Eligibility Criteria

Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka

The intending bidder should furnish the copy of the certificate of registration issued by state/ central Govt.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

The Intending bidder are advised to visit the site of work and also access the tender documents well in advance.

Conditional tenders will not be accepted.

The tenderer shall bear all costs associated with the preparation and submission of his tender, and the employer will in no case be responsible and liable for those costs.

The TENDER PROCEESING FEE will not be refunded.

The employer is not responsible for any delay in accessing Karnataka Public Procurement Portal Portal.

The requisite Earnest Money Deposit (EMD) Through ONLINE only With validity of 225 days from the date of opening of the tender. The tender schedule will be issued to the applicants who make payment through ONLINE only. Tenders received without valid EMD through e- payment will be rejected.

All the formats prescribed in the bid document shall be filled by the bidders in a complete manner. Incomplete formats may constitute sufficient reason at the discretion of CNNL for rejection of the bid.

All scanned documents to be uploaded shall be in original and the Executive Engineer will verify the original documents at any stage before recommending for approval. Bidders should produce their original documents for verification during office hours related to uploaded documents in e-portal within 3 days of opening of technical Bid.

Further particulars, if any, required by the bidders can be had from the office of the Executive Engineer, Executive Engineer, No.7 HLBC Division, Nagamangala during office hours on all working days. It may be noted that if any of the calendar of any event mentioned above happen to be General Holiday / Declared holiday, the next working day will hold good for the respective events.

Defect liability period is FIVE YEARS from the date of completion of the entire work, after issuing of work completion certificate from CNNL.

Operation and maintenance period is FIVE YEARS from the date of completion of the entire work, after issuing of work completion certificate from CNNL.

The bid validity will be 180 days from last date of receipt of tenders.

The Tenderer should furnish the Name of the individual / firm/ Company with address and telephone number with place of registration, year of incorporation etc.

The application made by the firm / company shall be signed by a person holding the power of attorney, in which case the Tenderer should furnish a copy of power of attorney shall be submitted.

The scanned signature of the bidders / authorized representatives of the bidders shall be attached while uploading the Bid document.

Necessary certificates should be signed by an officer not below the rank of the Executive Engineer or equivalent competent authority and should be countersigned by the superior officer not below the rank of Superintending Engineer or equivalent competent authority.

The intending Bidder/firm/company should furnish list of man power available with him for taking up above work.

The intending Bidder/firm/company shall provide accurate information on the related form about any litigation or Arbitration resulting from contracts completed or on going under its execution over the last five years. The consisting history of awards against the tenderer may result in failure of the application.

Tenderer should furnish a copy of the Income Tax Return for the preceding five financial year (2021-22 to 2025-26)

The intending Bidder/firm/company shall provide the audited balance sheets or other financial statements acceptable to the employer for the last five years (2021-22 to 2025-26) and must demonstrate the current soundness of the applicant s financial position and indicate its prospective long term profitability. If deemed necessary the employer shall have the authority to make enquiries with the applicants bankers.

The Tenderer should furnish a valid copy of GST Registration Certificate.

Employees provident fund registration certificate along with copy of recent paid challan is to be furnished.

Employees Provident fund Registration Certificate.a) In respect of Contractors who are not registered with the EPF (Employees Provident Fund) authorities,the contractors should produce an undertaking that he shall within 7 days of the close of every month submit to the Executive Engineer, Executive Engineer, No.7 HLBC Division, Nagamangala, a statement showing the recoveries of contributions in respect of employees employed are through in and shall also furnish under the provision of the scheme to the commissioner, EPF b) However, having given an undertaking to this effect if the contractor does not furnish the information, the Nigama will deduct the necessary amount from the amount due from the contractor. Notwithstanding the above, the contractor will be liable for any consequential penalty /damages levied by the EPF authorities.

The intending bidders are advised to visit the site of work before attending the pre- bid meeting and also before submitting the tenders.

