Financial Eligibility Criteria: The tenderer must have minimum averageannual contractual turnover of V/N or 'V' whichever is less; where V=Advertised value of the tender in crores of Rupees N= Number of yearsprescribed for completion of work for which bids have been invited. Theaverage annual contractual turnover shall be calculated as an average of"total contractual payments" in the previous three financial years, as perthe audited balance sheet. However, in case balance sheet of theprevious year is yet to be prepared/ audited, the audited balance sheetof the fourth previous year shall be considered for calculating averageannual contractual turnover
The tenderers shall submit requisite information as per Annexure- VIB,along with copies of Audited Balance Sheets duly certified by theChartered Accountant/ Certificate from Chartered Accountant dulysupported by Audited Balance Sheet.
In case of newly formed partnership firm, the credentials of individualpartners from previous propriety firm(s) or dissolved previouspartnership firm(s) or split previous partnership firm(s), shall beconsidered only to the extent of their share in previous entity on the dateof dissolution / split and their share in newly formed partnership firm. Forexample, a partner A had 30% share in previous entity and his share inpresent partnership firm is 20%. In the present tender underconsideration, the credentials of partner A will be considered to theextent of 0.3*0.2*value of the work done in the previous entity. For thispurpose, the tenderer shall submit along with his bid all the relevantdocuments which include copy of previous partnership deed(s),dissolution deed(s) and proof of surrender of PAN No.(s) in case ofdissolution of partnership firm(s) etc.
n case of existing partnership firm, if any one or more partners quit thepartnership firm, the credentials of remaining partnership firm shall bere-worked out i.e., the quitting partner(s) shall take away his credentialsto the extent of his share on the date of quitting the partnership firm(e.g.in a partnership firm of partners A, B & C having share 30%, 30% & 40%respectively and credentials of Rs 10 crore; in case partner C quits thefirm, the credentials of this partnership firm shall remain as Rs 6 crore).For this purpose, the tenderer shall submit along with his bid all therelevant documents which include copy of previous partnership deed(s),dissolution deed(s) and proof of surrender of PAN No.(s) in case ofdissolution of partnership firm(s) etc
In case of existing partnership firm if any new partner(s) joins the firmwithout any modification in the name and PAN/TAN no. of the firm, thecredentials of partnership firm shall get enhanced to the extent ofcredentials of newly added partner(s) on the same principles asmentioned in item 6 above. For this purpose, the tenderer shall submitalong with his bid all the relevant documents which include copy ofprevious partnership deeds, dissolution/splitting deeds and proof ofsurrender of PAN No.(s) in case of dissolution of partnership firm etc.
echnical Eligibility Criteria: (a)The tenderer must have successfullycompleted or substantially completed any one of the following categoriesof work(s) during last 07 (seven) years, ending last day of monthprevious to the one in which tender is invited: (i)Three similar works eachcosting not less than the amount equal to 30% of advertised value of thetender, or (ii)Two similar works each costing not less than the amountequal to 40% of advertised value of the tender, or (iii)One similar workcosting not less than the amount equal to 60% of advertised value of thetender (b) (1)In case of tenders for composite works(e.g. works involvingmore than one distinct component, such as Civil Engineering works, S&Tworks, Electrical works, OHE works etc. and in the case of major bridges -substructure, superstructure etc.), tenderer must have successfullycompleted or substantially completed any one of the following categoriesof work(s) during last 07 (seven) years, ending last day of monthprevious to the one in which tender is invited: (i)Three similar works eachcosting not less than the amount equal to 30% of advertised value ofeach component of tender, or (ii)Two similar works each costing not lessthan the amount equal to 40% of advertised value of each component oftender, or (iii)One similar work each costing not less than the amountequal to 60% of advertised value of each component of tender. Note forb(1): Separate completed works of minimum