Special Eligibility Criteria

   Tenderer with satisfactory past performance for the tendered item within last 3 years for minimum 20 percent of the tendered quantity against a single order to any Zonal railway or railway PUs shall only be eligible for full/bulk order. If such past supply performance level is lower than as required for bulk order (i.e. minimum 20 percent), then the offer may be considered for placement of developmental order not exceeding to 20 percent of the net procurable quantity. For past performance firm should attach proof of supply signed by either purchaser, consigner, inspector nominated by purchaser (should not be firm representative). For this purpose receipt note, inspection certificate, CRAC, receipted challan, work completion certificate etc. should be attached with bid. Proof of supply should clearly indicate quantity supplied and date of supply. Only copy of purchase order, self signed tax invoice, self made performance statement will not establish that supply has been completed. In case tenderer participate as an authorized agent, then the performance as required above shall be that of the Principal, authorizing the agent. It may so happen that the agent has credentials of past supply for a different Principal but this will not be considered as performance for placing bulk order in case of change of Principal

   TENDER SPECIFIC AUTHORIZATION: - Authorized agents of OEM must submit Tender Specific Authorization of the OEM. No back reference will be made in this regard & communication received after opening of tender will also not be entertained. The material supplied by the traders will be inspected at the OEM premises by the inspecting agency before supply. Neither one agent can represent two OEMs nor can one OEM authorize two agents. Purchaser reserves the right to reject both bids in such cases. In a tender either the Agent on behalf of the OEM or OEM itself can bid but both cannot bid simultaneously for the same item in the same tender. In cases where both OEM and their agent participate in bidding for same item, any or both the bids shall be summarily rejected

   ONUS OF SUBMISSION OF REQUISITE DOCUMENTS: The onus of submission of requisite documents as given above for establishing their eligibility for bulk or developmental order lies with the tenderer. Tenderers are to note that non submission of the documents as detailed above shall be taken as they are not having any such documents. In such case their offer shall be considered based on their past supply performance as available from Railway's internal digital platform iMMS. No back reference in this regard will be made to them.

   A) The machine should conform to ISO or DIN or JIS or ASTM or other equivalent international standards for accuracy/performance test. Detailed sample Test Charts for the same, clearly showing the accuracies to be achieved on the machine for analytical analysis shall also be submitted with the offer along with the international standard to which the offered machine confirms, to be indicated in the offer. B) OEM/OEM authorized firm should have valid ISO quality certificate.

   Jurisdiction of Court :- As per Para 2.7(C) of IRS Condition of Contract dtd 11.09.2025 the Courts of the place from where the acceptance of tender has been issued shall alone have jurisdiction to decide any dispute arising out of or in respect of the contract.

   PLASTIC WASTE MANAGEMENT RULE 2016 :- "It is certified that for execution of this contract, the plastic packaging material or commodities which are made out of Compostable Plastic or Biodegradable Plastic shall be purchased from firms having certification by CPCB for manufacture or sale of plastic packaging or commodities made from Compostable Plastic or Biodegradable Plastic as per rule 4 (4) of Plastic Waste Management rule 2016. It is also certified that we shall also not use any other category of plastic, such as Bio Compostable or Oxo- degradable or Oxo-bio-degradable or the like, which are not recognized under Plastic Waste Management Rule 2016 with all amendments." (Note: - May confirm as Yes , to certify all the above certification .)

   Firms are expected to quote for quantity not less than 50% of tendered quantity. Offers for a quantity less than 50% of tendered quantity will be considered unresponsive and will be summarily rejected.
