   Regular Order [Minimum 80%]- Only those firms will be considered for placement of regular order who have (i) successfully commissioned minimum 01 (one) set of the equipment (tendered item) in 3 phase Electric Locomotives over Indian Railways and prototype clearance has been issued as on tender closing date and/ or (ii) Successfully supplied and commissioned the propulsion equipment which are tested and approved for regular use by CLW/BLW Traction Converter, Auxiliary converter and Vehicle Control Unit. They should have proven capability for successful interfacing and commissioning of these equipment in 3-phase Electric Locomotives over Indian Railways as on Tender closing date.

   Developmental order [Up to 20%]-Bidder shall fullfil the following conditions of eligibility for considering them technically suitable for developmental order. (i) Designed, developed and supplied minimum 1(One) Propulsion Equipment of electric/diesel locomotive/EMU/DEMU for Indian Railway which shall be under commercial service as on the tender closing date, or (ii) Designed, developed and supplied Propulsion equipment for Railway locomotives of minimum 4000 HP worldwide which shall be in commercial service for a period of minimum 2 years preceding the tender closing date. (iii) In case the bidder has not supplied the vehicle control unit, the bidder can source the vehicle control unit from established and approved source.

   The firms who do not fulfil the criteria either for placement of regular order or for developmental order, they must submit their credential details i.e., Machinery and Plant, Testing Facilities, QAP, Technical manpower etc. In deserving cases, offers from new suppliers may be considered for only a small quantity not more than 5 percent of the tendered quantity.

   The bidder must provide source code and complier of software of Traction Converter, Auxiliary Converter and Vehicle Control Unit (VCU to WCR). The option of " ...... long term life time support ....... " as an alternate of " ........ source code and complier of software ....... It is also certified that we shall also not use any other category of plastic, such as Bio compostable or Oxo- degradable or Oxo-bio-degradable or the like, which are not recognized under Plastic Waste Management Rule 2016 with all amendments.

   Conditions for Annual Maintenance after expiry of Warranty period of the equipment: A contract will be concluded by homing shed where the locomotives installed with IGBT BASED 3-PHASE DRIVE PROPULSION EQUIPMENT will be homed. Execution of contract for maintenance of the equipment will be monitored by concerned homing shed Authority. Rate of maintenance of equipment is already mentioned in this tender.

   CONTRACT PERFORMANCE GUARANTEE FOR AMC:The contactor shall submit to concerned homing shed performance Guarantee for amount equivalent to 5 % of contract agreement for (MX12 + 2) months where M is the no. of months for which contract agreement is to be signed. This Performance Guarantee shall be in the form of Bank Guarantee. The user Railway may forfeit the BG in case of the failure of the firm in execution of the contract or in the event of breach of any terms and conditions of contract by the contractor. Reference as per AMC para 15.0.

   The bidders/ tenderers have to quote the rates for Capital cost of IGBT BASED 3- PHASE DRIVE PROPULSION EQUIPMENT i.e. supply, installation, testing and commissioning of IGBT BASED 3-PHASE DRIVE PROPULSION EQUIPMENT system. During the maintenance period after completion of warranty period, the Contractor shall be paid for its Maintenance obligations @ 2.5% (Two point five percent) of the total Capital cost of IGBT BASED 3-PHASE DRIVE PROPULSION predefined cost of AMC equipment pertaining to the fleet in holding with Authority per annum, from the date of completion of Warranty Period till completion of Maintenance (i.e. 03 years after expiry of normal warranty period).

    Formula for Price adjustment for Maintenance Price (WPI): Lump sum payment for Maintenance shall be adjusted every quarter for changes in rates and prices of various inputs in accordance with the formula given below: V=P x (Wi -W0)/W0 Where V = Increase or decrease in the quarterly lump sum payment p = quarterly lump sum payment due to the Contractor after adjusting any reduction in payment for noncompliance of the Maintenance Requirements. Bidders shall certify that none of their sister concern or affiliates (such as having common partner/director/promoter/owner/holding company decision control etc.) have participated in this tender & which can give rise to a conflict of interest or fall under anti-competitive practices.The offers of all such sister concern or affiliates if quoted are liable to be rejected as per relevant provisions of IRS terms and conditions. Bidders shall abide by the Code of Integrity in general, with specific reference to conflict of interest [Para 2502 (e)], anti competitive practices [Para 2502(c)] and obligation to proactive disclosures [Para 2503]. Bidders shall fully responsible for the declaration/certification regarding Code of Integrity, Misdemeanor and Penalties given in commercial compliance and it shall not be the Railways responsibility to verify the same.    Inspection:For Regular Orders: Inspection by TPI agency at firm's premises. For Developmental Order: Capacity-cum- capability assessment followed by prototype approval byRDSO/CLW/BLW, if not done earlier for the tendered item. Inspection of balance qty is to be done by TPIagency at firm's premises. Note- Special conditions for inspection through TPI are as per Annexure-II (uploaded).

   INSPECTION OF BOUGHT OUTS & CRITICAL RAW MATERIALS: 1) Inspecting Engineer of Inspecting Agencyshall ensure that all the documents,i.e. Tax Invoice (priced or un-priced), Import documents (if any), Testcertificates/WTC, Delivery Challan etc. of all the bought outs & Test certificates of critical raw materials,submitted by Principal firm or Sub vendor at the time of inspection are original and relate to each other in allrespects as per requirement of the purchase order to ensure that the Bought Outs & critical raw materialshave been genuinely procured from approved sources or as per PO. A copy of all such documents shall be uploaded & provided by the Inspecting Engineer along with the Inspection Certificate to WCR along withcomplete traceability records like Sr. No. Make etc. Inspection certificate issued without these documents willbe considered as incomplete Inspection Certificate. 2) Firm should provide all the above stated documentsas required by the Inspecting Engineer of Inspecting Agency for verification and uploading by the InspectingEngineer along with the Inspection Certificate. Bills of the firm will not be passed with incomplete InspectionCertificate issued without these documents.

   The condition of comprehensive annual maintenance contract after completion of warranty period will be as per the tendered specification no.CLW/AMC/CD& D/01 issued on March 2016 which will be executed by the Homing Shed where the loco will be homed. This supply contract will include rate of AMC but the actual AMC will be operated by homing shed and the supplier will be bound to accept the AMC at this rate.

   Warranty clause- As per clause 2 of special condition of contract i.e. The Warranty of the complete system will be 72 months from the delivery or 60 months from the date of satisfactory commissioning and acceptance test of the item, whichever is earlier. The contractor shall ensure round the clock availability of qualified engineer at the nominated electric loco shed for the first two years. After expiry of warranty, the AMC for three years as per terms and conditions shall be applicable.