required values shall alsobe considered for fulfillment of technical eligibility criteria for differentcomponents. (b)(2)In such cases, what constitutes a component in acomposite work shall be clearly pre- defined with estimated tender cost ofit, as part of the tender documents without any ambiguity. (b) (3) Toevaluate the technical eligibility of tenderer, only components of work asstipulated in tender documents for evaluation of technical eligibility, shallbe considered. The scope of work covered in other remainingcomponents shall be either executed by tenderer himself if he has workexperience as mentioned in clause 7 of the Standard General Conditionsof Contractor through subcontractor fulfilling the requirements as perclause 7 of the Standard General Conditions of Contract or jointly i.e.,partly himself and remaining through subcontractor, with prior approvalof Chief Engineer in writing. However, if required in tender documents byway of Special Conditions, a formal agreement duly notarized, legallyenforceable in the court of law, shall be executed by the main contractorwith the subcontractor for the component(s) of work proposed to beexecuted by the subcontractor(s), and shall be submitted along with theoffer for considering subletting of that scope of work towards fulfilmentof technical eligibility. Such subcontractor must fulfill technical eligibilitycriteria as follows: The subcontractor shall have successfully completedat least one work similar to work proposed for subcontract, costing notless than 35% value of work to be Sublette, in last 5 years, ending lastday of month previous to the one in which tender is invited through aworks contract. Note: for subletting of work costing up to Rs 50 lakh, noprevious work experience of subcontractor shall be asked for by the Railway
Work experience certificate from private individual shall not beconsidered. However, in addition to work experience certificates issuedby any Govt. Organization, work experience certificate issued by Publiclisted company having average annual turnover of Rs 500 crore andabove in last 3 financial years excluding the current financial year, listedon National Stock Exchange or Bombay Stock Exchange, incorporated /registered at least 5 years prior to the date of closing of tender, shallalso be considered provided the work experience certificate has beenissued by a person authorized by the Public listed company to issue suchcertificates. In case tenderer submits work experience certificate issuedby public listed company, the tenderer shall also submit along with workexperience certificate, the relevant copy of work order, bill of quantities,bill wise details of payment received duly certified by CharteredAccountant, TDS certificates for all payments received and copy offinal/last bill paid by company in support of above work experiencecertificate.
Para 1.2 & its sub para of standard financial criteria are also applicableduring evaluation of technical credential of partnership firm
Definition of Similar Work :- 'Any type of civil work viz building and structure work, pipe line, under ground and overhead tanks,foundation treatment works in any Railway embankment /cutting, anyearth work, cover over platform, bore wells, level crossing worksincluding lifting barriers, cement concrete apron works'.

As per this check list mentioned in the following sub- para;Documents in prescribed format as per applicability shall besubmitted duly filled & signed by the Tenderer. Non submissionof these documents shall be led to summarily rejection of Bid.
Work Completion Certificate shall be submitted in reference topara 10.1 of Tender Form Second Sheet of ITT

The original Bank Guarantee if any should be delivered in personto the official nominated i.e. Inward/outward Section beforeclosing date for submission of bids (i.e. excluding the last date ofsubmission of bids). Bank Guarantee Bond shall be issued fromany scheduled commercial bank of India on non-judicial stamppaper as per The Stamp Act of the concerned State & should bein the name of the Executing Bank.
In case of other than Company/Proprietary firm, Annexure - V(A)shall also be submitted by each member of a Partnership Firm /Joint Venture (JV) / Hindu Undivided Family (HUF) / LimitedLiability Partnership (LLP) etc. as the case may be.
Tender Form (First Sheet) in Standard format shall be uploadedby the tenderer. The tender form shall be purchased andsubmitted only in the name of the JV and not in the name of anyconstituent member.
