The tenderer must have minimum average annual contractual turnoverof V/N or 'V' whichever is less; where V= Advertised value of the tenderin crores of Rupees N= Number of years prescribed for completion ofwork for which bids have been invited. The average annual contractualturnover shall be calculated as an average of "total contractualpayments" in the previous three financial years as per the auditedbalance sheet. However, in case balance sheet of the previous year isyet to be prepared/ audited, the audited balance sheet of the fourthprevious year shall be considered for calculating average annualcontractual turnover. The tenderers shall submit requisite informationasper Annexure-VIB, along with copies of Audited Balance Sheets dulycertified by the Chartered Accountant/ Certificate from CharteredAccountant duly supported by Audited Balance Sheet. Note: Auditedbalance sheet of the fourth previous year can be considered only whenbalance sheet of the previous year is yet to be prepared/ audited and itshall be certified by CA in Annexure VIB. For this purpose Standardformat is attached. Non submission of Annexure VIB certificate, orsubmission of Annexure VIB certificate either not properly filled in, or in aformat other than the prescribed format shall lead to summary rejectionof your offer.
The tenderer must have successfully completed or substantiallycompleted any one of the following categories of work(s) during last07(seven) years, ending last day of month previous to the one in whichtender is invited: (i)Three similar works each costing not less than theamount equal to 30% of advertised value of the tender, or (ii)Two similarworks each costing not less than the amount equal to 40% of advertisedvalue of the tender, or (iii)One similar work costing not less than theamount equal to 60% of advertised value of the tender. Definition ofSimilar work- 'Any type of Civil Engineering work involving Constructionof RCC frame Building (S). The cost component of RCC building(s) shallbe at least 30% of tender value.

Tenderers should show discount in the rate schedule only,instead of anywhere else in the offer. Discounts not shown atdesignated place will be summarily ignored for assigning interseranking of offers. Conditional discount will not be considered foradjudging the inter-se position i.e. rate quoted without anyconditions attached (viz. Discount/ Rebates having linkages toquantity, rates payment etc.) will only be considered forevaluation purpose. In other words, discounted rates linked toquantities, rates, prompt payment etc. will be ignored fordetermining inter-se position. Railway, however reserves theright to use the discounted rate/ rates considered workable andappropriate, for counter offer to the successful tenderers.
Tenderers will examine the various provisions of The CentralGoods and Services Tax Act,2017(CGST)/ Integrated Goods andServices Tax Act, 2017 (IGST)/ Union Territory Goods andServices Tax Act, 2017(UTGST)/ respective state's State Goodsand Services Tax Act (SGST) also, as notified by Central/StateGovt.& as amended from time to time and applicable taxesbefore bidding. Tenderers will ensure that full benefit of InputTax Credit (ITC) likely to be availed by them is duly consideredwhile quoting rates.The successful tenderer who is liable to beregistered under CGST/IGST/UTGST/SGST Act shall submit GSTINalong with other details required under CGST/IGST/UTGST/SGSTAct to railway immediately after the award of contract, withoutwhich no payment shall be released to the Contractor. TheContractor shall be responsible for deposition of applicable GSTto the concerned authority. In case the successful tenderer isnot liable to be registered under CGST/IGST/UTGST/ SGST Act,the railway shall deduct the applicable GST from his/their billsunder reverse charge mechanism (RCM) and deposit the sameto the concerned authority. Contractor shall be liable topay/refund the amount collected as GST to the Indian Railwaysalong with interest and penalties, if any imposed by theauthorities, in case GST input tax credit of Indian Railways isdenied/rejected by the tax authorities due to reasons mentionedbelow but not limited to: Wrong/incorrect invoices issued byContractor ; No-filing of GST returns; Non payment of GSTcollected from Indian Railways to the authorities; Any othernoncompliance done by Contractor; Retention Money: Anypayment liable to be paid by Indian Railways to contractoragainst the goods or services or both supplied by suchcontractor to Indian Railways shall be kept on hold in casesupplier makes any noncompliance of any of the GST lawprovisions including nonreporting of invoices in GST returns.Such payment shall be released after proper verification ofrecords and availability of ITC to Indian Railways as perprovisions of GST Law. General Indemnity: Contractor herebyagrees to indemnify and hold harmless the Indian Railways fromand against any and all losses, including loss on account of InputTax Credit and all losses incurred by the Indian Railways relatingto or arising out of or in connection with any actual orthreatened claim, legal action, proceedings, prosecution orinquiry by or against the Indian Railways arising out, directly orindirectly, offailure by the contractor to comply with theprovisions of GST and related laws, or based upon or arisingfrom any failure by the Contractor {After award of LOA it shouldbe indemnify otherwise action may be taken by competentauthority and will be binding upon contractor).(ACS-6 dtd21.12.2023) ( Click here to download Format)
The Bid Security shall be deposited either in cash throughepayment gateway or submitted as Bank Guarantee bond froma scheduled commercial bank of India or as mentioned in tenderdocuments. The Bank Guarantee bond shall be as perAnnexureVIA and shall be valid for a period of 90days beyondthe bid validity period. In case, submission of Bid Security in theform of Bank Guarantee, following shall be ensured: (i).Ascanned copy of the Bank Guarantee shall be uploaded oneProcurement Portal (IREPS) while applying to the tender.(ii).The original Bank Guarantee should be delivered to ChiefOffice Superintendent Rate before closing date for submission ofbids i.e., excluding the last date of submission of bids. (ACS-5dtd 20.10.02023). (iii)Non submission of scanned copy of BankGuarantee with the bid on etendering portal (IREPS) and/or nonsubmission of original Bank Guarantee within the specifiedperiod shall lead to summary rejection of bid. (iv) The TenderSecurity shall remain valid for a period of 90 days beyond thevalidity period for the Tender. (v) The details of the BG,physically submitted should match with the details available inthe scanned copy and the data entered during bid submissiontime, failing which the bid will be rejected (vi).The BankGuarantee shall be placed in an envelope, which shall be sealed.The envelope shall clearly bear the identification "Bid for the***** Project" and shall clearly indicate the name and address ofthe Bidder. In addition, the Bid Due Date should be indicated onthe right hand top corner of the envelope. (vii)The envelopeshall be addressed to the officer and address as mentioned inthe tender document. (viii).If the envelope is not sealed andmarked as instructed above, the Railway assumes noresponsibility for the misplacement or premature opening of thecontents of the Bid submitted and consequent losses, if any,suffered by the Bidder.