Royalty Recovery from the contractors bill will be made as per Government Circular CI 81/MMN 2014 Bangalore Dt: 05-03-2014 & Circular from the office of Director Mines & Geology Department Dt: 13-03-2014 & Circular from the office of Director Mines & Geology Department Dt: 06.09.2018 & Circular from the office of Director Mines & Geology Department Dt: 12.12.2019 further any Orders/Circulars issued by Government of Karnataka from time to time.

The rates quoted by the contractor must be inclusive of all Taxes, etc., (Excluding GST). The contractor is also required to pay quarry Fees, Royalties, Octroi Dues levied by the state Government or any Local body or an authority and ground rent, if any, charged by the Executive Engineer for stacking materials.No Extra Payment on this account will be made to the contractor.

Applicable GST will be paid separately & GST will be deducted as per the prevailing Govt. orders from time to time.

Increase in GST shall not be paid in extended period of contract for which the contractor alone is responsible for delay as determined by the authority while granting the extension of time.

Materials like steel, cement etc., required for the work shall be procured by the Contractor themselves and should get the same tested by the quality control authority of CNNL before use in this work.

The work includes all lead and lift / delift and work shall be carried out as per instruction of engineer-in-charge of the work. And all the specification as per Indian road congress and all relevant Indian codes. The rate for the specifications in the Schedule-B includes all lead and lift, irrespective of distance and height.

The contractor should establish his own laboratory at site and he should co-operate with both quality control, authorities and cnnl officials.

Performance security-Within 20 days of receipt of the letter of acceptance, successful tenderer shall deliver to the employer a security deposit in any of the forms given below for an amount equivalent to 5.00% of the contract price plus additional security for unbalanced tenders (If quoted below) in accordance with the clause 25. 5 of ITT and clause 43 of the conditions of the contract.Cash/ Bankers cheque/ Demand draft/ Payorder/ Bank Guarantee in favour of Executive Engineer, Executive Engineer, No.7 HLBC Division, Nagamangala payable at Nagamangala or specified small saving instruments pledged to Executive Engineer, No.7 HLBC Division, Nagamangala.

Security Deposit Will be withheld till the expiry of the defect liability period.

Building and other construction workers welfare cess: The contractor shall subscribe 1.00% of gross amount of each bill payable to him in respect of contract to the building and other construction workers welfare cess as per GO No: LD 300 LET 2006, Bangalore, dated: 18-01-2007. The amount of subscription will be recovered out of payable amount to him in each bill. This component is deemed to have been included in the quoted rate / Item rate.

The contractors should adhere to the accepted action plan submitted by him under any circumstances without linking to the pending payment of the work.

Tendering by the joint venture will not be entertained.

Sub leasing /subcontracting in any form is prohibited. Bids of bidders with track record of Sub leasing/subcontracting are liable for rejection

On account of restrictions on sand mining and scarcity of availability of sand, as an alternative the use of manufactured sand (M-sand) confirming to relevant IS specifications may be allowed during the execution of work.

Successful Bidder should submit the PERT Chart at the time of Execution of Agreement.

Idle charges for men & machineries for non-progress period delayed due to any reasons will not be paid.

As per FD GO dated 26.03.2019, NSIC exemption for EMD is not accepted.

Even though the Tenderers meet the above criteria they are subject to be disqualified if they have a)Made misleading or false representation in the forms, statements and attachments submitted in proof of the qualification requirements and b)Record of poor performance such as abandoning the works, not properly completing the contract inordinate delays in completion,litigation history or financial failure etc) c)Participated in the previous tender for the same work and had quoted unreasonably high tender prices and could not furnish rational justification) if the contractor is involved in multiple projects, the value of ongoing works is subtracted from his bid capacity. Since his assets will be engaged with other works also,Not disclosing the ongoing works, contractor is involved in amounts to misrepresentations of facts.Hence fraudulent practice under clause-113 of KPWD code.

CNNL reserves the right of rejecting all or any of the tenders without assigning any reasons.

Design and drawing pertaining to the work should be got approved by the competent authority of CNNL before execution of work.

Successful bidder should execute work agreement within 20 days from the date of issue of Letter of acceptance, failing which his tender will be cancelled on Risk & Cost basis & his EMD will beforfeited.

The contractor should have capacity of deploying centralized batching plant along with the transit mixture during execution of concrete works for both structures and lining.