The tenderer shall clearly specify whether the tender issubmitted on his own (Proprietary Firm) or on behalf of aPartnership Firm / Company / Registered Society / RegisteredTrust / Hindu Undivided Family (HUF) / Limited LiabilityPartnership (LLP) etc. The tenderer(s) shall enclose the attestedcopies of the constitution of their concern, and copy of PAN Cardalong with their tender. Tender Documents in such cases are tobe signed by such persons as may be legally competent to signthem on behalf of the firm, company, association, trust orsociety, as the case may be. Tenderer should submit Particularsof the Tenderer such as Name of the Firm, Constitution of thefirm (Proprietary/Partnership firm/ LLP/Company/HUF/Societyetc.), Name of Owner, Office Address, Phone No; email address,Key Person Name & Phone No; etc. along with the bid. If it isNOT mentioned in the submitted tender that tender is beingsubmitted on behalf of a Sole Proprietorship firm / Partnershipfirm / Joint Venture / Registered Company etc., then the tendershall be treated as having been submitted by the individual whohas signed the tender. After opening of the tender, anydocument pertaining to the constitution of Sole ProprietorshipFirm / Partnership Firm / Registered Company/ Registered Trust /Registered Society / HUF/LLP etc. shall be neither asked norconsidered, if submitted. Further, no suo moto cognizance of anydocument available in public domain (i.e., on internet etc.) or inRailway's record/office files etc. will be taken for consideration ofthe tender, if no such mention is available in tender offersubmitted.
All constitutional concern documents in Standard Format shall beuploaded by the Tenderer in reference to Para 14. ii. (a to g)17.14.1 to 5 & 18 of Tender Form Second Sheet of ITT as perapplicability.
Dully witnessed POA (executed on non-judicial stamp paper ofappropriate value as per Stamp Act of state concerned) shall beuploaded as per provision of POA act as per applicability.
Resolution of Board of Directors shall be signed by TwoDirectors/as per provision mentioned in AOA of the Companyunder provisions of Company Act with Company Seal & attorneyto be issued as per decision made in board meeting. If anychanges in constitution of Company/Partnership firm occurred,all related documents with Company Data muster/Supplementary deed in case of Partnership Firm shall besubmitted by bidder. Resolution of Board of Directors shall besigned by Two Directors/as per provision mentioned in AOA ofthe Company under provisions of Company Act with CompanySeal & attorney to be issued as per decision made in boardmeeting. If any changes in constitution of Company/Partnershipfirm occurred, all related documents with Company Datamuster/ Supplementary deed in case of Partnership Firm shall besubmitted by bidder
The facility for online verification of Bank Guarantees(BGs)through the Structural Financial Messaging system (SFMS) hasbeen enabled. Kindly refer to the Railway Board's letter(2020/ACII/9/6/e dated 07.04.2022) details as prescribed intender documents as well as the above cited Board letter mustbe incorporated into the SFMS while issuing Bank Guarantees byvendors/contractors in favour of the railway. It is mandatory ifsubmission of BG be in form of security deposit (duringtendering) as well as performance guarantees (after award ofwork).
For tenders having advertised value more than Rs 10 crore (ACS11 Dated 13.03.2026) wherein eligibility criteria includes bidcapacity also, the tenderer will be qualified only if its availablebid capacity is equal to or more than the total bid value of thepresent tender.
