The tenderer must have minimum average annual contractual turnoverof V/N or 'V' whichever is less; where V= Advertised value of the tenderin crores of Rupees; N= Number of years prescribed for completion ofwork for which bids have been invited. The average annual contractualturnover shall be calculated as an average of "total contractualpayments" in the previous three financial years, as per the auditedbalance sheet. However, in case balance sheet of the previous year isyet to be prepared/ audited, the audited balance sheet of the fourthprevious year shall be considered for calculating average annualcontractual turnover. In this reference, fourth previous year shall beconsidered only if bidder(s) give their consent in Annexure VIB as"previous year is yet to be prepared/ audited". The tenderers shallsubmit requisite information as per Annexure-VIB, along with copies ofAudited Balance Sheets duly certified by the CharteredAccountant/Certificate from Chartered Accountant duly supported byAudited Balance Sheet. Criteria with explanation & Format are attachedas a link.
(a) Attested Certificates(s) issued by Executive or Nominated Authority ofthe government Departments or Semi-Government/Public SectorUndertakings for the value of the work done for them during thequalifying period including current financial year certifying the billamounts paid Agreement-wise and Date-wise or attested photo copy ofsuch certificate. Such certificates will be accepted only from Govt. / Govt.bodies / PSUs authorities. Certificates issued by Private Bodies will not beconsidered.
NOTE: (i) Financial Year shall normally, be reckoned as 1st April to 31stMarch of the Next Year. However, for Turnover Criteria, the FinancialYear as applicable to the Company /Tenderer is to be considered, if itdefers from the above. (ii) Current Financial year is reckoned as theincomplete Financial year in which the date of tender submission falls.(iii) Chartered Accountant statements duly indicating yearly receipts willnot be considered until and unless backed by Audited Balance Sheets orProvisional Balance sheet. (iv) If the tender is not accompanied by thecertificate(s) in support of financial eligibility as above, the tender shallbe rejected. No post-tender correspondence will be entertained.
If JV firms are allowed to participate; Financial eligibility of the JV Firmshall be adjudged based on satisfactory fulfillment of the Para No.17.15.2of J.V guide lines of IRSGCC April - 2022 [with up to date correction slip]
10. Eligibility Criteria: 10.1 Technical Eligibility Criteria: (a) The tenderermust have successfully completed or substantially completed any one ofthe following categories of work(s) during last 07 (seven) years, endinglast day of month previous to the one in which tender is invited:(i) Threesimilar works each costing not less than the amount equal to 30% ofadvertised value of the tender, or (ii) Two similar works each costing notless than the amount equal to 40% of advertised value of the tender, or(iii) One similar work costing not less than the amount equal to 60% ofadvertised value of the tender. (b) (1) In case of tenders for compositeworks (e.g. works involving more than one distinct component, such asCivil Engineering works, S&T works, Electrical works, OHE works etc. andin the case of major bridges - substructure, superstructure etc.),tenderer must have successfully completed or substantially completedany one of the following categories of work(s) during last 07 (seven)years, ending last day of month previous to the one in which tender isinvited:(i) Three similar works each costing not less than the amountequal to 30% of advertised value of each component of tender, or (ii)Two similar works each costing not less than the amount equal to 40% ofadvertised value of each component of tender, or (iii) One similar workeach costing not less than the amount equal to 60% of advertised valueof each component of tender. Note for b(1): Separate completed worksof minimum required values shall also be considered for fulfillment oftechnical eligibility criteria for different components. (b)(2)In such cases,what constitutes a component in a composite work shall be clearlypredefined with estimated tender cost of it, as part of the tenderdocuments without any ambiguity. (b) (3) To evaluate the technicaleligibility of tenderer, only components of work as stipulated in tenderdocuments for evaluation of technical eligibility, shall be considered. Thescope of work covered in other remaining components shall be eitherexecuted by tenderer himself if he has work experience as mentioned inclause 7 of the Standard General Conditions of Contractor throughsubcontractor fulfilling the requirements as per clause 7 of the StandardGeneral Conditions of Contract or jointly i.e., partly himself andremaining through subcontractor, with prior approval of Chief Engineerin writing. However, if required in tender documents by way of SpecialConditions, a formal agreement duly notarised, legally enforceable in thecourt of law, shall be executed by the main contractor with thesubcontractor for the component(s) of work proposed to be executed bythe subcontractor(s), and shall be submitted along with the offer forconsidering subletting of that scope of work towards fulfilment oftechnical eligibility. Such subcontractor must fulfill technical eligibilitycriteria as follows:The subcontractor shall have successfully completedat least one work similar to work proposed for subcontract, costing notless than 35% value of work to be subletted, in last 5 years, ending lastday of month previous to the one in which tender is invited through aworks contract. Note: for subletting of work costing up to Rs 50 lakh, noprevious work experience of subcontractor shall be asked for by theRailway.
