Eligibility Criteria

Tenders from Joint ventures are not acceptable.

Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of KPPP portal on or before the last date and time of bid submission.

The bidder is required to ensure browser compatibility of the computer well in advance to the last date and time for receipt of tenders The departments shall not be responsible for non accessibility of KPPP portal due to internet connectivity issues and technical glitches at bidders end

EMD Payments through KPPP portal mode shall be made as one single transaction and payments made in part are liable for rejection

Bidder shall pay Contract Management Module processing fees of 0.025% of the contact value (Min Rs.500/- & Max Rs.7500/-) soon after contract has been issued to bidder

Conditional / Incomplete Tenders are liable to be rejected .The Employer reserves the right to Reject any or all Tenders without assigning any reason

Tenderer shall note that the Tenders of those found Eligible as mentioned in Clause 3 - Qualification of the Tenderer in Section 2 : Instructions to Tenderers (ITT), will only be considered for evaluation.

The quoted cost shall include royalty applicable by central/state/local authorities. Royalty on construction materials and other taxes will be deducted as per prevailing Govt orders. Royalty shall be deducted as per KMMCR 1994 Amendment rule 2016, Also KMMCR 2016 Amendment Rule 36(3), 42(1), 44(3), 44(4)

The cost of the Tender form shall not be refundable.

The successful bidder, before commencement of work shall produce Establishment registration certificate registered under labour department, Government of Karnataka . And shall engage only registered construction workers registered under labour department, Government of Karnataka

As per Karnataka State Govt Order No:LD/300/LET/2006/Bangalore Dt: 1-1-2007 and Govt Ltr No:PW/134/BMS/2007, Dt: 27-7-2007, a sum amounting to 1% of the bill amount will be deducted towards Construction Labour Welfare fund.

The item rates are excluding GST but inclusive of all other charges. The contractor shall quote the rates without adding GST either materials or works contract (service). GST payable by the Contractor under this works Contract will be paid to the Contractor separately over and above the Contractors bid amount. The increase if any in the GST shall not be paid in the extended period of contract for which the contractor alone is responsible for delay as determined by the authority.

Financial turnover of previous years shall be given a weight of 10% per year to bring them to the price level of the 2023-24 in the Technical Qualification Criteria .

Unique Document Identification Number (UDIN) from Practicing Chartered Account is Preferred with Annual Turnover certificate, P&L statements and in a Balance Sheets.

Name, address, telephone, email id and fax numbers of the contractor is to be provided for communication.

During the execution of work, if any minor minerals are required contractors have to abide by the Karnataka Minor Mineral Concession Rules 1994 (as amended up to date). As per the prevailing rules, for any use of Minor Minerals, the contractor has to submit the Mineral Dispatch Permit (MDP) obtained from Mines and Geology Department. If Mineral Dispatch Permit (MDP) is not submitted by the contractor along with the bill, the prevailing penalty and DMF contribution as per Karnataka Minor Mineral concession rules 1994 (as amended from time to time) will be deducted from contractors bills at the time of payment.

Sub-Leasing/G.P.A of Work is Prohibited.

The contractor has to furnish Additional Performance Security Deposit for unbalance tender as per clause 29.1 of ITT, to an amount equal to the difference in contract price and amount put to tender, in addition to 5% performance guarantee (in any of the form prescribed) while concluding the Agreement, .Failure of the successful tenderer to comply with the requirements of Tender clauses shall constitute a sufficient grounds for cancellations of the award and forfeiture of the Earnest Money Deposit

In case of unbalanced tender i.e the rate(s) Quoted by the contractor for any item(s) of work is/ are below 75%of the estimate/recast rate(s) of the department then the contractor shall furnish an additional security in the form as stated in clause 29 of ITT for an amount equvivalant to the difference between quoted rate(s) and 75% of estimate/recast rate(s) and shall be valid as stated in clause 43 of condition of contract in case of contractor quoting rate above 125% of the estimated/recast rate, then, the amount over and above 125% will be witheld during the progress of work. The withheld amount will be released only after entire work contract is fully complete and so certified by the employer

The contractor have been registered as KPWD class-I Registration Certificate (up load registration certificate of original should be produced while opening the tender)

As per vide Govt Circular No. FD-CAM/16/2022(P-2) dated 22.08.2022 Line of Credit (LOC) or Bankers Certificate (BC) should be in prescribed format (On Banks Letter Head), if not, then the Bid is liable to be rejected.