The Bid Security shall be deposited either in cash through epayment gateway or submitted as Bank Guarantee bond from ascheduled commercial bank of India or as mentioned in tenderdocuments. The Bank Guarantee bond shall be as per AnnexureVIA and shall be valid for a period of 90days beyond the bidvalidity period. In case, submission of Bid Security in the form ofBank Guarantee, following shall be ensured: (i).A scanned copyof the Bank Guarantee shall be uploaded on e- ProcurementPortal (IREPS) while applying to the tender. (ii).The original BankGuarantee should be delivered to Chief Office SuperintendentRate before closing date for submission of bids i.e., excludingthe last date of submission of bids. (ACS-5 dated 20.10.02023).(iii)Non submission of scanned copy of Bank Guarantee with thebid on e-tendering portal (IREPS) and/or non submission oforiginal Bank Guarantee within the specified period shall lead tosummary rejection of bid. (iv) The Tender Security shall remainvalid for a period of 90 days beyond the validity period for theTender. (v) The details of the BG, physically submitted shouldmatch with the details available in the scanned copy and thedata entered during bid submission time, failing which the bidwill be rejected (vi).The Bank Guarantee shall be placed in anenvelope, which shall be sealed. The envelope shall clearly bearthe identification "Bid for the ***** Project" and shall clearlyindicate the name and address of the Bidder. In addition, the BidDue Date should be indicated on the right hand top corner of theenvelope. (vii)The envelope shall be addressed to the officer andaddress as mentioned in the tender document. (viii).If theenvelope is not sealed and marked as instructed above, theRailway assumes no responsibility for the misplacement orpremature opening of the contents of the Bid submitted andconsequent losses, if any, suffered by the Bidder
Tenderers should show discount in the rate schedule only,instead of anywhere else in the offer. Discounts not shown atdesignated place will be summarily ignored for assigning interseranking of offers. Conditional discount will not be considered foradjudging the inter-se position i.e. rate quoted without anyconditions attached (viz. Discount/ Rebates having linkages toquantity, rates payment etc.) will only be consideredforevaluation purpose. In other words, discounted rates linked toquantities, rates, prompt payment etc. will be ignored fordetermining inter-se position. Railway, however reserves theright to use the discounted rate/ rates considered workable andappropriate, for counter offer to the successful tenderers.
Tenderers will examine the various provisions of The CentralGoods and Services Tax Act,2017(CGST)/ Integrated Goods andServices Tax Act, 2017 (IGST)/ Union Territory Goods andServices Tax Act, 2017(UTGST)/ respective state's State Goodsand Services Tax Act (SGST) also, as notified by Central/StateGovt.& as amended from time to time and applicable taxesbefore bidding. Tenderers will ensure that full benefit of InputTax Credit (ITC) likely to be availed by them is duly consideredwhile quoting rates. The successful tenderer who is liable to beregistered under CGST/IGST/UTGST/SGST Act shall submit GSTINalong with other details required under CGST/IGST/UTGST/SGSTAct to railway immediately after the award of contract, withoutwhich no payment shall be released to the Contractor. TheContractor shall be responsible for deposition of applicable GSTto the concerned authority. In case the successful tenderer isnot liable to be registered under CGST/IGST/UTGST/ SGST Act,the railway shall deduct the applicable GST from his/their billsunder reverse charge mechanism (RCM) and deposit the sameto the concerned authority. Contractor shall be liable topay/refund the amount collected as GST to the Indian Railwaysalong with interest and penalties, if any imposed by theauthorities, in case GST input tax credit of Indian Railways isdenied/rejected by the tax authorities due to reasons mentionedbelow but not limited to: Wrong/incorrect invoices issued byContractor ; No-filing of GST returns; Non payment of GSTcollected from Indian Railways to the authorities; Any othernoncompliance done by Contractor; Retention Money: Anypayment liable to be paid by Indian Railways to contractoragainst the goods or services or both supplied by suchcontractor to Indian Railways shall be kept on hold in casesupplier makes any noncompliance of any of the GST lawprovisions including nonreporting of invoices in GST returns.Such payment shall be released after proper verification ofrecords and availability of ITC to Indian Railways as perprovisions of GST Law. General Indemnity: Contractor herebyagrees to indemnify and hold harmless the Indian Railways fromand against any and all losses, including loss on account of InputTax Credit and all losses incurred by the Indian Railways relatingto or arising out of or in connection with any actual orthreatened claim, legal action, proceedings, prosecution orinquiry by or against the Indian Railways arising out, directly orindirectly, off failure by the contractor to comply with theprovisions of GST and related laws, or based upon or arisingfrom any failure by the Contractor {After award of LOA it shouldbe indemnify otherwise action may be taken by competentauthority and will be binding upon contractor).(ACS- 11) ( Click here to download Format)