The total value of similar nature of work completed during the qualifyingperiod and not the payments received within qualifying period alone,shall be considered. In case, final Bill of similar nature of work has notbeen passed and final measurements have not been recorded, the paidamount including statutory deductions will be considered. If finalmeasurements have been recorded and work has been completed withnegative variation, then also the paid amount including statutorydeductions will be considered. However, if final measurements havebeen recorded and work has been completed with positive variation butvariation has not been sanctioned, original agreement value or lastsanctioned agreement value whichever is lower shall be considered forjudging eligibility.
In case JV firms are allowed to participate, Technical Eligibility of the JVFirm shall be adjudged based on satisfactory fulfillment of the ParaNo.17.15.1 of J.V. guide lines of IRSGCC April-2022 [read with up to datecorrection slip]
Tenderer shall carefully read clause No. 10 including clause no. 10.1 to10.5 of IRGCC April 2022.
The value of work completed will not include the cost of any materialsissued free of cost by the Railway/ Department concerned. PriceVariation amount, if any; if indicated / incorporated in the experiencecertificate will also be considered towards eligibility.
Work experience certificate from private individual shall not beconsidered. However, in addition to work experience certificates issuedby any Govt. Organization, work experience certificate issued by Publiclisted company having average annual turnover of Rs 500 crore andabove in last 3 financial years excluding the current financial year, listedon National Stock Exchange or Bombay Stock Exchange,incorporated/registered at least 5 years prior to the date of closing oftender, shall also be considered provided the work experience certificatehas been issued by a person authorized by the Public listed company toissue such certificates.
The work experience certificate shall be in the name and style of thetenderer participating or as per provisions under Clause 17.15 of GCCApril-2022 for JV Firm, if eligible to participate. [with up to date correctionslip]
The work experience certificate shall be issued by an officer not belowthe rank of JA Grade or Bill passing Officer in Railways and Bill passingOfficer/Executive In-charge of work in other Govt. / Govt. bodies / PSUs.The certificate should bear the signature and seal of the issuing officer,name of the department etc. In case tenderer submits work experiencecertificate issued by public listed company, the tenderer shall also submitalong with work experience certificate, the relevant copy of work order,bill of quantities, bill wise details of payment received duly certified byChartered Accountant, TDS certificates for all payments received andcopy of final/last bill paid by company in support of above workexperience certificate.
Similar nature of work:"Any type of civil work viz. building and structures work, pipelines, underground and overhead tanks, foundation treatment works in any railway embankment/cutting, any earthwork, cover over platform, bore wells, level crossing works including lifting barriers, cement concrete apron works, etc."
Tenderer shall carefully read clause No. 10 including clause no. 10.1 to10.5 of IRGCC April 2022.
In case after award of contract or during execution of work it becomesnecessary for contractor to change subcontractor, the same shall bedone with subcontractor(s) fulfilling the requirements as per clause 7 ofthe Standard General Conditions of Contract, with prior approval of ChiefEngineer in writing. Note for Item 10.1: Work experience certificate fromprivate individual shall not be considered. However, in addition to workexperience certificates issued by any Govt. Organisation, workexperience certificate issued by Public listed company having averageannual turnover of Rs 500 crore and above in last 3 financial yearsexcluding the current financial year, listed on National Stock Exchange orBombay Stock Exchange, incorporated/registered at least 5 years prior tothe date of closing of tender, shall also be considered provided the workexperience certificate has been issued by a person authorized by thePublic listed company to issue such certificates. (i) The tenderer shall clearly specify whether the tender issubmitted on his own (Proprietary Firm) or on behalf of aPartnership Firm / Company / Joint Venture (JV) / RegisteredSociety / Registered Trust / Hindu Undivided Family (HUF) /Limited Liability Partnership (LLP) etc. The tenderer(s) shallenclose the attested copies of the constitution of their concern,and copy of PAN Card along with their tender. TenderDocuments in such cases are to be signed by such persons asmay be legally competent to sign them on behalf of the firm,company, association, trust or society, as the case may be. (ii)documents shall be submitted according to clause 14 of IRGCC2022:

All requisite documents are to be properly submitted online onlyand the bidders should ensure that the content of thedocuments uploaded is distinctly legible /readable. Non- readabledocuments will not be considered and will not be asked againafter tender opening date.
