"Land acquisition and other allied works in connection of various ROB's/RUB works under jurisdiction of Dy.CE/GSU/GWL of Jhansi Division of North Central Railway".

The tenderer must have minimum average annual contractual turnoverof V/N or 'V' whichever is less, where V= Advertised value of the tenderin crores of Rupees N=Number of years prescribed for completion ofwork for which bids have been invited. The average annual contractualturnover shall be calculated as an average of 'total contractualpayments" in the previous three financial years, as per the auditedbalance sheet. However, in case balance sheet of the previous year isyet to be prepared/ audited, the audited balance sheet of the fourthprevious year shall be considered for calculating average annualcontractual turnover. The tenderers shall submit requisite information asper Annexure-VIB, along with copies of Audited Balance Sheets dulycertified by the Chartered Accountant/ Certificate from CharteredAccountant duly supported by Audited Balance Sheet. Failure insubmission of this statement will lead to summary rejection of offer.

The tenderer must have successfully completed or substantiallycompleted any one of the following categories of work(s) during last 07(seven) years, ending last day of month previous to the one in whichtender is invited: (i) Three similar works each costing not less than theamount equal to 30% of advertised value of the tender, or (ii) Two similarworks each costing not less than the amount equal to 40% of advertisedvalue of the tender, or (iii) One similar work costing not less than theamount equal to 60% of advertised value of the tender. (b) (1) In case oftenders for composite works (e.g. works involving more than one distinctcomponent, such as Civil Engineering works, S&T works, Electrical works,OHE works etc. and in the case of major bridges - substructure,superstructure etc.), tenderer must have successfully completed orsubstantially completed any one of the following categories of work(s)during last 07 (seven) years, ending last day of month previous to theone in which tender is invited: (i) Three similar works each costing notless than the amount equal to 30% of advertised value of eachcomponent of tender, or (ii) Two similar works each costing not less thanthe amount equal to 40% of advertised value of each component oftender, or (iii) One similar work each costing not less than the amountequal to 60% of advertised value of each component of tender. Note forb(1): Separate completed works of minimum required values shall alsobe considered for fulfillment of technical eligibility criteria for differentcomponents. (b)(2)In such cases, what constitutes a component in acomposite work shall be clearly pre-defined with estimated tender cost ofit, as part of the tender documents without any ambiguity. (b) (3) Toevaluate the technical eligibility of tenderer, only components of work asstipulated in tender documents for evaluation of technical eligibility, shallbe considered. The scope of work covered in other remainingcomponents shall be either executed by tenderer himself if he has workexperience as mentioned in clause 7 of the Standard General Conditionsof Contractor through subcontractor fulfilling the requirements as perclause 7 of the Standard General Conditions of Contract or jointly i.e.,partly himself and remaining through subcontractor, with prior approvalof Chief Engineer in writing.

However, if required in tender documents by way of Special Conditions, aformal agreement duly notarized, legally enforceable in the court of law,shall be executed by the main contractor with the subcontractor for thecomponent(s) of work proposed to be executed by the subcontractor(s),and shall be submitted along with the offer for considering subletting ofthat scope of work towards fulfilment of technical eligibility. Suchsubcontractor must fulfill technical eligibility criteria as follows: Thesubcontractor shall have successfully completed at least one worksimilar to work proposed for subcontract, costing not less than 35%value of work to be subletted, in last 5 years, ending last day of monthprevious to the one in which tender is invited through a works contract.Note: for subletting of work costing up to Rs 50 lakh, no previous workexperience of subcontractor shall be asked for by the Railway. In caseafter award of contract or during execution of work it becomes necessaryfor contractor to change subcontractor, the same shall be done withsubcontractor(s) fulfilling the requirements as per clause 7 of theStandard GeneralC conditions of Contract, with prior approval of ChiefEngineer in writing. Note for Item 10.1: Work experience certificate fromprivate individual shall not be considered. However, in addition to workexperience certificates issued by any Govt. Organization, workexperience certificate issued by Public listed company having averageannual turnover of Rs 500 crore and above in last 3 financial yearsexcluding the current financial year, listed on National Stock Exchange orBombay Stock Exchange, incorporated/registered at least 5 years prior tothe date of closing of tender, shall also be considered provided the workexperience certificate has been issued by a person authorized by thePublic listed company to issue such certificates. In case tenderer submitswork experience certificate issued by public listed company, the tenderershall also submit along with work experience certificate, the relevantcopy of work order, bill of quantities, bill wise details of paymentreceived duly certified by Chartered Accountant, TDS certificates for allpayments received and copy of final/last bill paid by company in supportof above work experience certificate.

Substantially Completed Work means an ongoing work in which paymentequal to or more than 90% of the present contract value (excluding thepayment made for adjustment of Price variation (PVC), if any) has beenmade to the contractor in that ongoing contract and no proceedings oftermination of contract on Contractor's default has been initiated. Thecredential certificate in this regard should have been issued not prior to60 days of date of invitation of present tender. 2. In case a work isstarted prior to 07 (seven) years, ending last day of month previous tothe one in which tender is invited, but completed in last 07 (seven)years, ending last day of month previous to the one in which tender isinvited, the completed work shall be considered for fulfillment 1.1.1 ofcredentials. 3. If a work is physically completed and completioncertificate to this extent is issued by the concerned organization but finalbill is pending, such work shall be considered for fulfillment ofcredentials 4. In case of completed work, the value of final bill (grossamount) including the PVC amount (if paid) shall be considered as thecompletion cost of work. In case final bill is pending, only the total grossamount already paid including the PVC amount (if paid) shall beconsidered as the completion cost of work. In case of substantiallycompleted work, the total gross amount already paid including the PVCamount (if paid), as mentioned in the certificate, shall be considered asthe cost of substantially completed work.

