(b)Financial Standing: - Financial Eligibility Criteria: The tenderer must have minimum average annual contractual turnover of 1.5 V/N crores; whereV= Advertised value of the tender in crores of Rupees N= Number of years prescribed for completion of work for which bids have been invited. The average annual contractual turnover shall be calculated as an average of "total contractual payments" in the previous three financial years, as per the audited balance sheet. However, in case balance sheet of the previous year is yet to be prepared/ audited, the audited balance sheet of the fourth previous year shall be considered for calculating average annual contractual turnover. The tenderers shall submit requisite information as per Annexure-VIB of GCC-April 2022, along with copies of Audited Balance Sheets duly certified by the Chartered Accountant/ Certificate from Chartered Accountant duly supported by Audited Balance Sheet.Bid Capacity: The tender/technical bid will be evaluated based on bid capacity formula detailed in Annexure- I.

(a)Technical Eligibility Criteria: - The tenderer must have successfully completed or substantially completed any one of the following categories of work(s) during last 07 (seven) years, ending last day of month previous to the one in which tender is invited:i.Three similar works** each costing not less than the amount equal to 30% of advertised value of the tender, orii.Two similar works** each costing not less than the amount equal to 40% of advertised value of the tender, oriii.One similar work** costing not less than the amount equal to 60% of advertised value of the tender.**Similar service contract means any contract that is so specified as per Clause 4.1 of Chapter -IV of this tender document."Work experience certificate from private individual shall not be considered. However, in addition to work experience certificates issued by any Govt. Organisation, work experience certificate issued by Public listed company having average annual turnover of Rs 500 crore and above in last 3 financial years excluding the current financial year, listed on National Stock Exchange or Bombay Stock Exchange, incorporated/registered at least 5 years prior to the date of closing of tender, shall also be considered provided the work experience certificate has been issued by a person authorized by the Public listed company to issue such certificates.In case tenderer submits work experience certificate issued by public listed company, the tenderer shall also submit along with work experience certificate, the relevant copy of work order, bill of quantities, bill wise details of payment received duly certified by Chartered Accountant, TDS certificates for all payments received and copy of final/last bill paid by company in support of above work experience certificate.

Similar Nature of work: Similar nature of work for Rehabilitation/One Time Repair & Comprehensive Annual Maintenance of "HORIBA" make Brake Dynamometer Machine for Three (03) years Installed at Brake Dynamometer Laboratory Testing Directorate, R.D.S.O., Manak Nagar, Lucknow are as following :"Supply/Repair/Rehabilitation of Inertia Brake/chassis/engine dynamometer including installation and commissioning by OEM/ Authorised representative of OEM"

Tenderer must be submitted bank details i.e. name of bank along with the branch code, account number, IFSC code , PAN number, mandate form for ECS and GSTIN registration certificate.

Earnest Money: The Tenderer is required to deposit an Earnest Money of Rs. 5602600.00 (Rupees Fifty Six Lakh Two Thousand Six Hundred only) through online modes as permitted in IREPS application.

The price to be quoted by the tenderer shall be inclusive of supply and delivery of all materials for RDSO, LUCKNOW and erection at site. All prices shall be quoted by the firm on rupees basis. Rates quoted by the tenderer shall remain valid for at least 120 days from the date of opening of the tender irrespective of Market Fluctuations.

The rates once quoted for items shall be inclusive of all taxes etc. The rates quoted must not in any circumstances be altered or erased.

The successful tenderer will have to submit full performance guarantee as per clause no. 2.11 (Chapter-II) of tender document before execution of agreement.

Tenderer are allowed to make payments against this tender towards earnest money through on payment modes available ON IREPS portal LIKE net banking, debit card, credit card etc. Manual payments through Demand draft, Banker cheque, Deposit receipts, FDR etc. are not allowed.

Security Deposit: The Security Deposit shall be 5% of the total contract value. The Bid Security (Earnest Money Deposit) submitted by the Contractor with his tender will be retained/ en- cashed by the Railways as part of security deposit for the due and faithful fulfillment of the contract by the Contractor (Please refer to clause no. 2.12 of Chapter- II of Tender Document).

Rates are inclusive of Cost of Material, Manpower, Transportation, Equipment's, Tools, Inspections, and any other cost direct or hidden not mentioned and all duties, taxes, GST and levies applicable. No extra payment will be made on this account. Railway may deduct any taxes being levied by the Government from time to time or in force from time to time. Tenderer may consider this aspect while quoting for the work.

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

The whole of the work shall be executed in conformity with the Indian Railways Standard General Condition of Contract-APRIL- 2022, with amended/corrected up to the correction slip, till the inviting date of this tender.

If the tenderer(s) deliberately gives / give wrong information in his / their tender or creates / create circumstances for the acceptance of his / their tender, the Railway reserves the right to reject such tender at any stage.

In case the date of closing mentioned in the Notice Inviting Tender is declared a holiday/band/strike etc. on any account, the date of closing tender online will not be changed as the application in the website of IREPS does not permit submission of any offer after closing date and time of the tender. However, opening of tenders online will be on any convenient day after the closing date/time of tenders.

Offer rates quoted in the form of e-tender schedule shall be final. No other documents related to offer rates shall be entertained. Tenderers are advised not to attach any document related to offer rates (except undertaking(s) asked). These documents shall be treated as NULL and void and shall not be considered for evaluation of offer.

In case of any query/ambiguity regarding terms and condition laid down in tender document uploaded herewith, the bidders may ask online query on IREPS portal at least before two day of start of bidding.

The intending tenderers are advised to study the General Conditions of Contract Regulations and Instructions for tenderers and standard forms of contract (Indian Railways Standard GCC - April "2022") as corrected from time to time and as mentioned in the special conditions attached, and make themselves conversant with their contents, as these shall govern this contract and shall form an integral part thereof, save and except where these are repugnant to the terms and conditions brought out in the tender documents. The special conditions of contract are in addition to the general condition of contract. In case of any conflict in clauses of SCC & GCC APRIL 2022 the SCC shall prevail. All those conditions which are not covered in the tender document will be governed by Indian Railways Standard GCC - April "2022"

The tenderer are advised to read the scope of work and tender conditions and also visit the site of work before quoting the rates. No post tender correspondence will be entertained to enhance the rate on above account.

Tenderers will examine the various provisions of The Central Goods and Services Tax Act, 2017(CGST)/Integrated Goods and Services Tax Act, 2017(IGST)/ Union Territory Goods and Services Tax Act,2017(UTGST)/ respective state's State Goods and Services Tax Act (SGST) also, as notified by Central/State Govt & as amended from time to time and applicable taxes before bidding. Tenderers will ensure that full benefit of Input Tax Credit (ITC) likely to be availed by them is duly considered while quoting rates.

The successful tenderer who other is liable to be registered under CGST/IGST/UTGST/SGST Act shall submit GSTIN along with other details required under CGST/IGST/UTGST/SGST Act to railway immediately after the award of contract, without which no payment shall be released to the contractor. The contractor shall be responsible for deposition of applicable GST to the concerned authority.

In case, the successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act, the railway shall deduct the applicable GST from his/their bills CGST under reverse charge mechanism (RCM) and deposit the same to the concerned authority.
