Proto-development-deployment of Acoustic Bearing Detection system (ABD) by M/s Liama Intelligence Pvt Ltd at site to be decided in consultation with Zonal Rly & Rly Board

(Para 2.9 of Chapter II of Tender Document) Bid Security (Earnest Money Deposit, or EMD): As per clause 5 (of Part-I) of IR Std GCC (April'2022), tenderer is required to submit the Bid Security with the tender for the due performance with the stipulation to keep the offer open till such date as specified in the tender, under the conditions of tender.

(Para 2.10 of Chapter II of Tender Document) Security Deposit (SD): The Security Deposit shall be 5% of the contract value, as per details mentioned under clause 16. (1) of Part-II of Indian Railways Standard GCC-April 2022 or latest if any. Refund/ forfeiture of SD are governed by GCC clauses 16. (2) & 16. (3).

Performance Guarantee (PG): The successful bidder shall submit the Performance Guarantee (PG), amounting to 5% of the original contract value in any form, as per details mentioned under clause 16.(4) of Part-II of IR Std GCC-April 2022 or latest if any.

Pl upload signing authority.(Para 1.5 of Chapter I of Tender document) Any individual signing the tender or other document connected therewith should specify whether he is signing: i. As sole proprietor of the concern or his Attorney, or ii. As a partner or partners of the firm, or iii. For the firm, or iv. As a Director, Manager or Secretary in the case of a Limited Company duly authorized by a resolution passed by the Board of Directors, in pursuance of the authority conferred by Memorandum of Association.(Para 1.6 of Chapter I of Tender document) Requisite Power of Attorney or such other documents empowering the individual or individuals to sign should be furnished to RDSO for verification, if required.

(Para 2.3 of Chapter II of Tender document) The tenderer shall quote rates to be provided on the schedule of the tender document, loaded on IREPS website as well as the sheets provided for the schedule of rates & quantities - Tender form Third Sheet (attached with the tender document). (Para 2.4 of Chapter II of Tender document) All works under this contract shall strictly follow the schedules & scope of works as have been set out in Chapter IV of the tender papers (including Annexures I-VII). The schedule of prices should be carefully and properly filled in tender document. All rates should be mentioned in words as well as in figures. Erasures and alterations in the tender papers must be avoided. If any corrections are necessary, these should be a "pen through" and all such alterations must be attested by the full signatures of the tenderers along with dates. Additional conditions or stipulations, if any, must be made in the covering letter of the tender. It should be noted that R.D.S.O. reserves the right not to consider conditional tender(s) and to reject the same without assigning any reason.

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

(Para 1.10 of preamble to tender Papers) Tenderer is required to indicate their Bank Details (like name of the bank, branch, account number, IFSC No. etc.), PAN, Mandate Form for ECS, and GSTIN registration certificate etc.

The rates once quoted for items shall be inclusive of all taxes etc. The rates quoted must not in any circumstances be altered or erased.

The rates should be inclusive of materials, equipment, vehicle, traveling, boarding, incidental and transportation, labour charges, taxes and any other expenses required for completing the work satisfactorily. Railway shall not make any separate payment against these heads, nor provide any facility unless otherwise specified in Tender Document. Tenderer shall quote all prices only in Indian Currency.

Preamble to the tender papers, instructions to the tenderers, conditions of tendering, conditions of contract, prices and payment, specifications, drawings and forms of tenders etc. included herein shall be read as part referred to as the "Tender papers". The intending tenderers are advised to study the tender papers carefully. The tenderer shall also acquaint him-self with the local conditions, nature of work and all other matters pertaining thereto. The submission of the tender shall be deemed to have been done on the basis of tender papers and after careful study and examination of the tender papers with a full understanding of the implications thereof.

(Para 2.1 of chapter II of tender document )The intending tenderers are advised to study the General Conditions of Contract (GCC) Regulations & Instructions for tenderers and standard forms of contract (Indian Railways Standard GCC - April 2022) as corrected/ amended from time to time and as mentioned in the Special Conditions of Contract (SCC) attached, and make themselves conversant with their contents, as these shall govern this contract and shall form an integral part thereof, save and except where these are repugnant to the terms and conditions brought out in the tender documents. The Special Conditions of Contract (SCC) are in addition to the GCC. In case of any conflict in clauses of SCC & GCC, the SCC shall prevail. All those conditions which are not covered in the tender document will be governed by "Indian Railways Standard GCC - April 2022", as corrected/ amended from time to time.

