In case of any discrepancy noticed at any stage i.e. evaluation of tenders, execution of work or final payment of the contract, the master copy available with the railway Administration shall be final and binding upon me/us.

Date of actual Start, Actual Completion and Final value of Contract shall also be given.

System of verification of Tenderer's credentials: (a) The tenderer shall submit along with the tender document, documents in support of his/their claim to fulfil the eligibility criteria as mentioned in the tender document. Each page of the copy of documents/certificates in support of credentials submitted by the tenderer shall be self attested/digitally signed by the tenderer or authorized representative of the tendering firm. Self- attestation shall include signature, stamp and date (on each page). Only those documents which are declared explicitly by the tenderer as "documents supporting the claim of qualifying the laid down eligibility criteria", will be considered for evaluating his/their tender

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

As per GCC-2022 ACS-11 dated-13.03.2026- New Para 16(4) (h) of Part-II of GCC'22- (h)- If a tender is accepted on the quoted rates of bidder which is below the advertised tender value, an additional performance security shall be submitted by the bidder as below: (1)- if bid quoted in % of advertised cost is below 0 to No 5% (inclusive) than additional Performance guarantee will be "Nil". (2)-If bid quoted in % of advertised cost is below 5% then an additional Performance guarantee of 5% will be submitted by the tenderer.

For enactment of this Act, the tenderer shall be required to pay cess 1 of cost of construction work to be deducted from each bill. Cost of material shall be outside the purview of cess, when No supplied under a separate schedule item Railway Boards No. 2008/CE-1 CT/6 Dt. 09-07-2008

Rates are inclusive of all taxes/octroi, license fee, royalty charges etc. legally leviable by State, Central Govt. and/or any No other local authority.

In addition to General condition of contract 2022 and Indian Railways Unified standard specification Works Materials Volume III 2010, revised upto date, special condition attached shall also apply.

Sales tax/Business tax will be recovered as per extant instruction on the subject

The successful tenderer will have to submit full security deposit No as per GCC-2022 before execution of the agreement.

The successful bidder shall have to submit a Performance Guarantee (PG) within 21 (Twenty one) days from the date of issue of Letter of Acceptance (LOA). Extension of time for submission of PG beyond 21 (Twenty one) days and upto 60 days from the date of issue of LOA may be given by the Authority who is competent to sign the contract agreement. However, a penal interest of 12% per annum shall be charged for the delay beyond 21(Twenty one) days, i.e. from 22nd day after the date of issue of LOA. Further, if the 60th day happens to be a declared holiday in the concerned office of the Railway. No submission of PG can be accepted on the next working day. In all other cases, if the Contractor fails to submit the requisite PG even after 60 days from the date of issue of LOA, the contract is liable to be terminated. In case contract is terminated railway shall be entitled to forfeit Earnest Money Deposit and other dues payable against that contract. In case a tenderer has not submitted Earnest Money Deposit on the strength of their registration as a Startup recognized by Department of Industrial Policy and Promotion (DIPP) under Ministry of Commerce and Industry, DIPP shall be informed to this effect. The failed Contractor shall be debarred from participating in re-tender for that work.

The successful bidder shall submit the Performance Guarantee PG in any of the following forms, amounting to 5 percent of the contract value: i A deposit of Cash ii Irrevocable Bank Guarantee iii Government Securities including State Loan Bonds at 5 percent below the market value i v Deposit Receipts, Pay Orders, Demand Drafts and Guarantee Bonds. These forms of Performance Guarantee could be either of the State Bank of India or of any of the Nationalized Banks v Guarantee Bonds executed or Deposits Receipts tendered by all Scheduled Banks vi A Deposit in the Post Office Saving Bank vii A Deposit in the National Savings Certificates viii Twelve years National Defense Certificates ix Ten years Defense Deposits x National Defense Bonds and xi Unit Trust Certificates at 5 percent below market value or at the face value whichever is less. Also, FDR in favour of FA & CAO/N. E. Railway free from any encumbrance may be accepted.

Price Variation Clause (PVC) shall be applicable only in tender having advertised value above Rs.2 Crores. Provided further that, in a contract where PVC is applicable, following shall be outside the purview of price adjustments (i.e. shall be excluded from the gross value of the work for the purpose of price variation): (a) Materials supplied by Railway to the Contractors, either free or at fixed rate; (b) Any extra item(s) included in subsequent variation falling outside the purview of the Bill(s) of Quantities of tender, under clause 39. (1)(b) of these StandardGeneral Conditions, unless applicability of PVC and 'Base Month No has been specially agreed, while fixing the rates of such extra item(s).(2) Price Variation Clause for Annual Maintenance Contract or Zonal Contract: The price variation Clause of General Conditions of Contract shall not apply to a works contract which is either an Annual Maintenance Contract or a Zonal Contract as per Railway Boards letter No. 2013/CE/I/CT/O/10-PVC-PL.I dated 27.01.2015 2017/Trans/01/Policy dated 08.02.2018.(3) Price Variation Clause shall be applicable accordingly attached document

Earnest Money Cost: All the tenderers/Contractors have to deposit full earnest money as stipulated in the tender document through online modes as permitted in IREPS application. (2) Tender Document Cost: All the tenderers/Contractors have to No deposit tender document cost as stipulated in the tender document through online modes as permitted in IREPS application.

