Railway reserves the right to place Bulk or Full order on firm who has successfully supplied the tendered / similar/ item to any Indian Railway production unit or Zonal Railways, either through single or multiple Purchase orders, in the last three financial years and the current financial year up to the tender closing date. Firm must attach documentary evidence of their successful supply performance along with offer, including copies of PO Copy, Receipt Notes, Inspection Certificates, and Completion Reports, etc., along with their offer, failing which the offer will may be rejected.

Only tendered item will be accepted.

I/We engage to supply the Western Railway with the articles specified above upon the terms of the Indian Railway Standard Conditions of Contract (latest revision) and upon the terms of the Revised Special Conditions and Instructions for the Guidance of the Contractors issued by the Western Railway S/137/F Revised May 2011 Amendment No. 12 of Aug, 2018.

Warranty as per IRS conditions or specified in tender conditions, whichever is more.

VALIDITY : Tenderers to quote minimum 90 days validity of offers.

LD Clause: Recovery of Liquidated Damage (LD) shall be levied @1/2% (half percent) of the price of store per week or part of the week during which delivery is accepted and the upper limit for recovery of Liquidated Damages in supply contract is 10% (ten percent) of the value of contract irrespective of delays, unless otherwise provided, specifically in the contract.

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

1) Inspection by CONSIGNEE.

Firm to note that single use plastic should not be used in packing, if material to be supplied otherwise it will be rejected. Collection of non- biodegradables old waste after successful delivery of the product/material from consignee place will be arranged by the supplier.

MSE Clause: Please indicate whether you are a micro or small enterprise (MSE) with UDYAM certificate. Please also indicate whether the enterprise is owned by SC/ST or women. Bidder is required to submit UDYAM certificate. The 25% of quantity shall be considered for award to MSE's including quantity for women owned MSE's and SC/ST owned MSE's as per extant rules.The benefit of MSE policy shall not be considered if valid UDYAM certificate and documents are not uploaded.Classification of Enterprise as small,micro or medium enterprise shall only be considered on the basis of UDYAM certificate.

1) Firm must quote FOR destination rates, movement by road only, clearly indicating transport charges. Tenderers not accepting these terms are likely to be passed over without any further reference to the firm. Transit risk will be to contractors account. 2) Road Delivery:- In case of Road delivery, the date of delivery at destination (Consignee end) shall only be treated as delivery date irrespective of F.O.R./F.O.T. condition mentioned elsewhere in the contract/tender.

The successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act, The railway shall deduct the applicable GST from his/their bills under reverse case charge mechanism (RCM) and deposit the same to the concerned tax authority.

Tenderer should submit an undertaking that he will pay GST collected from Successful Railway within due date and upload the payment details in GSTIN to enable railway (purchaser) to obtain input tax credit.

Warranty/Gurantee: As per Specification is applicable.

On submission of the tender in IREPS it shall be considered that the firm has signed the following declaration: I/We certify that my/our offer is eligible for exemption from submission of bid security/Earnest Money Deposit, in terms of the tender conditions. In case my/our claim to Exemption from submission of bid security /Earnest Money Deposit is not found valid as per terms of the tender, I/We understand and accept that Railways has unquestionable right to summarily reject my bid and my offer shall not be considered for ordering. Further, I/we hereby understand and accept that if I/we withdraw or modify my/our bids during the period of validity, or if I/we are awarded the contract and on being called upon to submit the performance security/ Security Deposit, fail to submit the performance security/ Security Deposit before the deadline defined in the request for bid document/ Notice Inviting Tender, I/we shall be debarred from exemption of submitting Bid Security/ Earnest Money Deposit and performance security/ Security Deposit for a period of 6 (six) months, from the date I/ we are declared disqualified from exemption from submission of EMD/SD, for all tenders for procurement of goods issued by any unit of Indian Railways published during this period. The offer will be summarily rejected if there is any deviation or non acceptance of this declaration is given anywhere in offer by tenderer. There shall be no exemption to such bidders from submitting EMD and SD for all tenders published during the period of time they are so disqualified as per the declaration signed by them. 6.0 Para 5.0 above shall not be applicable for Govt. departments/ordnance factories/ other Railways/ Railway PSUs/ KVIC/ACASH and matter shall be taken up with them departmentally/administratively.

All the bidders/Tenderes should ensure that they are GST compliance and their quoted Tax structure/Rates are as per GST Law.

1) Firms must quote as per Tender Description/ Drawing/ Make-brand as applicable failing to which their offer will not be considered. 2) Firms must submit their GST no. and HSN code of the item offered by them. 3) Collection of non-biodegradable solid waste after successful delivery of the product/material from consignee place will be arranged by the supplier.
