Special Eligibility Criteria

   Make & Brand of offered item should be clearly mentioned in the offer. The detailed description of the offered product must also be attached by the bidder/firm. Failing this, the Bidder/firm's offer will summarily be rejected.

   The tenderer with past performance of satisfactory execution of contracts to BLW, or Other Zonal Railways/PUs for supply of the same / similar items for a quantity of 20 percent or more of tendered quantity against a single contract during last three years prior to, and excluding tender opening date may be considered as responsive to BLW requirements for placement of bulk and regular order. Tenderers are requested to submit the past performance report such as Copies of R Notes/CRAC/Proof of acceptance of material by consignee etc. along with their offer; failing which offer will be summarily rejected without making any back reference. However, in cases where the tenderers are having satisfactory past supply performances of tendered items with BLW, the supply performance data available in iMMIS with BLW shall be taken into consideration while evaluating the offers of the tenderers.

    Failure and Termination - If the Contractor fails to deliver the goods or any installment thereof within the period fixed for such delivery in the contract or as extended or at any time repudiates the contract before the expiry of such period the Purchaser may without prejudice to his other rights: - (a) recover from the Contractor as agreed liquidated damages and not by way of penalty a sum equivalent to %BD (half) per cent of the price of any goods (including elements of taxes, duties, freight, etc.) which the Contractor has failed to deliver within the period fixed for delivery in the contract for each week or part of a week during which the delivery of such goods may be in arrears where delivery thereof is accepted after expiry of the aforesaid period. Upper limit for recovery of liquated Damages in Supply Contracts will be 10 % (Ten Per cent) of value of delayed supplies irrespective of delays, unless otherwise provided, specifically in the contract, or (b) without prejudice to the Purchasers right to record adverse performance of the contractor for taking appropriate administrative action, cancel the contract or a portion thereof and forfeit the security deposit. (c) Wherever Security deposit has been exempted for any reason, levy damages from the supplier, not by way of penalty, an amount equal to Security Deposit amount, as would have been applicable had he not been an exempted vendor. These damages shall be treated as recoveries outstanding against the Contractor and dealt with accordingly,%u201D (d) In case of failure by contractor to meet deliveries for any lot, Railways may cancel the contract for defaulted part by forfeiting SD commensurate to that lot. Note- It may be noted that clauses (a), (b), (c) and (d) are applicable to regular (bulk) orders, whereas only clauses (b), (c), & (d) are applicable to in-side developmental orders up to 20% of the Net Procurement Quantity (NPQ).
