   1. OEM: The bidder must be the OEM or authorised dealer of the machine being offered. 2. ISO 9001 Certification: The OEM must have a valid ISO 9001 certificate at the time of tender closing and must submit a copy with the bid. 3. Supply History: The bidder must have supplied and successfully commissioned at least one similar machine* as defined in clause 4 below in the last Ten years, counted from the tender's closing date, to any of the end user organizations# listed below. Copies of the purchase order, commissioning certificate, or any other relevant documents that establish the supplied machine falls into the category of "similar," as defined in clause7.4 below, must be enclosed in the format at Annexure-C #List of end user organizations: i. lndian Railways ii. Central/State government enterprises iii. Central/State Public sector units iv. Private firms registered in MCA portal (https://www.mca.gov.in/) & having valid Corporate ldentification Number (ClN). a. Such private firms should have the average annual turnover, for the three completed previous financial years, reckoned from the date of closing the tender, more than 50 crores. b. The bidder must submit financial turnover details of private firms duly downloaded from MCA portal 4.    certificate for at least one such machine, supplied and successfully commissioned in the last ten years, in compliance with the requirements to clauses 3 & 4 i. This certificate must be obtained from the end user on their official letterhead, including a clear signature and address, verifying the location where the machine was installed and commissioned. The certificate must be dated within one year prior to the tender's closing\as per format enclosed at Annexure-D. ii. The machine, for which the performance certificate submitted by the bidder, should have completed at least one year working after commissioning as on date of obtaining the certificate' It should be clearly mentioned in the performance certificate that the machine has been working satisfactorilY. iii. ln case the end user category falls as defined in 3(i) or 3(ii) or 3(iii), the performance certifying authority should not be lesser than JAG grade' iv. ln case the end user category falls as defined in 3(iv), the performance certifying authority should be a responsible authority in that firm 6. ICF will independently verify the veracity of the Performance certificate, if needed. 7. All information documents required to establish the fulfillment of eligibility criteria should be submitted by the bidder in the offer itself. No correspondence / clarification shall be entertained in this regard The firms are advised to submit the performance certificate issued in the name of Tenderer along with their offer failing which the offer is liable to be rejected.

Commercial-Compliance

   It is certified that the item offered meets the local content requirement for Class-I/Class-II local supplier. Tenderers should specify Class-I or Class II in the remarks column, failing which the offer will not be considered for preference under Make in India Policy.

   (i) In case of MSE firm willing to claim the benefits under Public Procurement Policy (Preference to MSE) order 2012, the firm should upload with their offer, the proof of their being MSE registered with the agency mentioned in clause 13.1 of section-I of ICF Bid document, failing which such offers will not be liable for consideration of benefits detailed in para 13.3 of section-I of ICF Bid document. (ii) As per Gazette notification no. S.O.4926(E) dated 18.10.2022 amending notification no. S.O.2119(E) dated 26.06.2020 circulated vide Railway Board letter no. 2020/RS(G)/363/1 dated 03.11.2022 regarding re-classification of enterprises and Udyam registration, " In case of an upward change in terms of plant and machinery or equipment or turnover or both, and consequent reclassification, an enterprise shall continue to avail of all non-tax benefits of the category it was in before the re- classification, for a period of three years from the date of such upward change." In such cases, the tenderer claiming such benefits shall submit necessary documentary evidence along with offer. (iii) Tenderers shall upload Udyam Registration detail showing that the enterprise is owned by Scheduled Castes (SC)/ Scheduled Tribes (ST)/ women entrepreneurs to claim the benefit under this subclassification.

   Passing the benefits of ITC: I hereby confirm following: "We hereby declare that in quoting the above price, we have taken into account the full effect of Input Tax Credit available under GST. We, further agree to pass on any financial gain/benefit as may become available in future in respect of all the input tax credit on the date of supply by way of reduction in price and advise the purchaser accordingly. We also undertake that we are aware of the provisions of section 171 of the CGST Act and consequences thereof if we fail to comply with the same."

   Public Procurement (Preference to Make in India) policy is applicable as per Clause 16 of Section-I of ICF Bid Document. The procurement shall be done in accordance with the extant instruction of DPIIT (Department of Promotion of Industry and Internal Trade) for Make in India policy.

   It will be presumed that the firms who have submitted the e-bid have gone through and accepted all the terms and conditions of tender, until and unless firms specify the deviations from those conditions and so indicated specifically, under the headings - "Technical Deviation Statement" and "Commercial Deviation Statements". And if space available is not adequate, tenderers can upload a Statement of Deviations and a reference of uploaded deviation statement shall be given in "Technical or Commercial Deviation Statement". If there is any contradiction between any techno commercial terms and conditions quoted in e-offer and documents attached along with the e-offer, the terms & conditions quoted in e-offer will prevail over that of quoted in attached documents. Tenderers in their own interest are advised not to quote any techno commercial terms & conditions in attached documents.
