"Construction of Proposed Type II Staff Quarters- Two High Rise Towers of (G+3P+21 Floors) (240 Flats)"at Jogeshwari (East) in connection with Extension of Harbour Line between Goregaon to Borivali station (MUTP 3A).

The Bidder shall have a minimum Net Worth (the "Financial Capacity") of *[Rs. 8.39 crore] at the close of the preceding Financial Year. The tenderer shall not have total amount of dispute in their pending litigation more than Fifty percent (50%) of the tenderer's Net Worth. The tenderer shall be examined for all pending litigation from all contracts completed or all ongoing contracts. The tenderer shall provide detailed information of all such pending litigations in the prescribed proforma given in Appendix-VIII. The details of all pending litigation shall comprise of all such Arbitration cases and also all pending Court cases irrespective of whether these litigations have been initiated by the tenderer against their Employer/Authority/Client or by the Client/Employer/Authority against the tenderer. The amount of disputes shall also comprise of all the claim amount and also all counter-claim amount in such Arbitration/Court cases

2.2.2.7Submission in support of Financial Capacity (i) The Technical Bid must be accompanied by the Audited Annual Reports of the Bidder (of each member in case of a Consortium/Joint Venture and also of associates if any) for the last 5 (five) Financial Year s, preceding the year in which the Bid is submitted. (ii) In case the annual accounts for the latest financial year are not audited and therefore the Bidder cannot make it available, the Bidder shall give an undertaking to this effect and the statutory auditor shall certify the same. In such a case, the Bidder shall provide the Audited Annual Reports for 5 (five) years preceding the year for which the Audited Annual Report is not being provided. (iii) The Bidder must establish the minimum Net Worth specified in Clause 2.2.2.2, and provide details as per format at Annex-III of Appendix-IA.

Technical Capacity- For demonstrating Technical Capacity and experience (the "Technical Capacity"), the Bidder shall, during the last 5 (five) previous financial years and the current financial year up to the Base month (not to be read with para-2.1.13).

(i)have received payments for construction of Eligible Project(s), or has executed construction works by itself in a PPP project, such that the sum total thereof, as further adjusted in accordance with clause 2.2.2.4 (i) & (ii), is more than 2.5 (two and half) times the Estimated Project Cost (the "Threshold Technical Capacity").Provided that at least one fourth of the Threshold Technical Capacity shall be from the Eligible Projects in Category 1 and/ or Category 3 specified in Clause 2.2.2.4 (i) & (ii)

(ii)Completed (executed) or Substantially completed$ (executed) at least one Eligible Project of Railway Sector as mentioned in clause 2.2.2.4/iii of value of not less than [50% (fifty) per cent] of the Estimated Project Cost. However, in case of Consortium/Joint Venture, the other members of Consortium/Joint Venture (who are not considered for satisfying this technical Capacity under this clause) also must have Completed (Executed) or Substantially completed$ at least one Eligible Project of Railway Sector as mentioned in clause 2.2.2.4/iii of value of not less than [10% (ten) per cent] of the Estimated Project Cost

iii) a.Completed (executed) substantially completed$ (executed) at least one similar work of value of not less than [20% (Twenty percent)] of the estimated project cost OR b.Completed (executed) substantially completed$ (executed) at least two similar works of value of not less than [10% (Ten percent)] of the estimated project cost

Construction of Proposed Type-II Staff Quarters - Two High-Rise Towers (G+3P+21 Floors) comprising 240 Flats at Jogeshwari (East) in connection with the Extension of Harbour Line between Goregaon and Borivali Stations (MUTP-3A).(i) Railway sector would be deemed to include Any project involving construction of building executed for Railways, Metro Rail, High Speed Rail, other Central Govt.deptts/State Govt./PSUs/Local bodies/ Gov. Institutions/Govt Authorities; and(ii) Core sector would be deemed to include hydroelectric dams, barrage, ports, airports, thermal/steel/cement plants, irrigation canals, water supply (pipelines/treatment plants), sewerage (pipelines/treatment plants), civil works in power sector/commercial set ups (SEZs etc.)/ industrial parks/logistics parks and real estate development,

(iii) Similar nature of work is defined as "Construction of RCC frame structure/Monolithic Concrete structure building of 7 storey and above including Electrical works executed for Central Govt./State Govt./PSUs/Local bodies/ Govt. institutions/Govt. Authorities." (7 storey and above means G+6 floors and above or Stilt+6 floors and above or building having height of 25m and above)."

The Bank Guarantee bond shall be as per Annexure-VIA and shall be valid for a period of 90days beyond the bid validity period.