No Technical and Financial credentials are required for tendershaving value up to Rs 50 lakh. For tenders valuing more than Rs.50.00 lakh: The offer of Tenderer(s) who do not encloseExperience Certificate & Turnover Certificate with requisitedetails, and supporting documents along with their Tender toestablish their credentials shall be summarily rejected, eventhough they are working contractors or contractors on approved
Any Certificate /Documents offered / submitted /received afterthe tender opening shall not be given any credit and shall not beconsidered.
Increase/decrease of TAXES: if rates of existing GST or cess onGST for Works Contract is increased or any new tax /cess onWorks Contract is imposed by Statute after the date of openingof tender but within the original date of completion/date ofcompletion extended under clause 17 & 17A and the Contractorthereupon properly pays such taxes/cess, the Contractor shall bereimbursed the amount so paid. Further, if rates of existing GSTor cess on GST for Works Contract is decreased or any tax/cesson Works Contract is decreased / removed by Statute after thedate of opening of tender, the reduction in tax amount shall berecovered from Contractor's bills/Security Deposit or any otherdues of Contractor with the Government of India.
Fixed Deposit Receipts (FDRs) submitted after award of tendertowards Security Deposit/Performance Guarantee should be withautomatic renewal facility only
Tenderer(s) shall note that conditional/alternate offer will not beconsidered and will summarily be rejected, even though suchcondition makes them as the lowest tenderer
Shramik kalyan While processing payment of any 'On AccountBill' or 'Final Bill' or release of 'Advances' or 'PerformanceGuarantee / Security deposit', contractor shall submit acertificate to the Engineer or Engineer's representatives that "Ihave uploaded the correct details of contract labours engaged inconnection with this contract and payments made to themduring the wage period in Railway's Shramikkalyan portal at'www.shramikkalyan.indianrailways.gov.in' till ____Month,____Year.
Date of inviting tender shall be the date of publishing tendernotice on IREPS website if tender is published on website or thedate of publication in newspaper in case tender is not publishedon website
A)An offer shall become invalid: - (i) if the Bid Security is not paidOnline. (ii) if the offer is not digitally signed by the tenderer / bythe Attorney / by the person authorized by the tenderer to signand submit the tender on his/their behalf. (iii)if any individual/Proprietor / Partnership Firm / Company /JV Firm/HUF/Societyetc. uploads more than one offer either in his/their individualcapacity or as a Proprietor or as a Partner/Member ofPartnership Firm / JV Firm / HUF / Society etc. or as a Director ofany Company, etc. B)An offer shall get summarily rejected if thefollowing documents are not submitted /attached with offer asper the list mentioned in the tender documents: - (i) Documentsas applicable in case of Proprietary concern/ Partnership firm / JVFirm / Company/HUF/Society/LLP Firm, etc. (ii) Annexure-V(A)linked under heading submission of Standard Format is to besubmitted by the each member in case of a Partnership Firm /Joint Venture (JV) / Hindu Undivided Family (HUF) / LimitedLiability Partnership (LLP) etc.,. (iii) Ballast test certificate, ifapplicable. (iv) Any other document required for evaluation ofthe bid. C)An offer shall get summarily rejected if the tendereradds any condition on his/their own (anywhere in the e-offer),which is in violation of the Railway's Tender Conditions. D) Anoffer shall become ineligible for award of the tendered work ifthe tenderer does not fulfil the Eligibility Conditions, (both theStandard Financial Eligibility Criteria and the Standard TechnicalEligibility Criteria) prescribed in the Tender Documents and bidcapacity if applicable.

