Only electric locomotive manufacturers either for Indian Railways or world-over will be considered for placement of order who are having design and manufacturing capability with own IPR for IGBT based three-phase propulsion system and have supplied minimum 50 Electric locomotives of capacity 4000 HP or more with own designed IGBT propulsion system in past 7 years preceding to the bid due date. Out of 50 electric locomotives minimum 10 locomotives should be of capacity 6000 HP or more. OR Those firm who have designed, manufactured and supplied IGBT based three phase propulsion system of Electric Locomotive of capacity 4000 HP or more with own IPR for design, supply and manufacture of propulsion system. The firm should also have supplied such IGBT based propulsion system of total cumulative horsepower of 3,00,000 or more in past 7 years preceding the bid due date. Note: Propulsion system means Traction Converter, Auxiliary Converter and Vehicle Control Unit.
Bidder must fulfil these conditions: (1) An Indian manufacturing company. OR Indian subsidiary/associate company of a foreign manufacturer. (2) Lead Member of the Consortium/Joint Venture or the single entity Bidder as the case may be, (including its Associates) shall have designed an IGBT based Propulsion System of electric locomotives of 4,000 horsepower or more and manufactured and supplied the same. A Bidder who has procured the design from a third party (not being an Associate) shall not be eligible hereunder. In the event that a Bidder has developed its own technology, following the acquisition of technology from a third party it shall certify that the proposed technology is its own property and does not infringe on the intellectual property rights of a third party: Provided, however, that if such technology was acquired from a third party within a period of 10 (ten) years prior to the Bid Due Date, the Bidder shall also furnish a certificate from such third party that it has no intellectual property rights or claims on such technology. (3) Vendor must submit credentials and documents in the tender to establish their suitability for meeting the eligibility criteria as mentioned above. If it is found at any stage that forged documents or false credentials are submitted, penal action such as blacklisting of vendor and forfeiture of EMD shall be done by Indian Railway.

Have your noted pre-decided rate of Long Term Maintenance Agreement (LTMA) during quoting of offer?
(a) All the bidders/Tenderers while quoting the rates should clearly indicate HSN Code, the rate of applicable duties and taxes included in the prices quoted by them. Any variation in tax structure/rate shall be dealt with under Statutory Variation Clause (b) All the bidders/tenderers should ensure that they are GST compliant and their quoted tax structure/rates are as per GST Law. (c) All vendors should have GST Registration Number. (d) GST Act and Rules as applicable from time to time is applicable (e) No bills for payment will be accepted without GST registration. (f) In case the successful tenderer is not liable to be registered under CGST/GST/UTGST/SGST ACT, the railway shall deduct the applicable GST from his/their bills under reverse charge mechanism [RCM] and deposit the same to the concerned tax authority.
The bidder agrees to supply the tendered stores at the rates quoted by him in accordance with the IRS Conditions of Contract and [or] special Conditions and [or] other Conditions specified/attached with the tender.
The Firm shall pass on (as per section 17 (1) of CGST/SGST Act) any reduction in tax rate on supply of goods or any benefit of input tax credit to the Railway through a commensurate reduction in price without any undue delay. To the above effect the firm should give declaration that all the benefits accruing on account of change in tax rate and any additional input tax credit (ITC benefit) shall be passed on the Railways.
Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items,and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender condition.
EMD: All bidders except those are exempted from submitting EMD as per relevant para of CLW BID DOCUMENT- (Rev.V) Jan. 2026 (copy enclosed), shall be required to submit EMD as per the amount mentioned in the tender schedule. Offer submitted by bidders without EMD who are not eligible for exemption shall be summarily rejected.
Vendors who claim for exemption from payment of Earnest Money (EMD) as per the relevant para of CLW BID DOCUMENT- (Rev.V) Jan. 2026 (copy enclosed) shall have to attach scanned copy of requisite documentary evidence in support of their claim along with offer, failing which the offer will be considered invalid, without Earnest Money and will be summarily rejected .
All Tenderers claiming exemption from submitting EMD/SD, shall be required to sign a bid securing declaration as per Annexure-A (copy enclosed). By seeking exemption of EMD/SD by the tenderer, it will be considered that the contents of Annexure A have been read and unconditionally agreed to and accepted by the tenderers.
In compliance to Public Procurement (Preference to Make in India), Order2017 -Rev circulated vide Railway Board letter no. 2020/RS(G)/779/2/Pt.1(E-3322671) dated 20.08.24 (Copy enclosed), the Class-I local supplier/Class-II local supplier at the time of tender, bidding or solicitation shall be required to indicate percentage of local content and provide self- certification that the item offered meets the local content requirement for Class-I local supplier/Class-II local supplier. They shall also give details of the location(s) at which the local value addition is made.
WARRANTY: The warranty of the complete system will be as per IRS Conditions of Contract. After expiry of warranty, the Long Term Maintenance Agreement (LTMA) for 35 [Thirty Five] years as per terms and conditions shall be applicable (copy enclosed).
Bidders claiming to avail benefits and preferential treatment extended to Micro and Small Enterprises [MSEs] should necessarily enclose relevant documents. Bidders may please refer to the CLW BID DOCUMENT- (Rev.V) Jan. 2026 (Copy enclosed) in this regard.
The authorized dealer has to upload the tender specific authorization letter from the manufacturer authorizing him to submit offer against this tender. The tender specific authorization to the tender should be directly from the manufacturer without which, the offer will be summarily rejected.