Tenderers will examine the various provisions of The Central Goods and Services Tax Act,2017(CGST)/Integrated Goods and Services Tax Act, 2017(IGST)/ Union Territory Goods and Services Tax Act,2017(UTGST)/ respective state's State Goods and Services Tax Act (SGST)also, as notified by Central/State Govt & as amended from time to time and applicable taxes before bidding. Tenderers will ensure that full benefit of Input Tax Credit (ITC) likely to be availed by them is duly considered while quoting rates.

(Para 1.9 of Chapter I of Tender Document) The Administration shall not be bound to accept the tender and reserves the right to accept or reject the tender, wholly or partially, at its discretion, without assigning any reason. The Administration also reserves the right to modify, reduce, or cancel the scope of work specified in the tender documents, or to request revisions from the tenderer, without incurring any liability.(Para 1.10 of Chapter I of Tender Document)The successful tenderer will be advised by fax/ formal letter of tender acceptance (LoA). No tender shall be deemed to have been accepted unless such acceptance shall have been informed in writing to the successful tenderer by RDSO.(Para 1.11 of Chapter I of Tender Document)The tenderer shall keep the offer in response to the invitation of tender open for acceptance either in part or in full or as may be modified by negotiation, by the Administration, for a period of six months from the date on which tender is opened, during which period the tenderer shall not withdraw or restrict his offer nor amend, impair or derogate their form.(Para 1.12 of Chapter I of Tender Document)The tenderer shall be deemed to have accepted as aforesaid in consideration of his tender being considered by the Administration in terms hereof, provided the same has been duly submitted and is otherwise in order. When the successful tenderer is informed in writing at his address given in the tender papers, within the said period of six months, that his tender has been accepted by the Administration either in whole or in part, he shall be bound by the terms of tender papers constituted by his tender and such acceptance thereof by the Administration, until a formal contract has been executed between him and the Administration.(Para 1.13 of Chapter I of Tender Document)No claim for rejection of Tender: The Tender, when submitted, shall not constitute an agreement and the tenderer shall have NO cause of action or claim whatsoever against RDSO for rejection of his offer. RDSO shall always be at liberty to reject or accept the offer at its own discretion and any such action will not be called into question and the tenderer shall have no claim in that regard against RDSO.The successful tenderer shall be required to execute one or more agreements as necessary with the President of India, acting through Director General/ Executive Director (Testing)/ Jt. Director (Projects)/ Testing Dte., RDSO, as the case may be, for carrying out the work, as per the agreed conditions.

(Para 1.8 of Chapter I of Tender Document) No erasure or alteration in the text of the tender paper is permitted and any such erasure and/or alteration/overwriting will either be disregarded or render the whole tender void, at the option of RDSO.

(Para 2.7 of chapter II of tender document )The tenderer shall keep the offer open up to period of 180 days from the date of closing of tender. It is understood that the tender documents have been issued to the Tenderer(s) and the Tenderer(s) is / are permitted to tender in consideration of the stipulation on his / their part that after submitting his / their tender, subject to the period being extended further, if required by mutual agreement from time to time, he will not resile from his offer or modify the terms and conditions thereof in a manner not acceptable to RDSO or should the tenderer fail to keep the offer open for entire validity of period or resile from the contract after acceptance of the tender, the aforesaid amount shall be liable to be forfeited by the Railways.

In case of any dispute that may arise concerning contract agreement or the tender, the decision of RDSO Administration [Executive Director (Testing)/ Jt. Dir (Projects)/ Testing] shall be final and binding upon the tenderer. The contractors and his men would abide by the lawful instructions conveyed to him by RDSO Administration or its supervisory officials.

(para 1.9 of preamble to tender document)The Digital Signature of the Tenderer on the e-Tender form will be considered as confirmation that the Tenderer has read, understood and accepted all the documents unless specific deviation is quoted by the Tenderer.
