Special Eligibility Criteria

   (A)This item is reserved to be procured from CLW approved sources only. Purchaser reserves the right to procure Bulk/regular/entire quantity from approved vendors/sources of nominated vendor/source approving agencies for the tendered item (as available on UVAM only). In case of authorized agent/dealer, tenderer must submit tender specific authorization from Approved sources/Developmental sources. (B) (i) Offers received from tenderers appearing in the Vendor list of nominated Vendor/source approving agencies for tendered item (as available on UVAM only) as 'Vendors for Developmental Orders' shall be considered eligible for Developmental Orders up to 20 percent of net procurable quantity (NPQ). (ii) It is re-iterated that Developmental Vendors are only such vendors which are listed as developmental vendors on UVAM without any condition. (Authority: Railway Board's letter no. 2021/RS(G)/779/7 Dated 09.05.2025). (C) Where there are not more than three Indian suppliers categorized as Approved Vendor for a particular item, developmental vendors can be considered for placement of bulk order without any quantity restrictions. However, while considering such vendors, factors including past performance, capacity, including past performance, capacity, delivery requirements, quantity under procurement, nature of item, outstanding order load etc. shall be considered in a transparent manner, subject to rates being reasonable. In such cases, the purchaser reserves the right to split the order quantity between one or more firms and Para 25.2 of Instruction to tenderers and General Conditions of tenders for supply contract [for indigenous tenders] shall be applicable. Such orders shall be treated as bulk orders. Indian Supplier shall be defined as follows: A supplier or bidder shall be considered to be from India if (i) the entity is incorporated in India, or ii) a majority of its shareholding or effective control of the entity is exercised from India, or iii) more than 50% of the value of the item being supplied has been added in India. (D) The status of the vendor (i.e. approved or developmental vendor) shall be reckoned as on the date of tender opening and not thereafter. However, cases of downgrading/removal/ suspension/ banning etc., after opening of tender, shall be taken into account while considering the offers. (E) The firms/tenderers who are not appearing in UVAM as Approved/Developmental Vendors of nominated vendor/source approving agencies will not be considered for ordering. However, such firms willing to participate, are advised to approach the concerned Vendor Approving agency for getting their name registered as approved/developmental vendor in the vendor directory maintained in UVAM .

   In keeping with the Public Procurement (Preference to Make in India) Order, 2017, as amended, and in terms of clause 3.2.1 to 3.2.4 of Instructions to Tenderers version 24 dated 08.12.2025, Public procurement of this item is restricted to Class - I and Class-II local suppliers only. Thus, only class-I and class-II local supplier as defined under the public procurement (preference to Make in India) Order, 2017, as amended shall be eligible to bid in this tender. Offer from vendors who do not quality to be Class - I (Local Content: minimum50%) or Class-II (Local Content: minimum 20% but less than 50%) local supplier, shall be summarily rejected and, therefore, such vendors should not participate in the tender. In case any vendor who does not qualify to be a Class - I or Class-II local supplier for the tendered item participates in the tender, such a bidder does so at its own risk and cost and Railways shall not be liable for any loss or damage caused to the bidder on this account. NOTE -: As per Public Procurement (Preference to Make in India) Order, 2017, procurements where the estimated value to be procured is less than Rs 5 lakhs shall be exempt from this Order.

I/We hereby certify that no other concerns or affiliates (such as having common partner/director/promoter/owner/ holding company decision control etc.) have participated in this tender which can give rise to a conflict of interest or fall under anti-competitive practices. We understand that the offers of all such sister concerns including ours are liable to be rejected as per relevant provisions of IRS terms and conditions. I/We, affirm that we shall abide by the Code of Integrity in general, with specific reference to conflict of interest [Para 2502 (e)], anti-competitive practices [Para 2502(c) ] and obligation to proactive disclosures [ Para 2503].    Validity of offer: -Offer shall be kept valid for acceptance for a minimum period as specified in tender schedule from the date of opening of tender. In case a tenderer quotes shorter validity period, the offer shall be considered as unresponsive and would be summarily rejected.