One qualified Graduate Engineer where the cost of the work to be executed is Rs.200 lakh and above. b- One qualified Diploma Holder Engineer where the cost of the work to be executed is more then Rs.25 lakh, but less then Rs.200 lakh. Technical staff should be available at site whenever required by the Engineer- in-charge to take instructions. In case the contractor fails to employ the qualified Engineer, he shall be liable to pay amount of Rs.40000 and Rs.25000 for each month or part thereof for the default period for the provisions, as contained in para a and b above respectively. The decision of the Engineer-incharge as to the period for which the required technical staff was not employed by the contractor and as to the reasonableness of the amount to be deducted on this account No shall be final and binding on the contractor

All documents related to Constitution of Firm by the Partnership Firm/ Joint venture/ Society/Companies/ MOU etc. duly notorized No should be uploaded at the time of submission of bid.

The tenderer shall upload scanned copies of mandatory credentials such as experience certificates (Except Private No Individual), turn over Certificates and any other documents as applicable.

Goods & Service Tax (GST) will be recovered as per extant No instruction on the subject.

Books of reference: Tenderer should purchase a copy of the following books of Engineering department of the Railway from the office of the Principal Chief No North Eastern Railway, Engineer, Gorakhpur on payment of prescribed cost and should go through them.

CPWD, Delhi Schedule of Rate. here after called, DSR-2021 will be applicable in the No tender for rate and schedule.

Indian Railways Standard General Conditions Of Contract April 2022 with all correction slips and amendment, here after called GCC-2022

Contractor: Tenderer, whose tender is accepted by the Railway, shall thereafter by referred to as Contractor and shall mean the person / firm/co-operative society or company, whether incorporated or not, who enters into contract with the Railway and shall include his executor, No administrator, successor and permitted assignee. This tender document of the successful tenderer shall form part of agreement between the contract and contractor the railway acceptance thereof by the Railway.

Singular and Plural: Works importing singular number shall also include plural and vice versa where the context requires in this tender document and vice versa

IN CONSISTENCY BETWEEN THE DOCUMENTS:- The DSR-2021 shall be read with all correction slips issued thereto from time to time and shall form integral part of this tender document. No However, in case of any inconsistency and contradictions between the same and the special conditions and specifications laid in various chapters of this tender document, the later shall prevail.

SCOPE OF THE TENDER: Tenders have been invited in the present case for and on behalf of the President of India for the work, scope of which has been described in brief in chapter-1 of this tender document.

INSPECTION OF DATA: Drawings for the work can be seen in the office inviting this tender on any working day during working hours. The drawings are only for the guidance of tenderers. Detailed M working drawings, if required based on the drawings mentioned above, will be by given the Engineer representative from time to time

TENDERER'S POSTAL ADDRESS: Address, Email and Mobile No. of tenderer Tenderer shall state his postal and Emall address and Mobile No. fully and clearly in the Tender Form in chapter- 111 this tender communication sent in time to the No tenderer by post or email at the said address shall be deemed to have reached the tenderer duly and in time. INCOME TAX CLEARANCE CERTIFICATE Tenderer is required to produce, along with his tender, an authorized copy of latest Income Tax Clearance certificate, hereinafter referred to as ITCC, or a sworn affidavit duly countersigned by the Income-Tax Officer to the effect that he has no taxable income. Care should be taken to get all necessary information and date entered in the ITCC and no column should be left blank.

Tender without such a certificate may not be considered and, if at all considered, such certificate shall have to be produced before any payment is made. The contractor shall have no claim in regard No to non-payment in absence of such a certificate. However, instructions issued in this regard by the appropriate authority would prevail.

SALES TAX CLEARANCE CERTIFICATE Tenderer is required to produce, along with his tender, an authorized copy of latest Sales Tax Clearance Certificate, herein after referred to as STCC, issued by the appropriate Commercial Tax No Officer, Care should be taken to get all necessary information and date entered in the STCC and no column should be left blank.

The earnest money deposited with the tender of successful tenderer will be retained as part of security deposit which will be 5 percent of the value of work awarded. The balance amount of security No deposit will recovered on account bills of the work @ 6 percent till it reaches upto 5 percent of the value including earnest money
