Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka

Bidders shall ensure upload of relevant document certifying his/her status as Scheduled Caste/ Scheduled Tribe/other reserved category as prescribed in the tender document.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

Rs.2,30,000 as the cost of the Bidding Process (calculated as Rs. 10,000 for every 100 Cr or part thereof) of Project Cost to be submitted in form of DD in Favor of Managing Director, BSMILE and Original DD shall be submitted along with EMD before tender opening. The copy of the DD shall be uploaded in KPPP along with other documents in technical bid. The bid without the bidding process fee shall be treated as Non- responsive)

The Bidders shall quote the Concession Period in number of days in the Financial Bid as per Appendix-IB. The quoted Concession Period shall constitute the sole criterion for evaluation of Financial Bids. For the purposes of this Tender, the Concession Period shall commence from the Appointed date and shall include the construction period. The Concession Period quoted by a Bidder shall not exceed 11,863 (eleven thousand eight hundred and sixty three) days, being equivalent to 32.5 (thirty two point five) years from appointed date. Any Bid quoting a Concession Period exceeding 11,863 days shall be treated as non-responsive and shall be rejected. Further, notwithstanding any adjustment in Concession Period pursuant to the provisions of the Concession Agreement, including Article 29 (Effect of Variations in Traffic Growth), the total Concession Period shall in no event exceed 11,863 days from appointed date. The basis for fixation of the maximum Concession Period of 32.5 (thirty two point five) years is set out in Clause 1.2.11 of the RFP

Bids are invited for the Project on the basis of the Concession Period required by a Bidder for implementing the Project. The Authority shall provide fixed Viability Gap Funding of 40% of the Estimated Project Cost (i.e. 1,414.76 Cr being 40% of 3,536.89 Cr), and the Bidder shall quote the Concession Period required for recovery of its investment and returns from the Project in accordance with the terms of the Concession Agreement

The Concession Period quoted by a Bidder shall not exceed 11,863 (eleven thousand eight hundred and sixty three) days from appointed date. Any Bid quoting a Concession Period exceeding 11,863 days shall be treated as non-responsive and shall be rejected.

The Concessionaire shall be entitled to levy and charge a pre-determined user fee from users of the Project. Toll / User Fee Framework: The levy, collection, rates and revision of user fee on the Project shall be governed by the Karnataka Road User Fee (Determination of Rates and Collection) Rules, 2014 (notification No. PWD 06 EAP 2012 (P3) dated 07-03-2015, issued under the Karnataka Highways Act, 1964), as amended from time to time, and the applicable Government of Karnataka toll notification for the Project. The base fee rates are as specified in the said Rules, and are subject to annual revision in accordance with Rule 5 thereof namely, an increase of 3% (three per cent) per annum (without compounding) together with 40% (forty per cent) of the movement in the Wholesale Price Index (WPI), as set out in the formula in the said Rules. The toll rates, indexation and the basis of revision adopted in the Feasibility Report and the financial model are consistent with this framework. No peak / off-peak or congestion pricing is permitted, and the user fee shall be revised only in accordance with the said Rules. The detailed fee provisions are set out in Article 27 of the Concession Agreement and the Fee Notification at Schedule-R thereof

Notwithstanding anything to the contrary contained herein, in the event that the Bid Due Date falls within three months of the closing of the latest financial year of a Bidder, it shall ignore such financial year for the purposes of its Bid and furnish all its information and certification with reference to the 5 (five) years or I (one) year, as the case may be, preceding its latest financial year. For the avoidance of doubt, financial year shall, for the purposes of a Bid hereunder, mean the accounting year followed by the Bidder in the course of its normal business
