Special Eligibility Criteria

   1. Firm will develop tender item as per tender drawings and other enclosed relevant documents. 2. Manufacturing firm will offer type test plan, routine test plan etc. as per relevant IEC/Indian standard or equivalent for approval along with Data Sheet. Acceptance of the test specification or change in test specification will be done by BLW in consultation with RDSO. 3. Firms have to submit details of M&P, testing facility, technical manpower available, supply performance of similar type items (PO copies, Inspection certificate) along with their offer for evaluating their manufacturing capacity by BLW/IR. 4.10 Loco set prototype units will undergo field trials for 6 months minimum. The field trial period may extend further subject to the field performance.

   Tenderer having past credentials of supply of same/similar item to show the capability of supplying the tenderer item and to substantiate their capacity to develop this item. Tenderer to enclose their detail of infrastructure of plant and machinery and testing/quality control, QAP, ISO certificate details and other documents.

   a) Requirement of a vendor to be a Class I local supplier and Class II Local Supplier (certification to be provided as per Revised 'Public Procurement (Preference to Make in India), Order 2017 dated 16/09/2020 amended thereof [referred as PPP-MII order 2017 in subsequent Paras]), for the tendered item(s), shall be a mandatory condition in addition to other qualifying criteria, including status of Vendor approval, which may be applicable for purchase of the item. b) Offers of only Class-I local supplier and Class-II local supplier, as defined under the PPP-MII order 2017, shall be considered for any ordering.

   Those firms who had developmental (out-side) order for the tendered item earlier, but the same developmental order has been cancelled within last one year from the date of tender opening date will not be considered for ordering in the tender case. However in exceptional cases where the firm gets CCA done through UVAM or through other approving unit, it may be considered for a developmental order even earlier also.

Commercial-Compliance

   Earnest Money (EMD) : A. All bidders shall be exempted from submission of EMD who submits bid securing declaration in the format given below : I/We hereby understand and accept that if I/We withdraw or modify my/our bids during the period of validity, or if I/We are awarded the contract and on being called upon to submit the performance security/Security Deposit, fail to submit the performance security/Security Deposit before the deadline defined in the request for bid document/Notice Inviting Tender, I/We shall be debarred from exemption of submitting Bid Security/Earnest Money Deposit and performance security/Security Deposit for a period of 06(Six) months, from the date I/We are declared disqualified from exemption from submission of EMD/SD, for all tenders for procurement of goods issued by any unit of Indian Railways published during this period. B. The firms who are not submitting above bid securing declaration they will have to furnish Earnest Money along with their offers as per clause 1.21.2 of BLW tender document (Rev. Year-2026 Ver-01).

   The bidder shall give self-certification for local content in the quoted item (Goods/Works/Services) at the time of tendering under the relevant para : However, at the time of execution of the project, for all contracts above INR 10 crores, the contractor/supplier shall be required to give local content certification duly certified by cost/chartered accountant in practice (or certified by statutory auditor/cost auditor of the company, in case of Companies, as mentioned under para 1.15.3.4 of BLW's tender doc.) after issue of the purchase order and before submission of the first bill. The supplier will submit the relevant cerificate to BLW's tender document. After verification & confirmation of the local content from the above said certificate, a letter will issued by the BLW's purchase office, in form of the Modification Advice (M.A.) to the Purchase Order, duly mentioning the Class of the vendor under MII policy. The above mentioned Modification Advice shall be attached by the contractor/supplier along with the first bill for claiming the payment, in case the contractor/supplier does not meet the stipulated local content requirement and the category of the supplier changes from Class-I to Class- II/Non-local or from Class-II to Non-Local, a penalty up to 10 % of the contract value may be imposed. However, contract once awarded shall not be terminated on this account. In compliance of Para 1.15.3.3 off BLW's tender document, it's also to be ensured that in cases of procurement for a value in excess of Rs. 10 crores, the 'Class-I local supplier/' Class-II local supplier' shall be required to provide a certificate from the statutory auditor or cost auditor of the company (in the case of companies) or from a practicing cost accountant or practicing chartered accountant (in respect of suppliers other than companies) giving the percentage of local content.
