OEM should quote. Other firms should quote along with valid tender specific authorization of OEM along with their offers. Otherwise offer will be ignored.

Firm must quote make/brand along with model no. Multiple make/brand will not be accepted.

Firms are required to submit compliance remarks for every parameter of the attached specification in a technical compliance sheet duly signed and certified. Failure to provide this information will result in the disqualification of the offer.

Any deviation in specification will be summarily rejected without any back reference.

The Railway reserves the right to place orders for entire or bulk quantity on firms having proven satisfactory past performance of supply of same/similar item (definition of similar item here is "supply of Tri Colour LED Torch Light") to this Railway, other Railway and Railway Production Unit at least 20% of tender quantity anytime during preceding three years and current year against single order. Firm should upload supporting documents like Inspection Certificate, Receipt Note, Payment Receipt Particulars along with offer. Non-submission of such documents shall be taken as they are not having any such past performance and their offers shall be considered further as per extant rules and no back reference in this regard will be made to them.

Previous Test Certificate issued by a NABL-accredited laboratory must be submitted along with offer for during preceding three years and current year .

Mode of dispatch : By Road. and FOR destination.

Sample Clause : Sample to be approved from Consignee before bulk supply.

The tenderer to indicate the Manufacturer's Name, Month and Year of manufacturing by casting/ stamping/ etching/ embossing, at an appropriate place of each piece supplied, without affecting the functional utility and structural stability of the components/ material. However, if the same is Eastern Railway, General Tender Condition (Revision-1) effective from 06.01.2021 Page: 19 of 63 not possible because of component/ item being small in size or any other reason what so ever, tenderer should indicate the same in their offer.

Necessary certificate and test reports from NABL accredited/ Central Government approved Laboratory, Work Test Certificate to be submitted along with supply of materials for conformity of parameters in specification.

Warranty Certificate and Guarantee Certificate to be submitted at the time of delivery.

Deviations: Deviation if any should be mentioned in the deviation tab of the offer. Deviations if mentioned in uploaded documents will not be considered.

All the bidders or tenderers should ensure that they are GST complaint and their quoted tax structure /rate is as per GST Law with GST registration number.

Court Jurisdiction : For any disputes related to contract or inspection/action by Inspecting Agency, the court jurisdiction would be Kolkata, West Bengal

The tenderers shall submit a copy of certificate stating that all their statements/documents submitted along with bid/tender are true and factual. Standard format of certificate to be submitted by the bidder is enclosed as Annexure-I. In addition to Annexure-I, in case of other than company/proprietary firm, Annexure-I(A) shall also be submitted by the each member of the partnership firm/joint venture (JV: if permitted to participate in the tender)/ Hindu Undivided Family(HUF)/ Limited Liability Partnership (LLP) etc. as the case may be. Non submission of above certificate by the bidder shall result in summarily rejection of his/their bid. It shall be mandatorily incumbent upon tenderer to identify state and submit the supporting documents duly self attested/ digitally signed by which they/ he is qualifying the Qualifying Criteria mentioned in the tender document. It will not be obligatory on the part of Tender Committee/ Accepting Authority to scrutinize beyond the submitted document of tenderer as far as his qualification for the tender is concerned.
