Special Eligibility Criteria

   Railways reserves the right to place bulk orders on bidders meeting any one of the following conditions: A. The bidder must possess a valid BIS license of IS:2062 and should attach copy of their valid BIS Mark i.e., CML No. for IS:2062 along with the offer. Offers without, will be summarily rejected. OR B. The bidder must be an authorized dealer of a firm holding a valid BIS license of IS:2062. The authorized dealer shall attach along with the offer, the tender specific authorization issued by the BIS-licensed firm of IS:2062 and a copy of valid BIS license of their OEM. The bidders may also attach along with the offer, general authorization/Dealer Ship certificate issued by the BIS licensed firm of IS:2062. Such general authorization/ dealership certificates must clearly indicate their validity date and shall be treated as acceptable, provided they are valid as on the date of tender opening. C. i) The bidder must have supplied 'Steel Channel/Steel Beam/Steel Column/Steel Angle to IS:2062' to Indian Railways/Govt Departments/Public Sector Undertakings. Documentary evidence such as GeM CRAC, Railway Receipt Notes, RITES Inspection Certificates or copies of complied Purchase Orders etc. must be furnished along with the offer as proof of execution of such orders. ii) The bidder with satisfactory past performance, as mentioned above, for supply of at least 28 Metric Tonnes(MT) quantity of 'Steel Channel/Steel Beam/Steel Column/Steel Angle to IS:2062' against a single contract during the last five financial years or in the current financial year (prior to and excluding the tender opening date) may be considered responsive to S.Rly requirements for placement of bulk and regular orders.

   If the level of requisite past performance as described above is lower, then firm's offer may be considered as responsive to S.Rly requirements for placement of developmental order not exceeding 20% of the net procurable quantity.

    Have you attached any performance statements with your offer? For proof of supply to other railways / production units copy of Purchase Order, Inspection certificate and receipt note / certificate must be uploaded. Non-submission of such vital documents may be taken as their not having any such past performance.

Commercial-Compliance

   Failure consequences: In the event the firm fails to execute the contract within the stipulated delivery period, the Purchaser shall be entitled to impose liquidated damages for any extension of the delivery period. Further, if the supplier, for any reason, fails to deliver the goods in whole or in part in accordance with the contractual terms and conditions (as amended from time to time), the Purchaser reserves the right to recover damages from the supplier, not as a penalty, but by way of compensation, equivalent to the value of the security deposit for the entire contract . Such damages shall be treated as outstanding recoveries against the vendor and shall be dealt with accordingly

   EARNEST MONEY DEPOSIT (EMD) : EMD shall be deposited by all vendors for tenders with estimated value above Rs.25 Lakhs subject to the applicable exemptions. For the exemptions and other details please refer Para 2.0 Part A of Southern Railway Tender conditions.

   Traders are outside the purview of MSE Policy. Hence, bidders who are participating as traders/agents/dealers of OEM are not eligible for EMD exemption on grounds of MSE Status.

   SECURITY DEPOSIT (SD) shall be 5 % of total value of contract and shall be taken from all vendors for contract value above Rs. 25 Lakh subject to the applicable exemptions.    It will not be obligatory on the part of Tender Committee/Accepting Authority scrutinize beyond the submitted document of tenderer as far as his qualification for the tender is considered.

   1. For PUBLIC PROCUREMENT POLICY (Preference to Make in India ), please refer Para 16.0 Part B of Southern Railway Tender Conditions. 2. Procurement of the item is restricted to Class-I local suppliers with minimum local content of 50% (Class-I Local supplier as defined in Railway Board letter no: No.2020/RS(G)/779/2/Pt.1 dated 25.09.2020) only and the vendors who do not qualify to be "Class-I Local suppliers" (i.e., "Non-Local suppliers" or "Class-II Local suppliers" with local content less than 50%) should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a "Class-I Local supplier" for the tendered item participates in the tender, it does so at it's own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor. 3.Please enter the percentage of the local content in the material being offered .    In case of road delivery, the date of delivery at destination [consignee's end] shall only be treated as delivery date irrespective of F.O.R. condition mentioned elsewhere in the contract / tender. Similarly, in case of delivery by Rail, the date of delivery at destination station [consignee's end] shall only be treated as delivery date irrespective of F.O.R. condition mentioned elsewhere in the contract / tender.
