   EARNEST MONEY DEPOSIT : EMD is mandatory in this sale tender. The amount mentioned above is to be remitted as EMD along with the offer. The offers without EMD will be summarily rejected. EMD may be made through online gateway in IREPS. The EMD of the unsuccessful tenderer will be refunded. For successful tenderer, the EMD amount will be refunded after remittance of full sale value. If the tenderer withdraws the offer or does not pay the full value within the stipulated time, the EMD will be forfeited.

   1) It is certified that the above item is required for use in rail coaches. 2) A string ICF should be prefixed to the invoices uploaded by the suppliers of ICF in to the GSTIN. 3) The Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate, if quoted by the bidder. Wherever the successful bidder invoices the goods at GST rate or HSN Number which is different from that incorporated in the purchase order payment shall be made as per GST rate which is lower of the GST rate incorporated in the purchase order or billed. Whenever necessary, vendors will be required to adjust the basic price to the extent required by higher tax billed as per invoice to match the all-inclusive price as mentioned in the purchase order. 4) GST is Payable against documentary proof of firm's offer/MA. 5) If any condition / clause in this document is not as per firm's offer the same should be represented within 7 working days failing which it will be deemed unconditional acceptance of the supplier and no representation thereafter will be entertained by the purchaser on this account. 6. Traceability details such as manufacturers name, month & year of supply shall be necessarily provided on the components as specified in the relevant drawings, failing which item shall be rejected by the inspecting authority. 7. Stage inspection, if any shall be carried out as per the requirements given in the specification.

   SCOPE OF THE WORK : Removal of all Packing Wood, Plywood, Wooden Cable Drums and Other wood based Packing Materials unusable to ICF without segregation, Packing Wood attached with Nails, Fasteners, Angles, and Channels etc is permitted. The wood to be cleared by crushing the wood either by JCB or by wood crushing machine installed by the contractors with their own power and men. The Blackened wood also to be removed.NOTE:•The Packing Wood to be loaded in Lorries with JCB's in crushed condition only, no segregation of wood is permitted.• Manual loading of wood is not permitted. JCB Loading only permitted.•Ranking order of the Bid will be Higher to Lower.•Being a sale tender, EMD is mandatory. The offers without EMD will not be considered and will summarily get rejected.

   BRIEF DESCRIPTION OF WORK : 1. Clearing the above mentioned item after weighing it in the electronic weigh bridge Furnishing depot and transporting it through contactors vehicle away from ICF. 2. The material to be cleared without any selection/weeding out in crushed condition. 3. All these works shall be executed using purchasers dippers/lorries, JCB's/wood crushing machine with their own power and men, fuel, driver and tools. 4. Material to be cleared from the location mentioned in Delivery Order. 5. The subject work should be carried out during the period from 8.30 hrs to 12.00hrs and from 13.30hrs to 17.00hrs on full working days and from 8.30hrs to 12.00hrs on half working days. If required, the above work shall be carried out on holidays of ICF. 6. The Purchaser can take the delivery of packing wood only in crushed condition and the purchaser should bring sufficient number of vehicles for loading the packing wood through JCB's, so that accumulation in the dumpsite is cleared within the days mentioned in Delivery order. The contactor is permitted to use JCB in connection with loading of packing wood in the vehicles. Manual loading is not permitted.

   Special Tender Conditions: : 1.The Purchaser to take delivery of scrap packing wood in crushed condition either by using their JCB or wood crushing machine. Power supply will not be provided by ICF for crushing machine. The Purchaser to arrange a power generator for the same.2.The Purchaser should get the approval of the occupier of the factory (CWE/LHB) for installation of Wood crushing Machine/s and Power Generator.3.Contractor should use their own power for operating wood crushing machine.4.The purchaser should bring sufficient number of Trucks for loading the waste packing wood.5.Loading of crushed packing wood to be done with JCB only and no manual loading is permitted.6.The accumulation of left over should not be more than a truck load at the end of the day.7.Minimum 15 MT is to be cleared on full working days and 7 MT during half working days by the purchaser.8.If the purchaser fails to clear the above said quantity, penalty will be levied for the approximate left over quantity at the rate of RS.500/- per MT. If no material available in the dumpsite no penalty will be levied.9.The contractor has to remit the sale value in single installments for the offered quantity as per payment terms.10.Clearance of the material to be started from the next day of issue of delivery order issued (i.e. after remittance of entire sale value).