Bidder to submit a certificate, as mentioned hereunder, along with a bid for compliance of OM of MoF dated 23.07.2020. Model Certificate: "I have read the clause regarding restrictions on procurement from a bidder of a country which shares a land border with India: I certify that this bidder is not from such a country or, if from such a country, has been registered with the Competent Authority. I hereby certify that this bidder fulfills all requirements in this regard and is eligible to be considered. (Where applicable, evidence of valid registration by the Competent Authority shall be attached.)". Even if the bidder does not give such declaration along with the offer and submits the offer then it will be considered that the contents of above declaration have been read and unconditionally agreed and accepted by the tenderer. If the bidders are not agreeable to this declaration they have to categorically mention about the disagreement in Techno Commercial Deviation. If such certificate given by a bidder whose bid is accepted is found to be false, this would be a ground for immediate termination and further legal action in accordance with law.
All bidders shall confirm declaration as below in compliance of restrictions under Rule 144 (ix) of GFR-2017 and as per Clause 30 of Section II of "CLW Bid Document 2025" :- (A) l have read the clause regarding restrictions on procurement from a bidder of a country which shares a land border with India; I certify that this bidder is not from such a country or, if from such a country, has been registered with the Competent Authority. I hereby certify that this bidder fulfills all requirements in this regard and is eligible to be considered. Where applicable, evidence of valid registration by the Competent Authority shall be attached. (B) (i) "l have read the clause regarding restrictions on procurement from a bidder having Transfer of Technology (TOT) arrangement. I certify that this bidder does not have any TOT arrangement requiring registration with the competent authority " OR (ii) "I have read the clause regarding restrictions on procurement from a bidder having Transfer of Technology (TOT) arrangement I certify that this bidder has valid registration to participate in this procurement." (Strikeout any one of two i.e. (i) or (ii) whichever is not applicable). If the bidder fails to give such declaration, as above, then it will be presumed that the contents of above declaration have been read and unconditionally agreed and accepted by the tenderer. If any tenderer is not agreeable to this declaration they have to categorically mention about the disagreement in Techno Commercial Deviation.
Force Majeure Clause: As per IRS conditions of contract.
This tender is through single bid system (without e-Reverse Auction).
The bidder shall give self certification for local content in the quoted item (goods/works/services) at the time of tendering. However, at the time of execution of the project, for all contracts above INR 10 crores, the contractor/supplier shall be required to give local content certification duly certified by cost/ chartered accountant in practice. For cases where it is not possible to provide certification by cost /chartered accountant at the time of execution of project, the supplier shall be permitted to provide the certificate for local content from cost/chartered accountant after completion of contract, within time limit as mentioned in the contract. In case the contractor/ supplier does not meet the stipulated local content requirement and the category of the supplier changes from class-I to Class-II/ Non-local or from Class-II to Non-local, a penalty up to 10% of the contract value may be imposed. However, contract once awarded shall not be terminated on this account.
The bidders/tenderers have to quote the rates for Capital cost of tendered item i.e. supply, installation, testing and commissioning of Integrated Locomotive Kit. During the maintenance period after completion of warranty period, the Contractor shall be paid for its Maintenance obligations i.e. the annual Maintenance Fee per Locomotive, due and payable, for each Service Year of such Locomotive till Completion of Maintenance period, shall be as per Long Term Maintenance Agreement (LTMA) (copy enclosed).
Conditions for Long Term Annual Maintenance- After expiry of Warranty Period of the equipment, a contract will be concluded by Zonal Railway where the locomotives installed with Integrated Locomotive Kit will be homed. Execution of contract for maintenance of the equipment will be monitored by concerned Zonal Railway Authority. Rate of maintenance of is already mentioned in attached document of this tender.
The Technological Partner shall, for each and every locomotive, perform its Maintenance Obligations of Locomotive kit upto 35 Years from the date of dispatch of such Locomotive from manufacturing unit (the Maintenance Period). The Maintenance Obligations of the Technological Partner shall cease upon completion of the Maintenance Period and no Maintenance Fee shall be due and payable thereafter (ref: Article-5, Para-5.5 of LTMA vide Document No: C-D&D/T/24/LTMA, Rev-4 Issued On July 2026; copy enclosed).
The Technological Partner must ensure fleet maintenance meets the K e y Performance Indicators as defined in Article-6. Penalties for shortfall, if any, will be calculated and recovered annual basis as per Artical-6 of LTMA vide Document No: C-D&D/T/24/LTMA, Rev-4 Issued On July 2026 (copy attached).
For Post Warranty Period, payment for long term annual maintenance obligation will be as per Article-7 of LTMA vide Doc. No. C- D&D/T/24/LTMA, Rev-4 Issued On July 2026 (copy enclosed).
Terms & Conditions contained in Special Conditions of Contract (SCC) vide no. C-D&D/T/24/kit dtd 07.07.2026 (copy enclosed) shall override any similar existing condition in any other document of this tender.

Validity of offers: Offers should be valid for 120 days after closing date of tender. Any offer having lesser validity shall be deemed as commercially unresponsive and will be summarily rejected.
No deviation from the Price Variation Clause stipulated in the Tender is permitted. Offer with variation from Tendered PVC or base date as stipulated in tender will be summarily rejected. Offer with fixed price will also be summarily rejected.