IN CASE OF ADVERTISED TENDER VALUE IS MORE THAN RS. 10CRORES: The tender/technical bid will be evaluated based on bidcapacity formula detailed as Annexure-VI of IRSGCC April - 2022.NOTE: i)The Tenderer(s) shall furnish the details of existingcommitments and balance amount of ongoing works withtenderer as per the prescribed proforma of Railway forstatement of all works in progress and also the works which areawarded to tenderer but yet not started up to the of inviting oftender. In case of no works in hand, a 'NIL' statement should befurnished. This statement should be submitted duly verified byChartered Accountant.(ii) In case, the tenderer/s failed to submitthe above statement along with offer, their/his offer shall beconsidered as incomplete and will be rejected summarily
IN CASE OF ADVERTISED TENDER VALUE IS MORE THAN RS. 50CRORES: Electronic Reverse Auction (e-RA) method will beapplicable as per guide lines issued by Railway Board vide Lr no.2017/Trans/01/Policy/Pt-S Dt 28/3/2018. (Copy attached in thelist of documents)
Price Variation Clause (PVC) is applicable If the advertisedtender value above Rs.2 Crores. (As per letter No.2022/CEI/GT/GCC2022/Policy dated 14.07.2022) As detailed in -Para 46A of IRGCC April - 2022 attached to the tender in - DOCUMENTS. Base Month: The Base Month for 'Price VariationClause' shall be taken as the one month prior to closing oftender, unless otherwise stated elsewhere. The quarter forapplicability of PVC shall commence from the month followingthe Base month. The Price Variation shall be based on theaverage Price Index of the quarter under consideration. [with upto date correction slip/ Railway Board Letter].
The Bid Security shall be deposited either in cash throughepayment gateway or submitted as Bank Guarantee bond froma scheduled commercial bank of India or as mentioned in tenderdocuments. The Bank Guarantee bond shall be as perAnnexureVIA and shall be valid for a period of 90days beyondthe bid validity period. In case, submission of Bid Security in theform of Bank Guarantee, following shall be ensured: (i).Ascanned copy of the Bank Guarantee shall be uploaded oneProcurement Portal (IREPS) while applying to the tender.(ii).The original Bank Guarantee should be delivered to ChiefOffice Superintendent Rate before closing date for submission ofbids i.e., excluding the last date of submission of bids. (ACS-5dtd 20.10.2023). (iii)Non submission of scanned copy of BankGuarantee with the bid on etendering portal (IREPS) and/or nonsubmission of original Bank Guarantee within the specifiedperiod shall lead to summary rejection of bid. (iv) The TenderSecurity shall remain valid for a period of 90 days beyond thevalidity period for the Tender. (v) The details of the BG,physically submitted should match with the details available inthe scanned copy and the data entered during bid submissiontime, failing which the bid will be rejected (vi).The BankGuarantee shall be placed in an envelope, which shall be sealed.The envelope shall clearly bear the identification "Bid for the***** Project" and shall clearly indicate the name and address ofthe Bidder. In addition, the Bid Due Date should be indicated onthe right hand top corner of the envelope. (vii)The envelopeshall be addressed to the officer and address as mentioned inthe tender document. (viii).If the envelope is not sealed andmarked as instructed above, the Railway assumes noresponsibility for the misplacement or premature opening of thecontents of the Bid submitted and consequent losses, if any,suffered by the Bidder
We fail to submit the requisite Performance Guarantee [P.G] inthe prescribed format even after 60 (Sixty days) from the dateof issue of Letter of Acceptance, we are aware that the contractliable to be terminated duly forfeiting Bid Security and otherdues, if any payable against the contract.
The work shall be maintained after completion for a period of 24 months by the contractor and he shall make good any defects,imperfection shrinkages or faults which may appear at his own cost.
IN CASE OF ADVERTISED TENDER VALUE IS MORE THAN RS. 10CRORES: Bid capacity is applicable, the tenderers should submitbid capacity as per proforma attached in tender DOCUMENTS. Incase, the tenderer/s failed to upload BID CAPACITY PROFORMAalong with offer, their/his offer shall be considered as incompleteand will be rejected summarily.
