Eligibility Criteria

Tenders from Joint ventures are not acceptable.

Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka

Bidders shall ensure upload of relevant document certifying his/her status as Scheduled Caste/ Scheduled Tribe/other reserved category as prescribed in the tender document.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

The intending bidders are advised to visit the site of work before submission of the tenders

If the percentage quoted by contractor for the work is below Ninety percent (90%) of the amount put to tender (updated cost as per CSR) then the successful contractor shall furnish an additional performance security in the form of bank guarantee for an amount equivalent to the difference between the cost as per quoted percentage and Ninety percent (90%) of the amount put to tender (updated cost as per CSR) before executing the agreement. In case of contractor quoting the percentage above One Hundred and ten percent (125%) of the amount put to tender (updated cost as per CSR) then the amount over and above One Hundred and Ten percent (125%) of the amount put to tender (updated cost as per CSR) will be withheld during the progress of work. The additional performance security furnished in the former case/with held amount in the later case will be released only after the entire work entrusted is fully completed and so certified by the Executive Engineer.

The necessary certificates / documents in support of eligibility criteria fulfilled as stipulated shall be scanned and attached to e-tender document. The Original certificates/documents shall be produced on or before stipulated date and time for verification. Scanned signature of the bidder/authorized representative of the bidder shall be attached while uploading bid document

If any of the dates mentioned above happen to be a general holiday, the next working day holds good

The Technical bid will be opened first and there after the financial bids of those qualified in technical bid will be assessed on payment of tender processing fee. The financial bid will be opened subjected to the conditions that Electronic EMD payment is confirmed in the E-tender portal

Conditional tenders are liable to be rejected. The officer competent to accept the tender shall have the right to reject any or all the tenders without assigning any reason whatsoever

Corrigendum will be published in web site for all modifications/corrections if any

The intending bidders should note that, if any of lands either in part/parts or whole required for the work is not acquired by the Nigam, it shall be the responsibility of the bidder to take possession of such land and start the work by the consent of the land owners before commencement of work at no extra cost to the Nigam and no claim whatsoever relating to non availability of land would be entertained

The contractor should mention their recent correct postal address and e-mail address in the declaration form

Incomplete tender documents will be rejected

All materials like steel, cement etc., required for the above work should be procured by the contractor only at his own cost. And these materials will have to be got tested by the competent authority before put to use

The contractors shall send the authorization letter for their representatives duly attesting their signature

Maintenance period or the defect liability period for this work is 12 months from the date of completion of work

As per the Karnataka building and other construction workers welfare cess act 1996, 1% of the bill amount will be deducted from the bills

Tenders will be opened on the due date in presence of the contractor or their Authorized representatives

The payment of bills of this work will be made as and when the letter of credit is received under the same head of account from KNNL/Government of Karnataka

The contractors should adhere to the accepted action plan submitted by him under any circumstances without linking to the pending bill payment of the work

Typo-graphical errors if any will not be the ground for any claims by the Contractor

The contractor should furnish the name of the individual /firm with address and Telephone numbers with place of registration, year of incorporation etc

The tender processing charges paid by the bidders are not refundable even if the tenders are cancelled

Royalty on construction materials and other taxes will be deducted as per prevailing Government orders

The tenderer has to make his own arrangement for procurement of all materials required for the work. There is no departmental supply of materials. Contractor should procure only ISI mark materials and submit necessary quality control certificates from the authorized quality control authority, before execution

Sub leasing of work in any form is prohibited

Electrical work should be got done through registered electrical contractor

No quarries are approved by KNNL for materials. The quarries considered are for the estimate purpose only. The intending bidders shall visit the site, identify the quarries, ascertain availability for the quantity and quality of the materials required for the work and shall quote his rates accordingly. No extra claim whatsoever will be entertained in this regard

The rates includes all leads and lifts and work shall be carried out as per the instruction of Engineer-in-charge .All specifications are as per relevant IS codes in vogue and Indian Road Congress. The rates for the specification in the Schedule -B includes all lead and lifts irrespective of the distance and height, no extra claim will be entertained for additional lead and lifts

If Nigam wishes to engage third party inspecting agency for the said work, apart from the Quality control authorities and field tests of Nigam, the contractor should co-operate with the third party and quality control authorities

The validity period of EMD shall be for a minimum period of 225 days from the date of opening of the tenders

EMD of the unsuccessful bidders will be refunded only after the acceptance of tenders by the competent authority (clause 21 of the Formal Tender Notice)

EMD amount and Amount put to tender will be as mentioned in the e-portal

The contractor shall make his own land arrangements for depositing the excavated stuff

Quarries and Barrow areas:- All materials for construction which are not available from the excavation shall be obtained from the quarries and borrow areas which shall be got approved from the Engineer. The Government will not make available and quarry or borrow area. The contractor shall himself explore the quarries and borrow areas required for the work and quote his rate for finished items of work for Bill of quantities accordingly with all leads and lifts. The leads considered in the sanctioned estimate are for the estimate purpose and shall be not be takes as the actual leads for materials during execution. No claims what so ever shall be made or entertained for any extra leads over and above the leads considered in the estimate, no claim of any compensations shall be due to the contractor on any account whatsoever, such as the quarries and barrow areas considered in the estimates being found unsuitable or inadequate in yield, the haulage routs reckoned being found unsuitable, the lead reckoned being found incorrect, the land owners obstructing the procurement and conveyance etc,. The government does not undertake to acquire land for the quarries barrow areas. It is responsibility of the contractor to negotiate with the land owners and acquire the land to himself, either permanently or temporarily and procure required materials. If the quarries/ borrow area do not give sufficient quantity of material, contractor shall make his own arrangements for additional quarries/ borrow areas with the approval of the engineer and bear the cost of investigations all leads and lifts, cost of land etc,. at his own expanses without claim for any payment over and above his tender rates. Departmental investigation of the quarries borrows areas, on the basis of which the departmental estimates of cost are repaired have been made with the intention of having the most economical leads for the construction of work. If at any time after the entrustment of work, the departments finds quarries and borrow areas affording more economical leads and obtains position of such lands the departments reserves the right to order the contractor to bring the materials from such quarries and borrow areas and to reduce his rates in consequence thereof. In all such cases, whether the contractor compliance with the orders are not, the rates of concerned item of work in bill of quantities will be reduce for the quantities executed after two weeks from he date of communication of the order by an amount corresponding to the difference in the lead charges computed on the basis of the departmental schedule of rates adopted for preparing the comparative statement at the time of the acceptance of tender plus or minus percentage above or below in the original tender rates for that particular item of works
