For PAC items, the offer of OEM or its authorized dealer shall only be considered. To develop new vendors for PAC items, the offer from vendors, other than in whose favour PAC is signed, if received may be considered for developmental order upto 20% of NPQ only. Any new vendor desires to supply these items may approach Principal Chief Engineer (PCE) North Central Railway/HQ, GM Office, Subedarganj-211015 to dem onstrate their capability & capacity to manufacture these items. The firm will also upload proof of demonstrations issued by gazatted officer of PCE /NCR, failing which offer will be summarily rejected.

EMD- The offers not accompanied by requisite EMD as given in para 5.0 of Instructions to tenderers & General Conditions of tenders for supply contract will be summarily rejected, unless falling in exempted category. The firm claiming exemption from EMD should clearly indicate valid reasons for such claim duly attaching a signed bid securing declaration as per ANNEXURE- 16 (Attached) of Instructions to tenderers & General Conditions of tenders for supply contract along with scanned copies of relevant documents with their e- offers. Exemption from submission of EMD by MSEs shall also be governed by para 3.0 of Instructions to tenders and General conditions of tenders for supply contact. Bidders are reminded to carefully go through Para 35.0 of Instruction to Tendereres and IRS Conditions of Contract 2025 (included and uploaded along with the bid document) those pertaining to Code of Integrity, Misdemeanour and Penal measures. If two or more bidders are found to be sister concerns or affiliates (having common partner/director/promoter/ owner/holding company decision control etc.) the offers of all such sister concerns are liable to be rejected as per relevant provisions of Tender conditions. They are therefore earnestly urged to refrain from committing violation of code of integrity in general and conflict of interest and anti-competitive practices.

Payment Terms (Indigenous Offer)
100% payment against online CRN generated through UDM issued by Gazetted Officer of the consignee along with consignee inspection certificate.
Payment Terms (Import Offer)
90% payment shall be made against irrevocable L.C on proof of inspection certificate (from the nominated inspection agency) and shipment documents within 30 days of receipt of shipping documents as specified in the contract. Balance , 10% payment shall be made within 90 days of receipt of goods in India, and on submission of Warranty Bank Guarantee and / or other documents as specified in the Contract.

Statutory Variation Clause

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Option Clause

The purchaser shall be entitled to vary the order quantity upto +30% anytime within the delivery period (including extended delivery period) on the same terms and conditions. The increase in quantity with respect to the tender quantity can be done even at the time of ordering and the tenderer shall be bound to accept the quantity so ordered on the basis of his original offer. The purchaser shall be entitled to exercise +30% option clause in one or more than one instalment as long as the total variation in quantity does not exceed the limit of 30% of ordered quantity.

Railway Standard Fall Clause

Fall Clause, as per the following, shall be applicable : (i) The price charged for the stores supplied under the Contract by the contractor shall in no event exceed the lowest price at which the contractor sells the stores or offer to sell stores of identical description to any persons/organizations including the purchaser or any Department of Central Government or any Railway Office or any Railway undertaking, as the case may be, during currency of the contract. The lower price will be applicable to supplies made after the date of coming into force of such reduction or sale or offer to sell at a reduced rate. (ii) If at any time during the said period the contractor reduces the sale price, sells or offers to sell such stores to any persons, organizations including the purchaser or any Department of Central Government or any Railway Office or any Railway Undertaking as the case may be at a price lower than the price chargeable under the contract, they shall forthwith notify such reduction or sale or offer of sale to the purchaser and the price payable under the contract for the stores supplied after the date of coming into force of such reduction or sale or offer of sale, shall stand correspondingly reduced. (iii)The Contractor shall furnish the following certificate to the concerned Accounts Officer along with each bill for payment of supplies made against the contract. "I/We certify that there has been no reduction in sale price of the stores of description identical to the stores supplied to the Government under the contract herein and such stores have not been offered / sold by me/us to any person / organization including the purchaser or any Department of Central Government or any Railway Office or any Railway Undertaking as the case may be, up to the date of bill, at a price lower than the price charged to the Government under the contract."

Standard Governing Conditions

This tender is for entering into Rate Contract (RC) with the Firm(s) to meet the requirement of this Railway for the subject item. Supply orders shall be placed by the Competent Authority in the Office of the Principal Chief Materials Manager, North Central Railway,Prayagraj (PCMM/NCR/Prayagraj). Consignees will be indicated in the Supply Order. The currency of the Rate Contract will be for a period of one year from the date of commencement of the RC. However, the currency of the contract can be extended by another 01 year with the consent of both the parties to the contract. Supply orders can be placed till last date of the currency of the Rate Contract and the Delivery Period can go beyond the said period. Railway also reserve the right to short close the RCs during the currency of the contract if the same is found to be non-advantageous.
IRS Conditions of Contract: The contract shall be governed by IRS conditions of contract 2025 and all other terms and conditions incorporated in the tender documents.
