Special Eligibility Criteria

   This item to be procured from RDSO approved/Developmental sources registered under RDSO item ID: 3100228001 as available on ireps vendor directory. The status of firm shall be reckoned as on date of tender opening and not thereafter, unless changed because of downgrading/removal/suspension/banning. BULK ORDER:-Railway reserves the right to order entire or bulk quantity on RDSO approved sources. DEVELOPMENTAL ORDER: -The development orders may be placed on firms which are unconditionally approved by RDSO as developmental vendor as per Para 1.3.1 of Annexure-B of WCRs eTENDER DOCUMENT FOR SUPPLY CONTRACTS. Note :- (i) In case there are not more than three Indian Suppliers categorized as Approved Vendor for a particular item, unconditionally approved developmental vendors ( without any condition of prototype / field trials etc) can be considered for placement of bulk order without any quantity restrictions as per Para 1.3.1 of Annexure-B of WCRs eTENDER DOCUMENT FOR SUPPLY CONTRACTS. (ii) CONDITIONAL APPROVAL BY RDSO FOR FIELD TRIAL : - When a firm is approved by RDSO for developmental orders but with conditional approval subjected to field trials of the specific quantity as on the date of tender opening , firm should attach the details of orders received already. In case firm do not attach details, it will be presumed that firm has not received any order for the tendered item& such firm shall be considered only up to 20 % of net procurable quantity or the balance quantity required for field trial whichever is minimum. However, if after opening of the tender, such firms receive any order, it will be responsibility of the firm to inform it to this office at the earliest. In case the firm get any order against this tender but RDSO do not entertain the order for carrying out trials/ inspection then the order will be cancelled as per relevant instructions mentioned in the tender conditions. (iii) CONDITIONAL APPROVAL BY RDSO SUBJECT TO PROTOTYPE APPROVAL : - When a firm is approved by RDSO for developmental orders with remarks that "Supply (even for field trials, whichever applicable) shall commence only after approval of the prototype by the RDSO as on the date of tender opening. Offer of such firms shall not be considered for any order & no back reference will be made in this regard & communication received after opening of tender will also not be entertained.

   (i) This item is controlled by RDSO. Railway reserves option to procure bulk quantity of the item from RDSO approved sources. (ii) Offer should receive either directly from OEM (RDSO approved source) or OEM authorized dealer along with tender specific OEM authorization.

Commercial-Compliance

   (i)Code of Integrity, Misdemeanor and Penalties :- I/We have carefully gone through the IRS conditions of contract (included and uploaded along with the bid document) particularly Para 2500 pertaining to "Code of Integrity, Misdemeanor and Penalties". I/We hereby certify that none of our sister concern or affiliates (such as having common partner/director/promoter/owner/holding company decision control etc.) have participated in this tender which can give rise to a conflict of interest or fall under anti-competitive practices. We understand that the offers of all such sister concern or affiliates including ours are liable to be rejected as per relevant provisions of IRS terms and conditions. I/We, affirm that we shall abide by the Code of Integrity in general, with specific reference to conflict of interest [Para 2502 (e)], anti competitive ractices [Para 2502(c)] and obligation to proactive disclosures [Para 2503]. I/We understand that we are fully responsible for the above declaration and it shall not be the Railway's responsibility to verify the same. I/We are aware that we shall be liable for all consequences of violation of Code of Integrity, if detected, at any stage. (Note: - May confirm as Yes , to certify all the above certification.)

   Jurisdiction of Court :- As per Para 2703 of IRS Condition of Contract the Courts of the place from where the acceptance of tender has been issued shall alone have jurisdiction to decide any dispute arising out of or in respect of the contract.

No. 7/10/2021- PPD(1) dated 23/02/2023 circulated vide OM No. F.7/10/2021-PPD dated 23.2.2023; and I further certify that this bidder has been registered with the Competent Authority.    "PLASTIC WASTE MANAGEMENT RULE 2016:- "It is certified that for execution of this contract, the plastic packaging material or commodities which are made out of Compostable Plastic or Biodegradable Plastic shall be purchased from firms having certification by CPCB for manufacture or sale of plastic packaging or commodities made from Compostable Plastic or Biogradable Plastic as per rule 4 (4) of Plastic Waste Management rule 2016. It is also certified that we shall also not use any other category of plastic, such as Bio Compostable or Oxo-degradable or Oxo-bio-degradable or the like, which are not recognized under Plastic Waste Management Rule 2016 with all amendments." (Note:- May confirm as Yes, to certify all the above certification.)

   1.The bidder agrees to supply the tendered stores at the rates quoted by him in accordance with the IRS Conditions of contract and (or) special conditions and (or) other Conditions specified/attached with the tender. 2.The bidder confirms that Rates and other financial terms quoted in relevant columns of financial bid will only be ruling terms for acceptance, and such terms quoted anywhere else should be ignored. (Denial of this condition not recommended) 3.If you are not a MSE or a consortia of MSEs formed by competent authority , please indicate percentage of sub contracts in execution of this tender that will be from Micro and Small Enterprise (in percent of order value) with further breakup of MSE owned by SC/ST, (Information will be provided in % terms with 6 fields; Micro owned by SC, Micro owned by ST, Micro owned by others, Small industry owned by SC, Small industry owned by ST, Small industry owned by Others). 4.
