Special Eligibility Criteria

   The Railway reserves the right to place orders for entire or bulk quantity on OEM/Authorized Dealer/Sub dealer. Authorized dealer of OEM must submit valid and tender specific authorisation certificate from their OEM along with their offer. Offer of Sub dealer may be considered with the terms and conditions as described in Paras below. (a) Sub-dealer will have to submit following letter/undertaking along with their offer (In absence of these letter/undertaking, offer may be rejected): (i) Copy of Authorization letter/attested certificate issued by authorized dealer regarding sub-dealership and confirmation that they (authorized dealer) will take the responsibility of genuineness and warranty of spare (of particular brand, spare part description and part number) supplied by the sub- dealer to Indian Railways. (ii) Undertaking by the sub-dealer that "Documentary evidence of genuineness of spares i.e. genuine purchase slip/certificate from the OEM/authorized dealer along with the original manufacturers test certificates & warranty certificates shall be submitted at the time of delivery to consignee and in case of any case of any false information furnished by us railways may impose any penalty/debar/blacklist our firm for future tender(s). (iii) Dealers/distributors appointing any person/firm as sub dealer shall be authorized for such appointment by OEM of the product and undertaking/certificate from OEM should also be submitted that the distributor/dealer is authorizes to issue sub-dealership certificate on or before the date of closing of tender.

   THIS TENDER COMPLIES WITH PUBLIC PROCUREMENT (PREFERENCE TO MAKE IN INDIA), Order 2017-revision regarding issued by Ministry of Commerce and Industry order No. P. 45021/2/2017-PP (BE-Il) dtd. 16.09.2020. Tender must furnish information giving the percentage of local content.

[2] In case of Authorized Dealer, bidder has uploaded Tender specific Authorization Certificate along with offer. [3] Bidder has deposited required EMD amount as applicable as the case may be. [4] In case of micro and small enterprises, firm has submitted Udyam Registration Number as per public procurement policy. [5]The bidder has uploaded document like copies of Receipt Notes, Inspection Certificates etc. in support for their performance/Credentials as the case may be.

Commercial-Compliance

   GST: [1] All the bidders/tenderers should ensure that they are GST compliant and their quoted tax structure/rates are as per GST Law. [2] In case the successful tenderer does not have valid GST registration. Then the railway shall deduct the applicable GST from his/their bills under reverse charge mechanism [RCM] and deposit the same to the concerned tax authority. [3] The offers shall be evaluated based on the GST rate as quoted by each bidder and same will be used for determining the inter se ranking. While submitting offer, it shall be the responsibility of the bidder to ensure that they quote correct GST rate and HSN number. [4] Wherever the successful bidder invoices the goods at GST rate or HSN number which is different from that incorporated in the purchase order, payment shall be made as per GST rate which is lower of the GST rate incorporated in the purchase order or billed. [5] Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate if quoted by the bidder. [6] Any amendment to GST rate or HSN number in the contract shall be as per the contractual conditions and statutory amendments in the quoted GST rate and HSN number, under SVC. For details please refer to clause 26.0, Section - 2 of General Tender Conditions.

   Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

   Validity of Offer: No deviation from the offer validity period stipulated in the tender is permitted. Firm will have to submit quotation with a validity for a minimum period of 90 [ninety] days.
