the Section II of 'CENTRAL RAILWAY BID DOCUMENT (Updated) JANUARY 2024. I/We hereby certify that no other sister concerns or affiliates (such as having common partner/director/promoter/owner/holding company decision control etc.) have participated in this tender which can give rise to a conflict of interest or fall under anti-competitive practices. We understand that the offers of all such sister concerns including ours are liable to be rejected in terms of the relevant provisions of IRS terms and conditions. I/We, affirm that we shall abide by the Code of Integrity in general, Obligations for Proactive Disclosures in case of Conflict of Interest [Para 20.2]. I/We understand that we are fully responsible for the above declaration and it shall not be the Railway's responsibility to verify the same. I/We are aware that we shall be liable for all consequences of violation of Code of Integrity, if detected, at any stage." Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

The bidder confirms that rates and other financial terms quoted In relevant columns of financial bid will only be ruling terms for Acceptance, and such terms quoted anywhere else should be Ignored. The bidder agrees to supply the tendered stores at the Rates quoted by him in accordance with the IRS conditions of Contract and [or] special conditions and [or] other conditions Specified/attached with the tender.

Whenever tender is floated with purchase restriction from sources approved by nominated authorities and there exists a suspected cartel situation by approved sources or the rates available from approved source/sources are adjudged unreasonably high, despite fair efforts as permissible, the purchaser reserves the right to place orders on firms outside the approved vendor list, without any restrictions

The successful bidder shall note that Any modification/clarification for the conditions mentioned in the PO shall be brought to the notice of PO issuing authority within 10 days of issuing the PO. Beyond such time the PO shall be deemed accepted in all respect and any modification request there after shall be done with the liability on the tenderer.