The rates includes all leads and lifts and work shall be carried out as per the instruction of Engineer-in-charge .All specifications are as per relevant IS codes in vogue and Indian Road Congress. The rates for the specification in the Schedule-B includes all lead and Lifts irrespective of the distance and height,no extra claim will be entertained for additional lead and lifts.

The quarries considered are for the estimate purpose only. The intending bidders shall visit the site, identify the quarries, ascertain availability for the quantity and quality of the materials required for the work and shall quote his rates accordingly. No extra claim whatsoever will be entertained in this regard.

The contactor should obtain the material dispatch permit for stone, aggregates, sand and murrum etc. will be used in the construction work from the mines and geology department at the time of execution and same should be submitted along with the work bill, then for such work bills no royalty will be deducted. if the contractor failed to submit the material dispatch permit(MDP) along with the work bill five times royalty will be deducted from work bill as per KMMCR 2016 amendment 44(4) and circular vide no.Ga.bhu.E/DCB/TAKTE/2019-20/4497 dated-12.12.19 by mines and geology department

Typo-graphical errors if any will not be the ground for any claims by the contractor.

The undersigned reserves the right to either postpone or to cancel the entire process of tender.

The requisite Earnest Money Deposit (EMD of one Lakh shall be paid through online KPPP and the balance shall be through Bank Guarantee of Scheduled Commercial Bank and canned copy of the same shall be uploaded in the KPPP) With validity from the date of opening of the tender. CNNL Shall engage third party consultants / PMC for quality control assessment as per G.O No.FD 55 Pro.Cell 2004, Bangalore dated17,02,2002, apart from the CNNL quality control and field tests, the contractor should co-operate with both Quality control authorities and the third party.

The bidder shall pay contract management module processing fees of 0.025% of the contract value(minimum Rs.500 and Maximum Rs.7500) soon after contract has been issued to bidder.

Technical Criteria

Past Experience

The intending bidder/firm/company should have satisfactorily completed (90% of the contract value individually executed) as a prime contractor, at least one similar work like Lift irrigation/drinking water Scheme of value not less than (50 % of the amount put to tender) i.e. not less than Rs: 2551.75 Lakhs during the last five financial years from 2021-22 to 2025-26. The certificates should be obtained from the competent authority that is not below the rank of the Executive Engineer or equivalent rank officer, & should be countersigned by the Superintending Engineer or equivalent rank officer.(The cost of completed works of previous years will be given a weightage of 10% per year based to bring them to 2026-27 level rupee price value).

The intending bidder should furnish the KPWD Class I Contractor certificate of registration issued by State/Central govt. organization.

The intending bidder/firm/company should furnish the details of (50% ownership/50% lease) Machinery/Equipments like RC FC Lease Agreement etc., (Current year) as mentioned below of the following minimum requirement of machineries for each of the above said works. 1). Hydraulic Excavator-04 Nos. (02 Nos own and 02 Nos, lease) 2).CC mixer-04 Nos. (2 Nos. own and 2 Nos. Lease) 3). Tipper-04 Nos (2 No. own and 2 Nos. Lease) 4.Crane-20MT capacity-02 Nos (1 No. own and 1 No. Lease)

List of key Technical personnel required by the Tenderer who are suitable for both design and execution of work and number of technical personnel who will be deployed EXCLUSIVELY for these works with at least 1 Nos Project manager (BE civil with minimum 5 years experience), 2 Nos. B.E.(Civil Engineer with degree certificate with minimum 5 years experience ) and 2 Nos. Diploma (Civil Engineer with minimum 5 years experience )

Tenderers will only be qualified, if their available tender capacity is more than the total tender value. The available tender capacity will be calculated as under: Assessed available tender capacity:-(AxNx1.5-B) where, A-Maximum value of civil engineering works executed in any one year during the last five years (updated to 2026-27 price level) taking into account the completed as well as works in progress. N- Number of years prescribed for completion of the works for which tenders are invited. B-Value, at 2026-27 price level, of existing commitments and on-going works to be completed during the next 18 months(period of completion of the works for which Tenders are invited).