The" Similar Work " is defined as "Complete Land acquisition for projectssuch as Roads, Railway or Airports from initial phase to ownership transfer" Failure in submission of completion certificate/s and other documents as per afore mentioned clauses will lead to summary rejection of offer.

If the earnest Money deposited by the bidder is in shape of BankGuarantee, it should be prepared in favour of "FA&CAO/C/NCR"on non-Judicial Stamp paper having stamp duty of 0.5% of theBG value subject to a maximum of Rs. 10,000/-, failing which thebid will be summarily rejected.

Tenderer must upload attested copy of PAN card of his own(Proprietary Firm) / Partnership Firm / company /Joint Venture(JV) / Registered Society /Registered Trust etc. whatever isapplicable, on behalf of tender has been submitted.

Following documents must be submitted if Work ExperienceCertificate submitted in Technical Eligibility Criteria has beenissued by Public listed company. As per Clause No.17 of Tender Form (Second Sheet)Annex. I ofPart-I of GCC-2022, the tenderer shall clearly specify whetherthe tender is submitted on his own (Proprietary Firm) or onbehalf of a Partnership Firm /company / Joint Venture (JV) /Registered Society /Registered Trust etc. For this, tenderer shallsubmit information as per Annexure- with the attested copiesofthe constitution of their concern. If it is NOT mentioned in thesubmitted tender that tender is being submitted on behalf of aSole Proprietorship firm / Partnership firm /Joint Venture /Registered Company etc., then the tender shall be treated ashaving been submitted by the individual who has signed thetender (As per Clause No.14(ii)(d) of Tender Form (SecondSheet) Annex. I of Part-I of GCC-2022).

As per Clause No. 14 of Tender Form of Part-I of GCC-2022) Thetenderer whether sole proprietor, a company or a partnershipfirm / LLP / registered society /registered trust etc. if they wantto act through agent orindividual partner(s), should submit acopy of power of attorney duly stamped and authenticated by aNotary Public or by Magistrate in favour of the specificpersonwhether he/they be partner(s) of the firm or anyotherperson specifically authorizing him/them to sign thetenderdocuments, submit the tender & create liability against firm /company / LLP / society / trust, sign the agreement, receivemoney, co-ordinate measurements through contractor'sauthorized engineer, witness measurements, sign measurementbooks, compromise, settle, relinquish any claim(s) preferred bythe firm and sign "No Claim Certificate" and refer all or anydisputes to arbitration. Tenderer must submit this power ofattorneyin Proforma depending upon type of firm. Offer will besummarily rejected in case of non-submission of such document.

Tenderer must submit list of Plants & Machinery availableonhand (own) and proposed to be inducted and hired for thetendered work

Tenderer must submit list of Personnel/ Organization availableon hand and proposed to be engaged for the tendered work inproforma

In case, tender has been submitted on behalf of partnershipfirm, tenderer must upload partnership deed complying withClause 18.2 of Tender Form (Second Sheet) Annex. I of Part-I ofGCC- 2022. Offer will be summarily rejected in case of nonsubmission of such document.

In case, tender has been submitted on behalf of LLP (LimitedLiability Partnership) registered under LLP Act-2008, tenderermust submit following documents: (i) LLP Agreement (ii)Certificate of Incorporation (iii) Resolution passed by partners ofLLP firm for submitting tender by LLP firm and to deal withtender on behalf of the firm. Offer will be summarily rejected incase of non-submission of such documents.

In case, tender has been submitted on behalf of RegisteredSociety & Registered Trust, tenderer must submit followingdocuments: (i) Certificate of Registration(ii) Deed of Formation.Offer will be summarily rejected incase of non- submission ofsuch documents.

Tenderer must submit an undertaking that neither I / We(nameof the sole Proprietor Firm / Partnership Firm /Limited Company /LLP / Registered Society / Trust / JV firm) nor any of the partneror partnership firm / LLP /Member of Registered Society / Trust /Constituent of JV firm including partner of partnership firm in JVhas / have been black listed or debarred by Railway or any otherMinistry / Department / Public Sector Undertaking of theGovernment of India / any State Govt. from participation intenders / contracts as on the date of opening of bids,either inour individual capacity or in any firm in which we were / arepartners. Concealment / wrong information inregard to aboveshall make the contract liable fordetermination under Clause 62of the General Conditionsof Contract. Offer will be summarilyrejected in case of non-submission of such document.

An undertaking by all partners of the LLP that they are notblacklisted or debarred by Railways or any other Ministry /Department of the Govt. of India from participation in tenders /contracts as on the date of submission of bids, either in theirindividual capacity or in any firm/LLP or JV in which they were /are partners/members. Concealment / wrong informationinregard to above shall make the contract liable fordetermination under Clause 62 of the Standard GeneralConditions of Contract

In case, tender has been submitted on behalf of companyregistered under Companies Act-2013, tenderer must submitfollowing documents: (i)Memorandum of Association (MOA) (ii)Article of Association (AOA) (iii) Resolution passed by Board ofDirectors authorizing its Director / employee to deal with tenderon behalf of company. Offer will be summarily rejected in caseof non-submission of such documents.

For consideration ofbalance sheet of the fourth previous year, a certificate statingthat the balance sheet of the previous year is yet to beprepared/ audited certified by the Chartered Accountant shall besubmitted. Without this certificate, balance sheet of the fourthprevious year shall not be considered.

All documents signed by CA should mandatorily have UniqueDocument Identification Number (UDIN) on the document. Thedocument uploaded should be verifiable from UDIN portal byentering UDIN mentioned on document. Failing this, documentshall not be considered for evaluation
