Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka

Bidders shall ensure upload of relevant document certifying his/her status as Scheduled Caste/ Scheduled Tribe/other reserved category as prescribed in the tender document.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

For the purpose of this contract, unless the context otherwise requires: (a) Department / Employer shall mean IIIT Dharwad or the authority inviting the tender. (b) Engineer-in-Charge (EIC) shall mean the officer appointed by the Department to supervise, inspect, and certify the work. (c) Contractor shall mean the individual, firm, or company whose tender has been accepted and includes legal representatives, successors, and permitted assigns. (d) Work shall mean execution of painting and allied works as specified in the Schedule of Quantities, drawings (if any), specifications, GCC, SCC, and TCC.

The contractor shall execute the painting work in a professional manner using approved materials and skilled manpower. The scope includes surface preparation, primer application, putty work, application of finishing coats, protection of adjacent surfaces, cleaning, removal of waste, and handing over the work in complete and usable condition.

The bidder shall submit Earnest Money Deposit (EMD) equal to three percent (2%) of the estimated cost of work in the form specified in the Notice Inviting Tender. The EMD of unsuccessful bidders shall be refunded without interest after finalization of the tender. The EMD of the successful bidder shall be retained until submission of the Security Deposit.

The successful contractor shall furnish Security Deposit equal to five percent (5%) of the tendered value. The Security Deposit shall be refunded after satisfactory completion of work and expiry of the Defect Liability Period of 03 years, subject to clearance of all dues.

The successful Contractor shall furnish a Performance Security equal to five percent (5%) of the tendered value within the period specified in the Letter of Acceptance / Work Order.The Performance Security shall be submitted in the form of Bank Guarantee / Demand Draft / Fixed Deposit Receipt from a nationalized or scheduled bank, valid up to the completion of the work, unless otherwise specified in the tender documents.The Performance Security shall be forfeited, wholly or partly, in case of failure of the Contractor to fulfill contractual obligations, non-completion of work, breach of contract conditions, or abandonment of work.The Performance Security shall be released after satisfactory completion of the work, subject to clearance of all dues and liabilities to the Department.

The contractor shall commence the work within the period stipulated in the work order and shall maintain required progress to ensure timely completion. The contractor shall deploy adequate manpower and resources so that the work is completed within the stipulated time.

Extension of time may be granted by the competent authority if delay is due to reasons beyond the contractors control. Such extension shall not entitle the contractor to any extrapayment or compensation.

If the contractor fails to complete the work within the stipulated time, compensation for delay shall be levied as per KPWD norms, subject to the maximum limit specified in the tender documents.

Measurements shall be taken jointly by the contractor and the Engineer-in-Charge or his representative. Payments shall be made based on actual quantities of work executed and measured, subject to deductions as per contract provisions.

All materials shall be of approved make and quality and shall conform to KPWD specifications and relevant IS standards. The Engineer-in-Charge shall have the authority to reject any materials or workmanship not meeting the specified standards, and the contractor shall replace the same at no extra cost.

The Engineer-in-Charge or his authorized representative shall inspect the work at all stages. Any defects noticed during inspection or after completion shall be rectified by the contractor promptly and at his own cost.

The contractor shall strictly comply with all applicable labour laws, safety regulations, and statutory requirements. The Department shall not be responsible for any accident, injury, or damage arising during execution of the work.

The Engineer-in-Charge shall have the right to terminate the contract in whole or in part in case of default, slow progress, or abandonment of work, without prejudice to any other rights of the Institute.

The bidder shall have successfully executed similar painting works of the following value during the last three financial years (2022-23, 2023-24 & 2024- 2025) in Government / PSU / Autonomous Bodies / Educational Institutions / Reputed Private Organizations: One similar work costing not less than 8.00 Lakhs or Two similar works each costing not less than 6.00 Lakhs or Three similar works each costing not less than 4.00 Lakhs Similar works mean oil painting / enamel painting of buildings, steel or wooden surfaces

The bidder shall have at least three (3) years experience in execution of painting works (i.e., from 2022 or earlier). The bidder shall have a registered office in India and shall have executed painting work(s) within the State of Karnataka.
