Eligibility Criteria

Tenders from Joint ventures are not acceptable.

Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka

Any individual/ reputed company registered as KPWD Class-II and above contractor are eligible to apply and certificate issued by respective department in this regard shall be furnished.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

The bidder is required to ensure browser compatibility of the computer well in advance to the last date and time for receipt of tenders. The departments shall not be responsible for non-accessibility of e-procurement portal due to internet connectivity issues and technical glitches at bidders end.

The original documents should be produced for verification at any stage of tender process as and when sought for, failing which, the bids are liable for disqualification

Rates shall be quoted in price schedule in the website itself.

The tender shall be valid for 180 days from the date of submission of bid.

The tender document is part and parcel of the agreement

Conditional tenders are liable for rejection.

The Bidder shall comply all the GST requirements.

The contractor shall quote his rates inclusive of PF as per the applicable rate as issued by the PF department from time to time.

The bidder shall register himself under section 7 and their worker who will be engaged for the work under section 12 of the building and other construction workers act 1996. If not the successful bidder may do so immediately before award of work.

The successful bidder shall give an undertaking that they would abide by the provisions of the Employees Provident Fund Act.

The bidder shall obtain insurance coverage for all the workers deployed for this work.

The bidder shall quote his rates exclusive of GST but inclusive of all other applicable taxes, levies, duties and Building Workers Welfare Cess at 1% etc., as per the latest GoK and GoI at prevailing rates as on last date of receipt of tender.

KPCL shall recover the Income Tax, building workers welfare cess, at the prevailing applicable rates.

The bidder should take into account the prevailing royalty charges while quoting their rates and shall be deducted from the work bills. The successful bidder shall strictly adhere to Rule 36 & 42 of Karnataka Mineral Concession Rules 1994 & its amendments thereof.

If the successful bidder/agency fails to furnish documents related to remittance of royalty charges for Coarse aggregate, Fine aggregate, murrum etc., as per Rule 44(4) of Karnataka Mineral Concession (amendment) Rules 2016, following penalty will be recovered from the work bills. A penalty of 5 times the royalty amount or A penalty of 1500 per ton for building stone and 3000 per ton for sand as per Schedule IC in addition to royalty charges. A penalty of 30 percentage of total royalty amount and the same will be transferred to District Mineral Foundation Trust as per rule 36(A).

The bidder should maintain register of workers deployed and wages paid for the workers and shall produce the documents whenever called for by the competent authority. Remittance towards PF shall be commensurate with the labour component of the work involved.

Bidder should have independent PF code.The bidder shall remit PF of labourers to Contractors permanent PF code number only and not to the KPCL PF sub code

In case the dates notified above declared as holiday, the immediate next working day will be reckoned.

If the Bidder makes any alterations in the conditions of the contract or puts any condition of his own, such tenders are liable for rejection.

Any variation in labour wages made by the Government from time to time shall be borne by the agency. Any claim towards this variation will not be entertained by KPCL.

In case of death of a contractor after executing the agreement/commencement of the work, his legal heir (to be intimated at the time of execution of agreement by the successful contractor), if any eligible registered contractor and willing, can execute and complete the work at the accepted tender rates irrespective of the cost of the work after obtaining approval from competent

The successful tenderer shall furnish a Contract performance guarantee (CPG)/Security deposit (SD) equivalent to 5% of the contract price plus additional security deposit for unbalanced tender (amount put to tender minus quoted amount) if any in the form of e-BG from any Nationalized/scheduled bank acceptable to the Corporation in the prescribed format within 20 days of receipt of acceptance letter from KPCL. Contract performance guarantee (CPG)/Security deposit (SD) should be valid for 30 days after the date of completion of defect liability period and Additional Security Deposit (ASD) shall remain valid until the satisfactory completion of work or till the final bill is passed.

And shall execute the agreement within scheduled time, failing which will attract penalty.

The work completion period is 4 Months (Including monsoon) and the defect liability period is twelve (12) months from the actual date of completion of the work.

KPCL/Tender inviting authority reserves the right to reject/cancel the tender without assigning reason to bidders at any stage. KPCL/tender inviting authority is not liable for costs incurred by bidders due to cancellation.

The intending eligible bidders should have satisfactorily completed (atleast 90 percentageof the contract value) as a prime contractor in single work of similar nature of work or any civil construction work of value not less than Rupees 134.94 Lakhs (Excluding GST) in any one of the preceding five financial years.In proof of the same the work done certificate issued by an officer not below the rank of Chief Engineer in case of KPCL/RPCL works and not below the rank of Executive Engineer/Competent Authority in case of State/Central Government/Government under taking/Public Sector Undertaking shall be uploaded (Weightage of 10 percentage per year will be given to the cost of completed works of previous years to bring them to the price level of present financial year i.e 2026-27)

The intending eligible bidders should have achieved at least in two financial years a minimum financial turnover of Rupees 539.740 Lakhs (excluding GST) in the preceding five financial years. In proof of the same, intended eligible bidders shall upload the certified copy of Turnover or Profit and Loss account certificate duly certified by the Chartered Accountant with Valid UDIN. (Weightage of 10% per year will be given to the cost of completed works of previous years to bring them to the price level of present financial year i.e, 2026-27).
