Eligibility Criteria

Tenders from Joint ventures are not acceptable.

Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by any State Government / Government of India /Union Territory.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

The bidder is required to ensure browser compatibility of the computer well in advance to the last date and time for receipt of tenders. The departments shall not be responsible for non-accessibility of e-Procurement portal due to internet connectivity issues and technical glitches at bidders end.

Bidder shall pay Contract Management Module processing fees of 0.025% of the contact value (Min Rs.500/- & Max Rs.7500/-) soon after contract has been issued to bidder.

Pre-qualification conditions are explained in tender booklet. Interested bidders shall abide by the rules and conditions mentioned in the standard tender document.

None of the contracts of the bidder should have been terminated/foreclosed/EMD forfeited on account of his default in KPCL or elsewhere during last three years.

Conditional tenders, incomplete tenders without EMD, tenders not properly uploaded and late submission of tenders shall be rejected.

The Right to accept any or reject any/all the tenders without assigning any reasons rests with the accepting authority.

The Tenderer shall obtain similar nature of work done certificate from financial year 2019-20 to 2023-24 and current year (50% of the amount Put to Tender Excluding GST) in the prescribed format from the Competent Authority from State/Central Government /Government undertakings and scan the original certificate and attach the scanned file to the Bid.

Financial turnover of previous years shall be given a weight of 10% per year to bring them to the price level of current year in the Technical Qualification Criteria.

The contractor shall quote his rates exclusive of GST as per the latest GOK notification prevailing as on the date of NIT. Tenders quoted with inclusive of GST will be rejected.

The contractor shall quote his rates inclusive of PF as per the applicable rates as issued by the PF Department from time to time.

As per Karnataka State Govt. Order No:LD/300/LET/2006/Bangalore Dtd: 1-1-2007 and Govt.Ltr. No:PW/134/BMS/2007, Dtd: 27-7-2007, a sum amounting to 1% of the bill amount will be deducted towards Construction Labour Welfare fund (if applicable.)

As per Karnataka State Govt. Order No: CI/56/MMN: 2006 Bangalore Dtd: 23.07.2007.The bidder should take into account the prevailing royalty charges while quoting their rates and shall be deducted from the work bills.

The successful bidder shall furnish a security deposit equivalent to 5% of the contract amount or tender value whichever is higher (exclusive of GST) in the form of DD/BG/NEFT from any schedule bank acceptable to the Corporation in the prescribed format within 20 days of receipt of acceptance letter or work order from KPCL plus additional security deposits for unbalanced tenders in accordance with conditions of contract.

Security deposit should be valid for 30 days after the date of completion of defect liability period.

The work completion period is as per TABLE-A(6) page no 04 and the Tenderer should maintain work during the defect liability period, which is twelve months after the date of completion of work.During the period any defects / non performance observed in system, it shall be duly completed immediately by contractor without attributing cost the KPCL.

Work should be carried out as per detailed technical specification/scope of work attached with this tender.

KPCL reserves the right to verify any information/documents furnished by the tenderer should the circumstances so warrant. In case the information or the documents furnished are found to be incorrect/false or invalid then the EMD furnished by such tenderer shall be forfeited, tender will be cancelled and registration of such tenderer in KPCL will also be cancelled.

Rates shall be quoted in Tender Bill of Quantities in the e-procurement web site itself.

The successful bidder shall give an undertaking that they would abide by the provisions of the Employees Provident Fund Act.

The successful bidder shall obtain accident insurance coverage for all the workers working in the site and shall produce the original copy of the same before starting the work.

Contractor should have an independent PF code.

Bidders shall give declaration regarding payment of fair and reasonable wages, which shall not be less than minimum wages fixed by government from time to time to the labors working under contractor in the contract undertaken by him failing which the bids are liable for rejection.

The successful bidder should maintain register of labour deployed and wages (as per Govt. orders) paid & the remittance towards PF for the workers and shall produce the documents whenever called for by the competent authority.

The successful contractor shall give preference in employing re-habitants of Kali Hydro Electric Project in their employee team.

Financial Year will be reckoned as the period between first day of April and Thirty first day of March of succeeding year (both days inclusive). In case the dates notified above are declared as holiday, the immediate next working day shall be reckoned.

If the contractor makes any alterations in the conditions of the contracts or puts any condition of his own, such tenders are liable for rejection.

Any dispute or difference or claim arising out of or in connection with or relating to the present contract or the breach, termination or invalidity thereof, shall be referred and settled under the Arbitration center Karnataka (Domestic & International) Rules 2012, by one or more arbitrators appointed in accordance with its rules.

Corrigendum, modification, or Corrections, if any will be published in the website only. Therefore, bidders are informed to visit e-procurement portal regularly for updates.

The Contractors GST number shall be in active/ regular condition, when verified through on line verification tool on GOI web site.

On completion of work, the contractor shall promptly demobilize from the site and leave the place in a manner as directed by the Engineer in-charge, including cleaning of the area contractor shall start demobilization only after the successful completion of contract.

The successful bidder shall furnish 5% Security Deposit, Stamp paper of suitable denomination and sign the agreement within the Twenty days from the date of issue of the work order

Contractor shall also arrange to take an Insurance policy under accident insurance plans covering claims under Workmen Compensation Act etc. with latest amendments to cover risks including himself/herself such as accidents, injury or death & third party claims against his liability for any material/physical damage, loss/injury which may occur to any person or property arising out of execution of contract. Agency should produce the original insurance policy before commencement of works, i.e during requisition of gate pass to the site.

The agency shall be solely responsible for any sort of compensation payable to the workmen working under him, during any unwanted incidents/accidents/death while on duty/while travelling to the work site etc.

The contractor is solely responsible for the safe execution of the works. All necessary safety gadgets and skilled man power shall be arranged by the Contractor at site while carrying out the job. The contractor shall abide by all applicable state laws in respect of nature of job, labour welfare, and safety during the contract period. The corporation does not assume any responsibility.

Terms of payment: Payments will be released after satisfactory completion of works completely.

Delay Penalty: Delay penalty of 0.5% of the work order amount per week up to maximum of 10% of the work order value shall be levied for the period beyond the period of completion.

Site Visit: Agency may visit the site before participating into the tender.

Contractor shall call with written letter to the employer for joint inspection of works after completion of works in all respect. The date of joint inspection without any punch points / defects / dues etc. at system as per contract is considered as completion of works in all respect . Same is treated as taking over of the system by KPCL from contractor.

The prospective bidder should have satisfactorily completed as a prime contractor at least one similar nature of work that is, maintenance or repair of hydro mechanical equipments such as penstock gates or vertical lift gates etc., of value not less than Rs. 5.38 Lakh (Excluding GST) in any reputed Industry/PSU/Government organization in the preceding five years (i.e 2019-20, 2020-21, 2021-22, 2022-23 and 2023-24). In proof of this, bidder should submit work done certificate and corresponding work order issued by the competent authority (in case of state/central Government/Government under taking from officers not below the rank of Executive Engineer or equivalent cadre and in case of KPCL not below the rank of Chief Engineer).Weightage of 10 % per year applicable to previous work orders to bring the current year price level..

Financial Status

The bidder in his name, should have in the last five years (i.e 2019-20, 2020-21, 2021-22, 2022-23 and 2023-24) achieved at least two financial years an average annual financial turnover of Rs.10.76 Lakh. In proof of this turnover certificate duly certified by a charted accountant shall be furnished. (A Weightage of 10 % per year is applicable to previous annual turnover to bring the current price level of 2024-25).