Incase creation of unsafe working due to infringement/entanglement of P.Way materials ( Rails, Sleeper, tec.) or/andtool & plants, deployed at worksites with running trains, apenalty of Rs. 1,00,000/- (Rs. One Lakh) shall be imposed perincident. In case of repeated such incidence, contract is liablefor termination as per contract conditions. (HQ's Lt. No. W.636.T.FBWP/Tender/2017 dtd. 12.10.2021). Further,Excavation and Earthwork in Railway Premises: While carryingout the excavation in the yard for executing any work allprecautions should be taken to avoid damages to cables pipelines etc and the damage cost will be borne by agency. In orderto avoid damage to the Signaling, Tele communication andElectrical cables, Telecom Circular No.17/2013 -"Procedure forundertaking digging work in the vicinity of signaling, electricaland telecommunication cables" issued vide letter no.2003/Tele/RCIL/1 Pt.IX dated 24.06.2013 has to be followed.
As per the recommendations by the 47th GST Council Meeting inrelation to changes in Tax rates, circulated by Railway Boardvide L.No.2017/ACII/1/6/GST/Main/Vol.-III, dated 05-07- 2022, theGST rates on Railway works contract has been revised fromexisting 12% to 18%. The clarification mentioned in the RailwayBoard's letter is attached in tender document. Therefore,Bidders are requested to quote their rates including 18% GST.'

Documentary proof - Tenderer should submit scanned copydocumentary proof in regard for fulfilling the Technical /financialeligibility criteria along-with their offer (for details refer attacheddocuments). If the tenderers do not submit any proof of meetingwith the eligibility criteria as laid down in the tender conditions,the offer shall be considered as incomplete and shall besummarily rejected. Documents submitted in support ofeligibility criteria after opening of tender will not be considered.