   OTHER IMPORTANT CONDITIONS : 1. The purchaser should strictly follow all rules and regulations including Factories Act, Labour Rules, Safety regulations, TNPCB regulations etc., which are in force. 2. There should not be any fly off dust or any other particles during transportation within outside ICF. 3. The vehicles used inside the factory by the purchaser must have current valid certification of Fitness issued by the Regional Transport Office and the exhaust gas pollution must be within the limit prescribed by TNPCB. 4. Purchaser has to engage adequate number of vehicles and suitable material handling equipments on all working days for carrying out this clearance work. 5. The purchaser shall be responsible to take necessary precautionary measures in order ensure the safety against injury, etc., for his personnel when working at the Railway premises and should follow the safety procedures, rules and regulations of Railway. 6. The purchaser has to get necessary work permit for the sale order from Chief Safety Officer/FUR and see that no unauthorized person works for

   him during the execution of the work. 7. The purchaser shall ensure that the persons employed by him/her if any inside the factory should comply with all instructions given by the Safety/RPF staff on duty and shall confined to their places of working and shall not go around the workshop.. 8. The persons if any engaged by the purchaser should wear appropriate personal protective equipment and the purchaser has to engage one supervisor for managing day to day activities. 9. Rate to be quoted in Tonnage basis. The highest rate quoted by bidder will be considered for placing contract. 10. The vehicle speed will be limited to 10 KMPH inside the Factory. If it is not followed strictly Rs.500/- penalty will be levied per instance. 11. All factory rules should be followed by the purchaser while working inside the factory. 12. The purchaser can take wooden packing in crushed condition and should load in the vehicles with JCB's, so that the accumulation is to be cleared from dumpsite within the days mentioned in D.O. 14. The Purchaser has to use JCB in connection with loading of materials in the vehicles. 15. TCS on sale scrap is leviable. The HSN code for packing wood material is 4415 and GST applicable is 5%. 16. In case of any accident or mishap resulting in loss or damage to property or life, the sole responsibility for any legal or financial implication shall rest with the contractor. 17. It is the purchaser's responsibility to comply with all the requirements of statutory and regulatory authorities for the vehicle(s) and driver(s) including insurance. 18. In case of any complaint lodged by the user or by the Railway, or in the event of a disagreement between the purchaser and the ICF/Railways, the award of arbitrator shall be final and binding on the purchaser.19. The Tender quantity may be split as per the splitting Clause between H1&H2 or H1, H2 &H3. PENALTY : Minimum 15 MT is to be cleared on full working days and 7 MT during half working days by the purchaser. If the purchaser fails to clear a penalty of RS.500/- per MT will be imposed for the un removed quantity. If no material available in the dumpsite no penalty will be levied.

   ARBITRATION : All disputes and differences of any kind whatsoever arising out of or in connection with the contract, shall be referred to the General Manager as per provisions of Clause 64 of GCC amended from time to time and provision of Arbitration and Conciliation (Amendment) act 2015. The arbitrator however will not be one of those who had an opportunity to deal with the matters to which this contract relates. The award of the arbitrator shall be final and binding on both the parties to this contract.

   PERIOD OF CONTRACT : The period of contract will be SIX Months from the date of issue of LOA.

   PAYMENT TERMS : The Purchaser has to remit the sale value for the offered quantity as per the payment terms. The sale value to be remitted to PFA/ICF through RTGS/NEFT within the stipulated working days from the date of advice from the authorities of Furnishing Depot (i.e. LOA).

    INSURANCE : The Tenderer shall take out and keep in force a policy or policies of insurance against all liabilities of the Contractor as the Railways at common law or under any statute in respect of accident to persons / vehicle whom shall be employed / engaged by the contractor or about, the site of the Contractor office for the purpose for carrying out the Contract work on the site. The Contractor shall also take out and keep in force a policy or policies of insurance against all recognized risks and losses due to theft, fire or natural calamities. Only Indian insurance shall be employed. Such insurance shall in all respects be subject to the approval of the Railways.