Addendum / Corrigendum will be published on the website for all modifications or corrections, if any.

The period of completion is 11 (Eleven months) including monsoon.

The intending bidders are advised to visit the site of work, and make themselves familiar with the local situation regarding the availability of the construction materials, workmen, land required for construction activities, etc.

The defects liability period is 1(ONE) year, i.e during the warranty period.

In the case of the death of the contractor after executing the agreement / commencement of the work, his legal heir, if is an eligible registered contractor and is willing can execute and compete the work at the accepted tender rates irrespective of the cost of the work.

Financial Year will be reckoned as the period between first day of April and Thirty first day of March of succeeding year (both days inclusive).

The tenderer shall furnish required information in all formats. Scan and upload all Formats/Original documents required for this bid to the e-procurement portal. The Original Formats/Documents shall be produced at the time of opening of Technical Bid for physical verification.

The Agency shall comply with ISO14001 (Environmental Management System) requirement during execution of work.

Estimate rates are excluding GST as per Common SR 2023-24 and prevailing GST (18percent of Amount Put to tender) amount is kept in form of Lump sum in sanctioned estimate according to guidelines in Common SR (GO:PWD 86 RDF 2022 Bengaluru Dt:15.11.2023). Therefore, amount put to Tender and ECV amount are inclusive GST. KPPP-PORTAL format has No Options to add GST Separately at stage of Draft Tender Schedule Process for Over All amount put to Tender, tender has been inviting through an Option with INCLUSIVE. But the item wise rates do not include GST. Hence, GST will be paid separately for the quoted amount accordingly. Declaration Certificate must be attached mandatorily.

The Tenders are invited as per Standard tender Bid Document KW-4

Agencies participating in the tender shall be registered in the Construction Labour Board as per the G.O.No.LD 300 LET 2006 Dated:18-1-2007 and Addendum No.LD 95 LET 2013 Bengaluru Dt:1-4-2013. Also the contractors entrusted with the work shall employ the labours only who have registered in the Karnataka Building and Construction Workers Welfare Board failing which the contractor shall be liable for any further action as deem fit by the authority/ EPF Registration

Omission and Typographical errors which are in the opinion of the Executive Engineer will not be a ground for claims of extra payment

Item for which 0.00 rate entered will not be paid for by the employer when executed and shall be deemed covered by the other rates & prices in the bill of quantities

Contractor has to make his own arrangement at his cost for procurement of all materials required for the work. There is no departmental supply of materials. Contractor should procure ONLY ISI mark materials and submit necessary quality control certificates from the authorized quality control authority, before execution. Also Contractor should establish a fully functional laboratory at site at their own cost and risk in order to carry out all the required tests for the materials and work being used in the project for satisfactory completion.Transportation charges from the site of work to Q.C.Lab of all the samples collected for testing should borne by the contractor himself.

If any of the dates mentioned in this tender happens to be a general holiday, the next working day holds good.

The contractor shall provide work program as per the chapter Time control of conditions of contract. The contractor should adhere to the accepted execution plan submitted by him under any circumstances without linking to the pending payment of the work.The proposed methodology and program of construction, backed with equipment planning and deployment, duly supported with broad calculations and quality control procedures proposed to be adopted, justifying their capability of execution and completion of the work as per technical specifications within the stipulated period of completion.

Contractors have to upload the Certificates of works in hand of any Department/Institutions failing which the tender will not be considered. Action will be taken as per clause 31 of SECTION 2: INSTRUCTIONS TO TENDERERS (ITT) in case of incomplete/ false documents regarding works in hand.

3.6 Tenderers who meet the specified minimum qualifying criteria will only be qualified, if their available tender capacity is more than the total tender value. The available tender capacity will be calculated as under: Assessed available tender capacity (AxNx1.5-B), Where A is Maximum value of civil engineering works executed in any one year during the last five years i.e.2018-19 to 2022-23 (updated to 2023-24 price level) taking into account the completed as well as works in progress. N is Number of years (0.92 years) prescribed for completion of the works for which tenders are invited. B is Value, at 2023-24 price level, of existing commitments and ongoing works to be completed during the next 0.92 years (11 Calendar months) Note: The statements showing the value of existing commitments and ongoing works as well as the stipulated period of completion remaining for each of the works listed should be countersigned by the Employer in charge, not below the rank of an Executive Engineer or equivalent.
